1984-07-03 /~ MINUTES - Queensbury Planning Board Tuesday, July 3, 1984 8:00 p.m. Present: R. Roberts, Chairman Absent: J. Dybas H. Mann R. Noll V. Macri M. Dean, Staff C. Scudder, Engineer P. Naylor, Highway Superintendent Chairman Roberts announced that the Town Board had appointed Mrs. Susan Levandowski to fill the unexpired term of Bill Threw. S. Levandowski K. Sorlin The minutes of the June 6, 1984 meeting were approved as written. NEW BUSINESS: SITE PLAN REVIEW Type II #12-84 - James Forman RC-15 Zone west side Route 9 across from Great Escape To operate a soft ice cream stand in RD-15 Zone on the property situated at the west side of Route 9 across from the Great Escape. Mr. James Forman present. A 15 x 20 foot building would be contructed on an existing slab at the Char Pit to serve the people coming out of Great Escape (take-out ice cream on seasonal basis). Mr. Forman will be leasing from Char Pit owner. Traffic and parking were discussed - primarily walking trade from Great Escape. Mr. Dybas said the State will have to deal with traffic problem on Route 9 in future. Warren County Planning Board feels there would be no overriding inpact as long as adequate parking is provided. No one spoke from the public. Mrs. Mann offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. RESOLVED: The Queensbury Planning Board approve this Site Plan based on one road cut, maintain fencing, keep parking in rear and that applicant see the Beautification Committee. SUBDIVISIONS: LAND 0' PINES, Section 5 No. 2-84 - 91 lots off West Mountain and Peggy Ann Roads - Ruggles and Benack Developers - Coulter & McCormack, Surveyors Public Hearing was held March 6, 1984. Preliminary and final approvals pending further information relative to storm water drainage and road cross sections.Mr. Scudder said that both he and Mr. Naylor had reviewed the plans. Mr. McCormack said they had addressed Dr. Miller's concerns with a 100' stone bed, beyond the stone will be open grass ditching. Letter from Mr. Naylor and Mr. Scudder to Mr. McCormack read and made part of record. IV ~ Page Two Mr. Benack questioned the developer's responsibility for driveway construction and culverts. Mr. Scudder said they were trying to see that the roads be built to specifications and they don't want culverts. If there is need for a culvert, that will be determined by the Highway Superintendent on a case by case basis. The homeowner should have to satisfy the conditions of the building permit (with respect to driveways), administered by the Building Dept. It was noted that the County has a permit system for driveways. Mr. Scudder said the responsibility is on the developer to make sure his contractors do the job according to specifications. Once the roads are accepted, the developer is off the hook. Mr. Naylor asked that he be notified in writing when requesting inspections. He also said that lateral drainage pipe are to be raised and #3 stone be used. Mr. Macri offered motion for preliminary and final approval, seconded by Mr. Noll. Motion carried unanimously. RESOLVED: Preliminary and Final Approval granted for Land 0' Pines Section 5 with Mr. Scudder's letter incorporated and subject to conditions of letter with changes on drawing. WESTLAND SECTION 15 #3-84 - 25 lots Fox Hollow Lane, Coulter & McCormack, Surveyors Public hearing held April 4, 1984. At the June meeting Mr. Scudder had requested a separate drainage map with grading and finished contours. All drainage will be piped. Mr. Scudder feels this is a superior plan. The grading and drainage plan with existing and future contours will be forthcoming. Mr. Roberts will not sign plan until Mr. Scudder's conditions are met. Mr. Macri questioned the contours. He said the road was cut too low (prior to present requirements) and there is a potential problem for construction and erosion. Mr. Noll offered motion for preliminary and final approval, seconded by Mr. Dybas. Mr. Macri abstained as he lives in Westland. Motion carried unanimously. RESOLVED: Preliminary and Final approval granted subject to the conditions in Mr. Scudder's letter and final grading and drainage plan which will show existing contours as well as finished contours. They have Water Dept. and Dept. of Health approvals. OLD ORCHARD SUBDIVISION, Section 3 No. 5-84 - 7 lots Orchard Drive, Coulter & McCormack Surveyors Mr. Scudder and Mr. Naylor's concern is the character of the soil and the groundwater as they relate to road construction. They will be taking a hard look at the road design and wastewater disposal systems. Mr. Roberts read letter from Roger Gebo (DPW) stating no objection to prosposal as shown on plans and profile. Mr. Scudder said they should see what the design looks like - they're not only concerned about wastewater but about the eventual frost heaving that could take place from water in the subgrade of the road. Mr. Scudder said the engineering input on this project is going to be relatively high even though it is a small project. This Subidvision tabled for preliminary and final approval. Public hearing to be held next month. / ?,} Page Three VARIANCE NO. 927 - John Hughes, Bay Road UR-5 - Professional offices to be constructed on lots 1-2-3-4 as shown on proposed subdivision of lands of John M. Hughes. Location is west side Bay Road north of Walker Lane. Mr. John Hughes present. Mr. Roberts said it was felt that this was a variance that the Planning Board should look at since they were involved in it initially in its minor changes to an already approved plan. Mr. Dybas offered motion for approval, seconded by Mr. Noll. Motion carried unanimously. COMMENTS: The Planning Board recommend approval of this use variance as it follows present plans for the Bay Road area and minor changes that they have agreed to previously. OTHER BUSINESS: Discussion regarding change in meeting date from 1st Wednesday of month to the 3rd Tuesday of the month, due to State Law that requires Site Plan Reviews to go to County Planning Board before Town Planning Board can deal with them, thereby holding up applicants longer than was the original intent. Mr. Roberts suggested a memo be sent to both County Planning Board and Queensbury Town Board. Mr. Roberts asked Board if they had received copies of letter he had sent to Tom Hall (DEC) regarding filling in of wetland (Dombek). Mr. Roberts said DEC is making some sort of compromise with him (Dombek) allowing him to fill a little more than what the Board was recommending. They would like to avoid a public hearing on the matter. Mr. Roberts noted that he was unable to locate the section of the ordinance that says you cannot hardsurface or build within 50 ft. of any viable stream or wetland. This should be in supplemental regulations. DEC wetlands mapping is on file with Town Clerk. Mr. Roberts scheduled a workshop meeting with memo to Town Board members re- lating to wetlands and a possible response for 7 pm Tuesday, July 10. Mr. Hazelton - complaint of neighbor adding a woodshed that is devaluating his property. Mr. Dean said that it meets all codes. If there were restrictive deed covenants that would be a civil matter.
