1984-10-16 2{}d MINUTES Queensbury Planning Board Tuesday, October 16, 1984 ',,- Present: R. Roberts, Chairman K. Sorlin, Secretary S. Levandowski J. Dybas H. Mann R.Noll V. Macri R. Bolton - Staff Absent: None The Minutes of the September 5, 1984 were approved as written. OLD BUSINESS: Site Plan Review #18-84 Mrs. Marian Canistraro (HC-15 Zone) Mr. Canistraro and Mr. William Millington, Esq. present. This application resubmitted from previous meeting. Mrs. Mann said the question that had been raised was that Mrs. Canistraro did not know what business she was going to put in building. The parking can only be reviewed when they know what parking is going to be used for. It was noted that application had been changed to show use as antiques and gift shop. Mr. Sorlin stated that living in this building should only be an incidental use. Mr. Del Mulder, representing the Hathaway's submitted a statement indicating their concerns, i.e. what happens if a business isn't run there - are they still going to be allowed to remain on the premises using it as residential property. They have no objection to residential use providing a business is operated. Mr. Sorlin said last month's presentation by Mr. Canistraro looked as if the living was primary use and business incidental. Mr. Canistraro said this would be a summer business. Mr. Sorlin said the strip of land in front of Mr. Canistraro's property is owned by the State and that property is up for grabs from a parking standpoint. Mr. Macri offered motion for approval, seconded by Mrs. Levandowski. Motion carried unanimously. RESOLVED: Recommend approval with the stipulation that business be established prior to occupancy as applied for (antique & gift shop). NEW BUSINESS: Site Plan Review No. 20-84, Dr. Steven J. Karp To construct fourplex town house apartments on 58 acres in Suburban Residential 20 Zone on the property situated at south side Upper Sherman Avenue 1500 ft. east of West Mountain Road. Mr. Gabe Armondo representing Dr. Karp. The first phase will be comprised of 9.37 acres - six buildings with four apartments in each; 1000 sq. ft. luxury type, one bedroom. They pl~m two buildings this year, remainder according to demand. Mr. Roberts said this is a cluster development and the back acreage will remain forever wild. Mr. Roberts also questioned the storm water drainage plan. Mr. Armondo said the total area developed with roofs as well as paving equals 44,304 sq. feet or 11 % of total area. 89% is still permeable and the soils are sandy. Mr. Roberts said he did not anticipate any problems, however, he would like to see more detailed mapping that shows natural drainage course so they will know what happens during spring runoff, etc. - J03 Page Two October 16, 1984 Several residents from Amy Lane questioned the density, drainage and buffer zones. They would like to see larger buffer zone. Mr. Sorlin pointed out that the entire 9.37 acre parcel could be developed into 20 single family residences with 10 foot setbacks and unlimited bedrooms. Mrs. Mann asked what type septic. Mr. Armondo said it would be precast concrete and drain fields. In response to a question, Mr. Armondo said that they do not anticipate at this time to ask Town to take roads. Mr. Roberts suggested that they buDöroads to Town specs. Mr. Roberts said as this progresses with next expansion they would have to have environmental assessment form. Mr. Sorlin questioned the name of development "Queen Pines" noting that the Town is saturated with "Pines". Mr. Macri offered motion to table until next meeting for better site drainage and topographical, seconded by Mrs. Levandowski. Motion carried unanimously. Mr. Roberts said that possibly a special meeting could be called if he submitted the necessary drainage plan, in order that construction could begin this year. Site Plan Review No. 21-84 Barrett Driv-Ur-Self Inc. PC-1A To construct and operate a gasoline service station and auto and truck rental business in Plaza Commerciall Acre Zone on the property situated at south- west side Quaker Road approximately 1500 ft. northwest of Dix Ave/Quaker Rd. intersection. The Barrett's will close Dix Ave operation. Warren County Planning Board recommended approval. This will be an Agway gas station, as an auxillary usage they will continue to rent cars and trucks. Gas operation will be open 24 hours. The service bays will service their fleet, no outside business. Mr. Noll offered motion for approval, seconded by Mrs. Mann. Motion carried unanimously. RESOLVED: The Planning Board recommend approval with the stipulation that applicant meet with Beautification Committee to finalize plans. SUBDIVISIONS: Bedford Close - Section 5 Mr. Tom McCormack present. There is a new entrance to this section which provides access to West Mountain Road. They will be looking for preliminary approval next month. They have acquired more property. With regard to drainage they have uncovered a 24 inch county storm sewer that dumps into Clendon Brook. The invert of that pipe is about 12 feet below lowest part of property. They have not yet done profiles but know what drainage plan ÏMrs. Mann offered motion for Sketch Plan approval of Section 5, seconded by Mr. Dybas. Motion carried unanimously. RESOLVED: Planning Board recommend approval of Sketch Plan for Section 5 of Bedford Close development. -- :J otj Page Three October 16, 1984 Court House Estates - Section 3 Mr. Tom McCormack Tom and son John are developers. A portion of the property is in HC zone, remainder in SFR 30. They are proposing to build town houses which would require a variance or rezoning. This would be a good buffering between com- mercial and residential. Mr. Sorlin said he had a problem with granting variances in the SFR zone. If they start giving variances they will be getting away from what they wanted for pure single family residential. They would not be lowering property values because townhouses would be in before any single family development. Mrs. Mann offered motion for Sketch Plan approval of Section 3, seconded by Mr. Noll. All voted in favor with the exception of Mr. Dybas and Mr. Sorlin who voted no. RESOL VED: The Planning Board grants Sketch Plan approval in concept for Section 3 with proposed multi-family housing in northwest corner. Specifically feel that multi family housing would present a good buffer area between the commercial strip on Route 9 and the single family residences which are planned for the east and south of multi family dwellings. Since we cherish the concept of SFR zone staying pure, this multi family area would not intrude on the zone but merely buffer it. Pheasant Walk - Peggy Ann Road 13 lots Phase 1 Mr. Leon Steves present. Lots are 100 x 200, presently served with water and power. Drainage plan will be forthcoming. Mr. Dybas offered motion for sketch plan approval, seconded by Mrs. Mann. Motion carried unanimously.
