MR. ZEGLEN-The applicant is planning to tear down the existing house, which is three bedroom. They are going to build a new four-bedroom house. To do this the wastewater system is insufficient and needs to be replaced. They are proposing a Clarus Fusion 450 Enhanced Treatment Unit. That would then go into a pump tank, which would pump up to the pressurized absorption bed away from the lake. It is a tight lot as you can see. The number one thing was get the field as far away from the lake as possible over a hundred feet. It does not …any wells we are left with the property line and the building setbacks. This is an improvement to their existing system. They have two drywells. One in that area. One in the other corner. We feel like this is an improvement for their property. DEPUTY SUPERVISOR, METIVIER-Before we open the public hearing does anyone have anything? REGULAR TOWN BOARD MEETING, MTG#31 09-27-2021 37 COUNCILMAN FREER-What wells are you talking about? MR. ZEGLEN-The existing system is a septic tank, pump tank up to two-seepage pit drywell type design on both corners on either side. COUNCILMAN FREER-You said you didn’t need a variance for wells. MR. ZEGLEN-I am sorry. Setbacks to any wells, neighboring properties. COUNCILMAN FREER-Are there any wells on neighboring properties? MR. ZEGLEN-I think most all of it is from the lake. COUNCILMAN MCNULTY-I have a question Tony. When we were at the site, we talked about fencing off that area so that no one parked on it. What is your approach to that? MR. ZEGLEN-Similar to what they have right now. They have some posts with some chain link to fence it off. They would do something similar to that their fence or a similar post with chains to get the parking in the parking area and off that field. COUNCILMAN FERONE-I think it needs to be a little bit more than that though. We don’t want to have driving on top of that field, which is going to be right next to the road. It is so tight up there to begin with the parking. I don’t want to say more than a post and a chain. It needs to be adhered to. It cannot be something removable. MR. ZEGLEN-I understand. SHEEHAN IREEV. TRUST TH PUBLICATION DATE: SEPTEMBER 17, 2021 AGENT ETHAN HALL – RUCINSKI HALL ARCHITECTURE DEPUTY SUPERVISOR, METIVIER-Reviewed Resolution before opening public hearing. MR. HALL-The project is on Rockhurst. It is an existing home. The existing home has two bedrooms on the main floor. It has a finished basement in the downstairs. There is also space in the attic that is unutilized, but it could have been utilized for bedroom space. I am not sure if you are familiar with Joe. He was the person several years ago whose boat exploded after getting filled with gas up there. Joe has the need to be out of the sun because of his injuries. We are looking at doing renovations to the house to make a garage that is accessible to him so he can get from the garage to the house. We are looking at doing some other renovations to the house to make it so that he gets more sun covered. Part of that is by doing these renovations we are required to upgrade the septic system, which is now a five hundred gallon tank. It is a concrete tank that is out front and a drywell. It is insufficient for what is there. They really don’t have the space on the lot to put an in ground sewage disposal system. We are looking at doing a holding tank method. With hopes that, I know there have been talks about the Rockhurst Development eventually coming together with a community system farther out closer to the mainland. We set this up with that in mind that if that does happen these can be turned into a septic tank. An affluent pump chamber with a pump in it. It can be forced out to that main. Eventually it would be rolled over into that if that were the idea with it. The proposal is for a three-bedroom house. It is currently two bedroom, but it does have a fully finished basement. DEPUTY SUPERVISOR, METIVIER-I applaud you for thinking in the future. Gentlemen any questions. COUNCILMAN FERONE-We looked at the property. It is tight. There is not a whole lot you could do there. DEPUTY SUPERVISOR METIVIER-Anything else? Do you want to read your thing? DEPUTY CLERK, O’BRIEN-Read the following letter into the record. It is on file in Town Clerk’s Office. The owner (Sheehan Trust) requests a variance to the South property line of 2’ 8” vs the required 10 ft. setback. The owners (Jeanne and Matt Lucas) at 78 Rockhurst, the immediate neighbors impacted by this variance to the South, understand that 10 ft. normal variance is difficult and propose the variance to be at 5 feet from the South property line. The lot has extensive room to the North and can accommodate the property line concerns tied to the installation of wastewater holding tanks by moving 3 ft. to the North. MR. ARICO-We actually had a variance originally for fifty feet. We first did the measurements along the ground we thought we were around fifty feet not more to elevation of the lake. Based on when we installed the tank we moved it like a couple feet of where it was. It didn’t get any closer to the lake…laterally. When the surveyor went out, she said it was only about thirty feet because the measurements were horizontally. DEPUTY SUPERVISOR, METIVIER-The tank is installed. You are just looking at the variance. MR. ARICO-The tank is installed. Just looking at the variance to keep it at the thirty feet. It is a one- bedroom camp. It is seasonal. There is no other place to put the tank to maintain a distance from wells and other properties. DEPUTY SUPERVISOR, METIVIER-This application was based on thirty-one point one feet plus or minus. MR. ARICO-That is an actual as built from the surveyor who located it. DEPUTY SUPERVISOR, METIVIER-Okay. COUNCILMAN MCNULTY-The tanks are already in. MR. ARICO-Yes. We backed filled it to some extent because we had to have it inspected. DEPUTY SUPERVISOR, METIVIER-So you got the approval. You did the work, but then you found out that it wasn’t… MR. ARICO-When Mr. Hatin came out he thought it was a little over forty feet not quite fifty feet. The surveyor went out. It is a downgrade. It is a little longer than thirty feet, but horizontally by survey, it is thirty-one point one. DEPUTY SUPERVISOR, METIVIER-It is still a holding tank. MR. ARICO-There will never be a leach field. There is no room for one. COUNCILMAN FREER-Do you have this measurement stuff figured out now so that we don’t have to do this again? MR. ARICO-Yes. The surveyor certified it to me at thirty-one feet. COUNCILMAN FREER-I am talking about the next time you put in a holding tank. Have you figured out that you need to measure horizontally for the Town of Queensbury? MR. ARICO-It was measured, but they didn’t measure the edge of water. COUNCILMAN FREER-Who is they? MR. ARICO-The surveyor. We had it surveyed originally. It is a dimension line. It just showed the edge of water. They didn’t survey the edge of water. They just put it on the map. It was kind of vague. It is just something that was missed on the map from the surveyor. We measured in the field. We thought we were close to fifty feet. We thought we could make the fifty feet. COUNCILMAN FREER-That is why I am asking. You are telling me you thought you could make fifty feet and you missed it by forty percent. What are you going to do to make sure we are not here again next year doing the same thing? MR. ARICO-I will make sure I check next time and make sure I am fifty feet. COUNCILMAN FREER-Okay. The numbers are staggering, but there is a great need for it. What we did is consolidated the districts. Therefore, on paper and mathematically and in some instances you will see increases. I have a note here up to about four hundred percent. That is not really the case. It is just that we consolidated everything. There are going to be some folks that are impacted that are greater than others. For the most part, it is about the same. We are comfortable, but do you want to come up. WATER WASTEWATER SUPERINTENDENT, CHRIS HARRINGTON-As Tony mentioned we went through this roughly four months ago. We have had many discussions on this. We had a couple Workshops. We had several sewer districts that send waste to the City of Glens Falls. We have the Route 9 Sewer District, West Queensbury Sewer District, Tech Park Sewer District, Queensbury Consolidated Sewer District, and Pershing Ashley Coolidge Sewer District. For some of these smaller system, particularly REGULAR TOWN BOARD MEETING, MTG#31 09-27-2021 49 the Pershing Ashley Coolidge, the pipes are from the nineteen fifties. Presently those people last year they had no debt. They saw a big fat zero of their tax bill. The problem is eventually we are going to have to do some work in Pershing Ashley Coolidge. I do not know when, but that day will come. We have a few thousand of linear feet of pipe in that Broad Acres area that would be big enough for thirty homeowners to swallow. We decided to consolidate the districts primarily for the O & M. It has become very difficult to transfer monies back and forth. Harrison is the only one in the sewer district. He is in the Queensbury Consolidated. I always felt the people in the Queensbury Consolidated Sewer District always bore the brunt of some of the inefficiencies in managing how you charge certain things. One of the things I talked about is a hammer. You get a twelve-dollar hammer from Ace. You are going to spend time to make sure that Tech Park pays its fair share it becomes ridiculous. Harrison always bought that hammer. The bigger thing was always the charge that the City of Glens Falls sent us. I could never come up with a fair way of how you charge a different district. Do you do it on flow? Do you do it on capacity? Do you do it on ad valorem? Do you do it on benefit tax? There is really no fair way to charge that two hundred and twenty thousand dollar bill. The fairest way is to make one district. I feel it is time for us to have one district. These districts have been around a long time. We are big boys right now. Everybody should be one district. It would freeze up some of the inefficiencies that we have. The Pershing Ashley Coolidge people are going to see a bill from zero to seventy. It is like an insurance policy so we can take care of the lines as I mentioned. Harrison is going to see another increase about fifty-five dollars. Those other people are going to help Harrison pay with possibly that force main if we don’t get aid or grants or get denied for the fourth time. We have been denied three times on that force main. So, those people are going to help Harrison if we need to do things at the Meadowbrook Pump Station or the pipes or what have you. Tech Park is another one. The people in Tech Park Sewer District, which is Dix Avenue and Luzerne Road, have a big fat zero. This year they are going to pay seventy dollars a year. That is going to help them out. Down the road when we did Carey Road Sewer District, we had to upsize the pump in Glens Falls. That is going to happen in about 2032. It will help those people in Tech Park. Now, conversely there are a couple of districts that their price per units is going to go down significantly. The beneficiary is West Queensbury. The average homeowner in that district is going to see a hundred and ninety dollars savings. Harrison pays fifty-five more. People in Pershing Ashley Coolidge pay sixty or seventy dollars more. People in West Queensbury some houses on Main Street they are going down about a hundred and ninety dollars. That is the way the math works out. Route 9 Sewer District. There are not many residences in Route 9, but there are a few. Those residents are going down about fifty two dollars. You have two districts that are going down. A couple of districts are going up. The overall picture is that it is going to be a stronger sewer district. When the smaller sewer districts get hit with a big bill, it will not be that dramatic. Every time you do, a reval or you do something like this there are winners and losers. I do not want to call them losers, but there people who are going to pay more. Again, I am talking more about the residential. I am not getting into commercials because commercials are very different. It is a different benefit you use. Everyone knows that the commercial people in Queensbury really want the sewer so they will pay a far greater share. The way the benefit tax is setup it is who benefits the most. The commercial benefits much more than residential. The residential people overall I think pay a fair share than commercial. That is the way Queensbury is set up. You have to put up with traffic, the Mall. The commercial people help with the taxes and all that good stuff. The assess value… a greater share from the County and all that good stuff. I hope that that gives an explanation of what we are going here. I think that overall it will be better going forward. DEPUTY SUPERVISOR, METIVIER-Can you explain quickly why Reservoir Park and South Queensbury are not included? WATER-WASTEWATER SUPERINTENDENT, MR. HARRINGTON-Reservoir Park is a different animal. That is an onsite system. They do not discharge to the City of Glens Falls. We kept them separate. In addition, that system does not have any water meters. Actually, the water is fed by the City of Glens Falls and they pay the City of Glens Falls for water. South Queensbury is also a different animal. That is an Intermunicipal Agreement with Warren County Sewer District, Town of Queensbury Sewer District, Washington County Sewer District and South Queensbury. It has its own IMA. TOWN COUNSEL, HAFNER-We would have to get approvals from some other municipalities that would make it very difficult. It would be very hard for the cost accounting issues that he is talking about. REGULAR TOWN BOARD MEETING, MTG#31 09-27-2021 50 WATER-WASTEWASTER SUPERINTENDENT, MR. HARRINGTON-If I deal with the three sewer districts compared to the seven. DEPUTY SUPERVISOR, METIVIER-Are these rates published some place. DEPUTY CLERK, O’BRIEN-They are on the website. DEPUTY SUPERVISOR, METIVIER-I will open up this public hearing. Does anybody wish to speak to the Greater Queensbury Consolidated Sanitary Sewer District Benefit Tax Roll for 2022? PUBLIC HEARING OPENED REBECCA LLOYD, REPRESENTING DUKE CONCRETE PRODUCTS-I really just have a question. We do use a lot of water in manufacturing. None of it will go into the sewer. It never does. It stays in the product. Is there a way to meter the water so that we are not going to be charged? I did look up the rates. We are looking at about five times higher than what we are currently paying for water based on real estate bills that I looked at over the last five years. We average anywhere from two sixty two to two sixty-nine. We are going to up to fourteen twenty nine. That is a huge increase for us. It does not seem like a lot. We are really a small manufacturing entity and every dollars counts. DEPUTY SUPERVISOR, METIVIER-I do not know the answer to this one. I am going to look at Chris for this one. WATER-WASTEWATER SUPERINTENDENT, MR. HARRINGTON-We do not have any mechanism for that not as of this year, we do not. DEPUTY SUPERVISOR, METIVIER-Has it ever been looked into? WATER-WASTEWATER SUPERINTENDENT, MR. HARRINGTON-No. DEPUTY SUPERVISOR, METIVIER-Is it something we should look into? WATER-WASTEWATER SUPERINTENDENT, MR. HARRINGTON-We could look into it. DEPUTY SUPERVISOR, METIVIER-I have never been asked that question before, I don’t know. MS. LLOYD-We have a manufacturing facility in Oneonta, Oswego Ready Mix. Our Plant was in the City of Oneonta. We were able to do that exact thing. We put in a meter so that we knew what kind of water was being used for the toilets and kitchen area, break rooms. All the rest of the water all goes into manufacturing. We paid for the water, but we did not pay for the sewer. COUNCILMAN FERONE-It sounds like something you might have to do internally in terms of plumping to separate the water supply. Where you could meter what is going into your product verses what is being used domestically in your building. MS. LLOYD-How are you going to manage what I am putting into the sewer? My understanding is you meter it by how much water I use. The water that we are using is not going into the sewer. We do have toilets and we do have a kitchen sink. We have two buildings. One building, absolutely I understand that it is not manufacturing. The Manufacturing Plant we use a lot of water. Our kilns are run by steam. There is a lot of water that we use. This is relatively new to me. I thought, I would just come and ask the question. DEPUTY SUPERVISOR, METIVIER-It is a great question. COUNCILMAN FERONE-It is a good question. COUNCILMAN MCNULTY-Are there other industries in Queensbury that might be using water that….we might want to look at this in a grander scale than just the one Company. DEPUTY SUPERVISOR, METIVIER-All of Route 9. COUNCILMAN FERONE-I can talk to a little experience here. I had a building where we had a large property that was sprinklered. When we first moved into the building, all the water that was being used was being considered for the equation for our sewer charges. What we did then is put two meters in. One for the supply to the sprinkler system. One for domestic water for the bathrooms, kitchens and so on. That lowered our bill. We had that one meter that was for domestic use not for what was going into the ground for the lawns. If I am incorrect, Chris let me know. WATER-WASTEWATER, SUPERINTENDENT, MR. HARRINGTON-We have some called dedicated meters. I could talk to legal a little more about this. That could get squirrely. TOWN COUNSEL, HAFNER-It is used over a large district. It predates our becoming Counsel, which was 1996. There are a whole bunch of factors. Water use for estimated that overall it would be a fair estimate for sewage going out. There are thousands of properties in the district. There are other factors in the sewage rate. WATER-WASTEWATER, SUPERINTENDENT, MR. HARRINGTON-It is mainly acreage. What is bigger than sewer, it takes up a lot of acreage. That is the primary driver. I think usually the water usage is small amount of the whole. It would be interesting to see what exactly that number is for water usage. How much of it contributes to benefit tax. I don’t know how significant it is or insignificant it is. Like, Bob said we have thousands of properties. I do remember years ago the Carey Sewer District, I believe Mr. Borgos had talked about some properties down in Native Textile that used water for cooling. They didn’t all discharge to the sewer. It did come up about four years ago. Again, I cannot change the benefit rate this year. It something that maybe I can look next year. TOWN COUNSEL, HAFNER-There are many factors. Some people are going to like certain factors and some are going to work against them. If you let people work for the ones that are against them…. COUNCILMAN MCNULTY-The costs are going to remain the same. WATER-WASTEWATER, SUPERINTENDENT, MR. HARRINGTON-If you eliminate that factor of the benefit tax someone else is going to pick it up. I don’t think it would be terribly significant. To go through each property separate and have meters it becomes a kind of headache. It is something we can look at. Asked the status of the C. T. Male Assessment Feasibility Study. Asked if there was a completion date. If they have not given one is it possible to get a date from them? Asked where the funds will come from to get them water, noting they feel they need water brought to their area. Recommended that they work together in parallel with the State Characterization and not wait in getting them water. Asked if anyone actively from the Town is designated to look into grant money? Funds from the State? Federal funds that they could look into. LISA ADAMSON-Thanked the Board for the Privilege of the Floor. Spoke to the Board regarding climate crisis. Acknowledged how much the Town Board has on their plate and how much they are doing in the areas of climate change. Congratulated the Town of Queensbury for achieving the Bronze status with the Climate Smart Committee. A shout out to Supervisor Strough and Councilman Freer for being on that Committee and helping it get across the finish line for the Bronze status. Thanked Kathy Bozony for the tireless paperwork and metrics that she accumulated including the Greenhouse Gas Emissions Inventory that is the basis for a Climate Action Plan. Is very aware of the other focuses that you have with possible engagement with the Stretch Program many things that you have completed in the area of climate mitigation. Thank you. Feels strongly on all levels of society we should be having climate action plans in place. On a personal level. On a County level. On the State level. We have the opportunity to do it in New York State. On a Federal level. We have the Reconciliation Bill going back and forth, as we speak today. On an International level with the Glasglow Summit coming up in November. The Cop26 Meeting Conference of Partners that is going to be determining how privileged countries can help island nations and what financial contributions we are going to be making. Asked if the Town Board could consider as we move into the next steps with the Climate Smart Community consider creating a Climate Action Plan that has a time frame to it. Recommended creating a Task Force experts in the area that can give you advise on what some of the metrics could be. 7.0 TOWN BOARD DISCUSSIONS COUNCILMAN MCNULTY (WARD IV) REGULAR TOWN BOARD MEETING, MTG#31 09-27-2021 65  Spoke regarding the presentation by Spencer Montgomery regarding their proposal for West Mountain Development. The concept for the development is on the north side of the slope. It is a significant development. It is posted on their website. It is proposed for a hundred seventy plus units with a Hotel, Conference Center. Encourage the residents of Queensbury to let us know their feelings on this. Hopes to have a Town Hall Meeting regarding this so we can get the input from the residents. Noted he is concerned with the traffic and concerned about the change to the whole west side of the Town in terms of what the project would mean. Encouraged residents to reach out to him on the website. Looks forward to getting input from the residents as we go forward. COUNCILMAN FERONE (WARD III)  Spoke regarding the Budget. In the Budget, the residents pay for two things. Fire and Emergency Services. They pay seventy-five cents per thousand value on a home for Fire. For EMS Services noting he thinks EMS is as essential as Fire. They are only paying about twenty-five cents per thousand of value for EMS services. EMS is having similar issues like hospitals in regards to staffing. There are not as many volunteers today as there were years ago. The Squads have to pay to provide these services to the Squad. There are three Squads for the Town. North Queensbury, Bay Ridge and West Glens Falls. They all are sort of out straight in regards to the staffing issues and funding. This is something we need to continue to look at funding for the Squads. In the next couple of meetings, we will have more information to share to everyone. COUNCILMAN FREER (WARD II)  The Town was awarded a Bronze Certified Climate Smart Community Status from the State. It is a rigorous process. Kathy Bozony has played a key role in this and deserves a lot of credit. John does serve on the Climate Smart Community Committee along with about a dozen non-government folks. Working hard at solar, EV stations and greenhouse gas inventory. Next up is Silver. We are going to insist that the Governor comes and gives us our Silver Plaque in person. One of the big keys with this in the short term is to continue to look at accepting the Stretch Energy Goals that we think will become part of the normal building codes in the future. If we do this early, we can achieve some additional status towards our Climate Smart Community Program.  Agrees with the Climate Action Plan. We have to do this and find funding. I think resiliency and sustainability needs to be built into our update of our long range Comprehensive Plan.  Spoke regarding the Short Term Rental Meeting held on Wednesday. It was a good meeting. Dan Davies came and provided a wealth of knowledge about what is going on in his side of short-term rentals. Happy to hear that the County is going to hire a firm to try to keep track of this so that we can get their occupancy tax.  It is getting dark early. Watch out for the deer and kids. Just be a little bit more careful on the roads. Everyone complains about speeding, it is time to slow down for the winter. DEPUTY SUPERVISOR METIVIER  Spoke regarding Fire, EMS, and their leave time noting that Fire and EMS are not Town Employees. They contract through the Town to provide a service for the Town. The Town of Queensbury has been working with our Fire and EMS for quite a few years to try and figure out what is the next step to all of this. They have final say, but we have say as far as what we can budget to pay them for what they do. We have to be conscious of what we refer to as the Tax Cap. The Tax Cap is the most money you can increase the tax base each year. They keep it around two percent depending on that is how we work our budget. One of the areas we are going to focus on is Fire and EMS. th  Warren County Rabies Clinic to be held on Saturday, October 9, 2021 at the North Creek th Johnsburg Dog Park to be held from ten to noon. Saturday, November 6, 2021 Rabies Clinic to be held at the Queensbury Activity Center from ten to noon. Pets must be 3 months of age to receive their immunization, which will afford them protection for one year. The next shot (booster) will afford protection for 3 years and is required one year after the first shot was given. From then on, every three years a booster should be given to protect your pet.
