1984-11-20 o1oS MINUTES Queensbury Planning Board November 20, 1984 Present: R. Roberts, Chairman K. Sorlin, Secretary S. Levandowski H. Mann R.Noll V. Macri M. Dean, Staff The Minutes of the October 16 meeting were approved as written. NEW BUSINESS: Site Plan Review #22-84 T. Lawrence Reynolds For conversion of rental cottage to single-family residential use in LR-1A zone on property situated at the west side of Cleverdale Road at intersection of Rockhurst Road. Public Hearing. Larry Reynolds, real estate consultant, representing owners Ralph & Elizabeth Shoenherr. Mr. Roberts noted that they were not dealing with any increased density, no change in use. The Warren County Planning Board recommended disapproval, felt a precedent would be established if approved. Letters from Alma R. Hurwitz and Roland L. Faulkner read and entered in record. Mrs. Hurwitz opposed to division of more than 2 parcels. Mr. Faulkner opposed to approval of application. Member of Lake George Association questioned additional burden on sewer system if used year round. Mr. Roberts pointed out that it could be rented year round now if owner desired. This would not change with new owners. Mrs. Leigh Beeman, co-owner of property on south side concerned about setting precedent for future. Mr. Roberts said the Board looks at these applications on a case by case basis and would hope that they were not setting precedents. Mr. Macri offered motion for approval, seconded by Mr. Noll. Motion carried unanimously. RESOL VED: The Queensbury Planning Board approved this Site Plan Review contingent upon no further subdivision of Parcel 2 which is shown as 2.27 acres on the plot plan submitted with the application and any restrictions previously made by the Adirondack Park Agency in ruling 76-363 permit P76-404C dated August 28, 1978 be incorporated into the approval. Site Plan Review No 23-84 Della Buick-Pontiac, Inc. To construct addition to existing structure for auto sales office and parts storage in Highway Commercial 15 Zone on the property situated at Quaker Road. Public Hearing. Representative from Della explained addition. The Warren County Planning Board approved this Site Plan without comment. Mr. Noll offered motion for approval, seconded by Mr. Sorlin. Motion carried unanimously. RESOLVED: The Queensbury Planning Board approved this Site Plan Review based on: No effect on existing traffic entrances, Warren County approval and this is an expansion of an existing use. "-- Jolo Page Two November 20, 1984 Site Plan Review No. 24-84 Phyllis M. Holtz To operate a real estate office in residence in Highway Commmercial15 Zone on the property situated at west side Route 9 north of Red Coach restaurant. Public Hearing. Mrs. Holtz present. Mr. Roberts noted that residence is located in primarily commercial strip. Mrs. Holtz has 6 acres, extra parking area in driveway but would expand if necessary. Presently room for about 10 cars. The Warren County Planning Board recommends approval without comment. Mr. Noll offered motion for approval, seconded by Mrs. Levandowski. Motion carried unanimously. RESOL VED: The Queensbury Planning Board approved this Site Plan inasmuch as it doesn't change the character of the existing area and provides sufficient land for parking off the highway. Site Plan Review No. 25-84 King Service, Inc. To construct and operate gasoline station and convenience store in Highway Commercial 15 Zone on the property situated at southeast corner Quaker and Bay Roads. Public Hearing. Mr. Ted Luce present. Gas station presently on property. This building will be removed with new building, 60 ft. long by 40 ft. wide. Two variances will be required for canopies. Traffic flow was discussed. Letter in file from Beautification Committee recommending approval of plans as presented. Warren County Planning Board recommends approval without comment. Mr. Noll offered motion for approval, seconded by Mr. Macri. Motion carried unanimously. RESOLVED: The Board approved as presented inasmuch as it will enhance the existing conforming use. SUBDIVISION: Pine Wood Hollow Subdivision - Lot 24 - Kenneth Matson Mr. Roberts said there is a problem with front property line setback. Location of structure is well within setback provisions of Queensbury Ordinance, however, deed restrictions require 45 foot setback, also shown on plat filed with County. Subject home is completed at 42.5 setback and bank will not issue mortgage until matter resolved. This is really a civil matter but because change in subdivision plat matter should be addressed by Board. The unanimous decision of all members present is as follows: A) The actual location of the structure is well within the setback provisions of the Queensbury Zoning Ordinance (Section 4.020-e). B) The actual location of the structure at 42.5 plus or minus feet has no adverse impact upon the Pine Wood Hollow Subdivision.
