1985-05-13 )23 MINUTES Queensbury Planning Board Monday, May 13, 1985 8:00 p.m. Present: R. Roberts, Chairman K. Sorlin, Secretary S. Levandowski J. Dybas H. Mann R. Noll V. Macri M. Dean, Staff . The Minutes of the March and April 1985 meetings were approved as written. Site Plan Review #8-85 - REHEARING - Michael L. Pall Tuthill Road RR5A Martin Meyer, Esq. representing Michael Pall. Meyer noted that the April 30 contract deadline for Dr. Pall had been extended through this evening. The April meeting resulted in a "non-action" vote with five board members present (3 yes, I no, 1 absention). The three "yes" votes did not represent a majority of the seven-member board. Several neighbors spoke in favor of Dr. Pall's application. (Dennis Brower, Jim Baker, Bill Cook) Mr., .Roberts acknowledged he was the most vocal in opposition to application because of his concern that roads leading to Tuthill Road could present danger to clients in inclement weather. Mr. Meyer said there would be no external changes to the property. Mr. Sorlin said he had not changed his opinion, he believes this is a permitted use under Site Plan Review in that zone and applicant has filled all the criteria from a parking standpoint; does not interfere with rest of neighbors. Motion' for approval offered by Mrs. Mann, seconded by Mrs. Levandowski. Motion carried - all voted "yes" with exception of Mr. Roberts who voted "no". RESOLVED: The Queensbury Planning Board approved this Site Plan as it meets the criteria for site plan review and is not detrimental to the neighborhood. NEW BUSINESS: Site Plan Review #10-85 - Adirondack Investors Group (Adirondack Outdoor Market) west side route 9, north 149 HC-15 To operate an open air outdoor market in HC 15 zone per Article 7, Section 7.077 "Transient and/or temporary commercial use". Public Hearing. The Warren County Planning Board approved without comment. Richard Dawson present. Mr. Dawson read prepared statement. They will be selling wicker, pottery, and apparel - all new merchandise. Mr. Dawson said he owned all merchandise. They will be canopied tents. There will be 'parking for 30 cars. Mrs. Mann asked about trash and restroom facilities. Mr. Dawson said they had a trash man on a regular basis. Mr. Dawson said he and his wife were only employees and they had restroom facilities on adjacent property that they lease. Mrs. Mann questioned how they could have that many tents, a store next door and only two employees. Mr. Dawson said they may need additional employees, probably not more than one. Hours are from 9 a.m. to dusk. Mr. D~wson said it is not his intent to lease any of the spaces but if a reputable individual came along that wanted to sell antiques or something li~e that he ~ould like to have the option to lease the space. Mr. Roberts said one of the things they want to determine is if this operation would fall under Local Law #2. He said it would seem that it would not be under the local law if he owned the property. Mrs. Mann said if he leased the space it would be a different ballgame. Mr. Dawson said his understanding is that he would have to have a lease for over 90 days and file appropriate business applications. Mrs. Mann said we would have no idea if these spaces were leased unless he voluntarily comes in. Frank DeSantis, Esq. (owner of building to south). He asked about Phase I and Phase II. Phase II property is wet and lower than road. He asked what is going to be done to bring this up to grade and what will be done once the wetland is displaced (water has to go somewhere). Mr. DeSantis said there is a culvert which is in state ~ight-of-way, maintained by state as pert of storm drainage pattern. He is concerned with , effect of displacement on downside areas of which he is the immediate property owner, but it will affect everyone. He also questioned lack of restrooms. He said that they were required to put restrooms in their building. He did not see how anyone could get to bathrooms without driving. Mr. DeSantis also said there is a very fine line between leasing the space and 'owning the space with everything in it being on consignment. He said they were interested in how this would be managed and what would be sold. If the owner doesn't own the goods they lose control of what is going on. Mr. Roberts said that Mr. Dawson is saying that he will own all the merchandise, there will be nothing on consignment. Mrs. Mann asked if this was preliminary to a proposed building, eventually. Mr. Dawson said he does plan building in the future. Mrs. M~nn said that it was impossible at this time to know the potential for a building on this property without further information. Mrs. Mann said, in her opinion, the intent of this section of the ordinance was to give merchants ,who had seasonal things in addition to their year-round business, ego lawn furniture in summer or snowmobiles in winter, an opportunity to display it outside so they would not be handicapped as extra signage. She also said there is no tax base for selling goods under tents. Mr. DeSantis asked if the stream is a registered stream which would require greater setbacks. Mr. Dawson believes it is runoff from the Northway. -2- 2Ji . c1JS- Mr. DeSantis said the culvert was there long before the Northway. Mr. DeSantis asked what plans Dawson has to alter property to reach stage one on northern portion of property. Mr. Dawson said that other than cutting trees there would be no alteration in -. Phase I. This Site Plan tabled for legal interpretation and additional site information on drainage, topo, traffic, clear cutting, and stream information regarding setbacks. . Site Plan Review No. 11-85 - Donald Maynard Dixon Rd. and Helen Dr. To construct two (2) single family dwellings, two (2) duplex dwellings and one (1) triplex dwelling on 2.42 acres in Urban Residential 10 Zone. Public Hearing. Donald Maynard and Leon Steves present. There will be one road cut on Dixon. They will put up one building at a time - will start with single family home. Soils are sandy and density requirements have been met. Helen Drive Homeowners Association are in favor of plan. Dale Harris, lives next to property, is delighted with project. Motion to approve offered by Mr. Dybas, seconded by Mrs. Mann. Motion carried unanimously. RESOLVED: The Queensbury Planning Board approved this Site Plan as it is in accordance with the Master Plan and will have no adverse effect on neighborhood. Site Plan Review No. 13-85 - Taylor Welding Supply Co., Inc. Lower Warren Street Public Hearing. Mr. Jim Hayes, Esq. representing Taylor Welding. Prosposal to extend the present use in HI-3A Zone over to adjacent parcel that applicant seeks to acqu'ire. Property presently has body shop situated on it. At a future time they will submit plans for a proposed building similar to the one at 22 Warren St. The Warren Cóunty Planning Board approved without comment. Motion for approval offered by Mr. Noll, seconded by Mrs. Levandowski. Motion carried unanimously. RESOLVED: The Queensbury Planning Board approved this Site Plan inasmuch as it tends to improve the property and has no negative effect on neigh- borhood and lots are too small to be developed for a new heavy industry.
