1985-09-17 ;' ~~9 MINUTES Queensbury Planning Board Tuesday, September 17, 1985 8:00 p.m. '-' Present: R. Roberts, Chairman K. Sorlin, Secretary J. Dybas S. Levandowski V. Macri M. Dean, Staff Absent: H. Mann The Minutes of the August 20, 1985 and September 5, 1985 Special Meeting were approved as written. Rezoning Request - Kenneth & Mildred Baldwin n. side Rt. 149 Town Board requests Planning Board recommendation. This is Maille property, 15 acres east of Ridge Road. Mr. Baldwin not present. Mr. Roberts said they had heard his presentation previously. He had wanted to put a water slide in on Rt 149. Mr. Roberts asked Board if they wished to handle this evening. Mr. Sorlin asked if they would hold off until next month. Board agreed that this matter should be tabled until October. SUB-DIVISIONS: Subdivision No. 6-85 - Farone Townhouse Subdivision - Dixon Road Leon Steves present. Mr. Steves presented new maps, reducing entrances on Dixon Road to two. This plan calls for cul-de-sacs within development. Discussion re Quaker Hill Road - splits property, owned in part by City and Town. Mr. Roberts commented that negotiations are underway between City and Town for work to be done on Dixon Road that would affect the perimeter of this property. Mr. Steves said he would be tapping into water on Quaker Hill Road. Mr. Sorlin asked if he had discussed this with Tom Flaherty and Mr. Steves indicated that he had. However, he said he had not discussed the cul-de-sacs with Mr. Naylor. Mr. Naylor came forward to look at map and said he would like to see it without cul-de-sacs. Mr. Roberts said he would like to see more work done on interior design, final negotiations on Dixon Road realignment and clarification of ownership of Quaker Hill Road before conceptual approval. Mr. Naylor said that must be straightened out first. Mr. Roberts said the proposed most westerly road entrance to Dixon Road appears to be a dangerous spot right now. Mr. Naylor agreed. Application tabled for further information. NEW BUSINESS: Site Plan Review #20-85 - Joan Kubricky To construct two single family residences - one on 12 acre parcel and one on 16 acre parcel in Land Conservation 42 acre zone on '- ~5() Page Two September 17, 1985 .,- the property situated at Jennifer and Hunter Lanes, off Upper Ridge Road. Public Hearing. Joan Kubricky and Tom McCormack present. Warren County Planning Board recommends approval without comment. This involves a 28 acre portion of a 78 acre parcel. Property is bounded on north by Cherry Ridge subdivision - two of roads in subdivision end at north line of Kubricky property (Hunter and Jennifer). Both roads are town highways. These residences would be feasible in terms of slope, drainage and disposition of sewerage. Each parcel would have frontage on an existing public highway. The property will be conveyed to Mrs. Kubricky's sons. An APA permit will be required. The remaining acreage (50 acres) extending to Ridge Road (3 acre zone) will be subdivided into 14 lots if the two lots in question are approved. Mr. Leoni, neighbor to the north asked if any wetland would be filled in. Mr. Roberts said the answer is no, there is only about 2 ft. difference in elevation between the end of Hunter Lane and where house will be located. Michael Muller resident east of property feels this is good use of property. Neighbor John LaPan has no objection. Mrs. Levandowski offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. RESOLVED: The Planning Board approved this Site Plan as this does not seem to be unreasonable use of the land which adjoins more densely developed property to the north. Adirondack Park Agency ruling not available. Site Plan Review No. 21-85 - Don & Kathryn Maynard To construct two single family dwellings and three 4-plex buildings in UR 10 zone on 2.42 acres on property situated at Dixon Road and Helen Drive. Public Hearing. Mr. Maynard and Leon Steves present. Similar to Site Plan approved last spring except they are going from duplexes and tri-plex to three fourplexes. The change is due to economics. Resident of Heinrick St. asked questions pertaining to access and building size. Mr. Maynard entered to record three letters in support of project. Karen Thomas, neighbor, expressed concern about speed limit and asked who would have ownership of proposed 4-plexes. Mr. Maynard said he would retain ownership and oversee properties. Mr. Sorlin said he did not like increased density but it falls within ordinance. Two neighbors spoke in favor, good buffer, enhances property. Mr. Macri offered motion for approval, seconded by Mrs. Levandowski. Motion carried unanimously. RESOLVED: The Board approved this Site Plan as good use for property as zoned. Site Plan check list reviewed with no negative impact. --- 025/ Page Three September 17, 1985 '- Site Plan Review No. 22-85 Adirondack Manor Home for Adults To construct an adult home in UR-5 zone on the property situated at west side Bay Road across from Adirondack Community College. Public Hearing. C.J. Madonna, Esq. present. This is a home for the elderly, they must be ambulatory. The procedures are governed by NYS Social Services Dept. Mr. Roberts expressed concern over Old Maids Brook and keeping driveway away from brook. Mr. Ferguson, adjacent property owner said stream is rated AAA-T meaning it is occupied by trout. Mr. Madonna said they would need a stream crossing permit from DEC. Mr. Roberts reminded them of new amendment requiring no filling or hard surfacing 50' from viable stream or wetland. This does not preclude a culvert. Ray Buckley, engineer and Leon Steves, surveyor discussed changing driveway location with Mr. Roberts. Warren County Planning Board approved without comment. Mr. Dybas offered motion for approval, seconded by Mr. Macri. Motion carried unanimously. RESOLVED: The Planning Board approved this Site Plan as it is in the intent of the Master Plan for this area and is not detrimental to the area. Site Plan review sheet in file. Site Plan Review No. 23-85 - Ground Round Restaurant To place a solarium addition to restaurant in Aviation Mall in Plaza Commercial 1 Acre zone on property situated at Aviation Mall. Kevin Connelly present. Solarium will seat 20-24 people. They presently have a sunroof but it is not satisfactory-cold in winter, hot in summer. They will be taking a much more active role in the landscaping which is the responsibility of the Mall. There will be no impact on sidewalk, parking area or exits. Warren County Planning Board approved without comment. Mrs. Levandowski offered motion for approval, seconded by Mr. Dybas. Motion carried unanimously. RESOLVED: The Planning Board approved as improvement is aesthetically superior and no other problems exist. Site Plan Review No. 24-85 - Marcel J. Demers To operate an automobile carburetor and repair service in Place Commercial 1 Acre Zone on the property situated at Lafayette and Bank Streets. Public Hearing. Mr. Michael Mueller, Esq. and Mr. Demers present. Site Plan granted three years ago but financing was not available. Original Site Plan called for Mannis Glass to occupy one of two stalls. This plan calls for only the carburetor business. The dumpster will be fenced in, will be closed evenings. Beautification '--~ J5:) Page Four September 17, 1985 .,,- Committee has approved plans. Drainage and sewer plans discussed. Warren County Planning Board approved without comment. RESOLVED: The Planning Board approved as it falls into character of neighborhood with no foreseen effects. It was also approved three years ago. Mr. Charles H. Scudder and the Planning Board had an informal dis- cussion regarding Baybridge Subdivision and SPEDES permit.
