Staff Notes.06.18.1997 Staff Notes & Note to File Prepared By: George Klron. Planing Assistant
ZONING BOARD OF APPEALS
Town of Queensbury -Dept. of Community Development
MEETING DATE: June 18, 1997
AREA VARIANCE NO. 30-1997
APPLICANT: Betsy Malman
PROJECT LOCATION: 27 Sunset Lane
Proposed Project and Conformance with the Ordinance:
The applicant proposes to construct a detached garage which
will not meet the side and rear yard setback requirements for the
WR-lA zone. The applicant is seeking a rear yard setback of 0 feet
and a side yard setback of 10 feet.
Criteria for considering an Area Variance, according to Chapter
267, Town Law.
1. Benefit to the applicant:
Relief would allow the applicant to build a garage for vehicle
storage.
2 . Feasible alternatives:
Alternatives are limited due to the location of the home on
this property and the steep slope on the driveway side of this
lot.
3 . Is this relief substantial relative to the ordinance?
The applicant is seeking 25 feet of rear yard setback relief
and 10 feet of side yard setback relief.
4. Effects on the neighborhood or community?
It appears that the proposed garage would not have a negative
impact on the surrounding neighborhood.

Area Variance No. 30-1997
Betsy Kalman
5. is this difficulty self created?
A difficulty exists due to the steep slope on one side of the
property and the location of the home on this lot which limit
where a garage can be built.
Staff Comments & Concerns:
It is Staffs opinion that the granting of this variance would
benefit the applicant and not adversely effect the surrounding
neighborhood. Staff recommends that the applicant provide
some type of stormwater management around any new garage such
as gutters or drywells to help prevent stormwater from running
down the steep slope on the driveway side of this property.
SSQR: Type II, no further action required.
