1984-05-02 //3 Planning Board meeting of May 2, 1984 Town of Queensbury Present: Mr. Dybas, Mrs. Mann, Chairman Roberts, Mr. Sorlin Mr. Noll and Hr. Macri, Mr. Threw Meeting called to order by the Chairman and the first order of business was the approval of the minutes of the previous meeting. Minutes were approved as submitted. Chairman opened the public hearing for a new subdivision called ~hp pjnes of Oueensbury. Mr. VanDusen explained that there were 119 lots marked on the map displayed with the average lot being 20,000 sq. ft. He also ex- plained that there would be a few that would be larger and would average about 23,000 sq. ft. Mr. Sorlin noted that on February 1, 1984 conceptual approval was given to this and also asked how many exits there would be to Potter Road and to Kiley Lane. Mr. VanDusen said there would be 3 exits to Potter and Kiley Lane. Mr. Sorlin then asked if it would be strictly single family. !<1r. Woodbury answered that it would be strictly single family. Mr. Sorlin next questioned the drainage problem, and the necessity of hooking into Kiley Lane. t-1r. Scudder, Town Engineer asked if this development was contigous to other developments and Mr. VanDusen said it was. Mr. Scudder then asked if it would be fair to say that this whole area would be developed and Mr. Woodbury said that it would be looked at for feasibility.. It was then suggested that no further approvals be given until a enginneers report is received and then any approvals that are needed can be given at one time. Mr. Woodbury then said they would be back in a month. Mr. Scudder interjected that they should bring any reports in before that time so that he would be able to look them over. Mr. Tucker, resident of pine Road, questioned the raw material coming off the property and what would be done with it. He then presented the Chairman with a copy of the Town Ordinance on the regulation of dumps. Public Hearing was closed. I ~1 Page 2 '- (no actual motion here) Motion to table for further engineering reports by Town Engineer and Project Engineer. site Plan Review, No. 8-84 - Loren Bartholomew - To operate a boat sales and service in Highway Commercial zone. Fred Hathaway explained that there were no problems with the boat sales and also there is plenty of parking space. Warren County Planning Board recommended approval with the condition that Mr. Bartholomew negotiate to purchase all three parcels. The board decided that there was not enough information to act on and that this be tabled so that the applicant could appear. site Plan Review No. 9-84 - Pyramid Company of Glens Falls - To construct canopy colonnade along front of Mall in Plaza Commercial zone at Aviation Mall, Aviation Road. Dennis Elliot, Regional Manager of the Aviation Mall was present to explain request. He explained that the only entrance to these stores would be from the outside. There would be a canopy down the building. The traffic was mentioned and stress put on the parking along the buildings. Warren County Planning Board approved with conditions regarding parking and stopping in front of the area. Mr. Elliott added that this is no problem they have already addressed this problem. Mr. Sorlin questioned signing. Mr. Kane, also from Pyramid, said that the signs are located on the face of the canopy. Abraham Rudnick, Queensbury Gardens, questioned the drainage and stated that the was opposed to this 100% because of the water drainage to his area. Mr. Sorlin interjected that he personally didn't think that this would cause any more problems than what is already there. Public Hearing closed. Motion by Mr. Dybas, seconded by Mrs. Mann all voting affirmatively, it was RESOLVED THAT the Planning Board of the Town of Queensbury approve Site Plan No. 9-84 as it will improve the appearance of the Mall, it will utilize space already there will not increase traffic flow, fire lanes will be kept open . /t~ Page 3 Vairance No. 911 - William and Marie Miller to replace existing camp with larger one-family dwelling with 12 ft. side setback in lieu of the required 15 ft with 42 ft. setback from lake shore in lieu of the required 50 ft. on Fernwood Road on Glen Lake. Chairman asked if he was planning on building a new septic system and Mr. Miller said yes. Mr. Sorlin asked if he had any soil tests made and he answered no. Mr. Sorlin then asked if the building itself would be any closer to the lake and Mr. Miller said no. Chairman noted that this is a unique lot and that he could show his practical difficulty because of the lay of the land. Motion by Mr. Macri, seconded by Mrs. Mann, all voting affirmatively, it was RESOLVED THAT the Planning Board of the Town of Queensbury hereby approves Variance No. 911 as the construction would be the same, the septic system would be new and the practical difficulty is the lot itself. VARIANCE NO. 912 - John J. Walker - - To operate a retail outlet for his logging supply business in Suburban Residential zone on property located northwest side of Route 149, west of Bay Road. Mr. Walker said he would be purchasing the property from Mr. Beakbane and would be using the garage for the small logging business he now operates out of his truck. It would be a small retail outlet and no large equipment would be sold or repaired there. He said the only physical changes would involve changing the driveway into a circlular one. Concern by the members of the Board about the possibility of large trucks parking there. Mrs. Mann asked if many large trucks would be stopping there. Mr. Walker said that he didn't anticipate any large tractor trailer vehicles stopping there. Mr. Sorlin added that you are asking for a variance and that you would have to convince the Zoning Board of Appeals that there is a hardship involved here. He added that he couldn't see where there is a hardship and would find it difficult to recommend approval. Mr. Walker explained why he would like to purchase the property and that he has spoken to many of the area residents and they said they could find no problems with his operation as planned. Chairman once again reminded Mr. Walker that he had to prove hardship for a variance. Mrs. Mann explained just why the area was zoned as it was. I ~ro Page 4 She explained that it was left commercial on the corner of Ridge and Rt . 149. Chairman explained that almost all of the commercial operation in the area now pre existed the zoning and that the Zoning Board makes the final decision on the matter. Motion by Mr. Sorlin, seconded by Mr. Dybas, all voting affirmatively (Yes meaning to deny) RESOLVED THAT the Planning Board of the Town of Queensbury hereby recommendes disapproval of Variance 912 on the basis that it is a residential zone and the applicant has not shown the hardship needed for Use Variance. Disapproved. VARIANCE NO. 913 - Cleverdale Country Store - Corner 9L and Cleverdale Road - Proposed to attach a walk-in cooler to Northwest side of building. Chairman noted that he couldn't find any great problem with the request as presented, they need the cooler. Motion by Mrs. Mann, seconded by Mr. Macri, all voting affirmatively, it was RESOLVED THAT the Planning Board of the Town of Queensbury hereby recommends approval of Variance 913 as the attached cooler will not interfere with traffic, will not cause any problems with the main road, will not be unsightly and it is necessary expansion of the store. There is practical difficulty shown. All voted yes. Approved. Meeting Adjourned. (jLU .ø ~.
