266.2011 Highway Sup. & Zoning Ad. as Stormwat RESOLUTION APPOINTING THE HIGHWAY SUPERINTENDENT AND ZONING ADMINISTRATOR AS STORMWATER MANAGEMENT OFFICERS REGARDING CERTAIN MS4 STORMWATER MANAGEMENT RESPONSIBILITIES RESOLUTION NO.: 266, 2011 INTRODUCED BY: Mr. Ronald Montesi WHO MOVED ITS ADOPTION SECONDED BY: Mr. Anthony Metivier WHEREAS, the Town of Queensbury is a regulated municipality under the New York State Department of Environmental Conservation Municipal Separate Storm Sewer System Program (MS4), which regulations help to protect and improve the quality of public water bodies in more densely- populated areas of the State, specifically focusing on stormwater runoff, and WHEREAS, the Queensbury Town Board recently entered into an agreement (the Agreement) with the Warren County Soil and Water Conservation District to perform certain mapping, reporting and public education/outreach functions which the Town is required to perform as a regulated municipality under MS4, and WHEREAS, the Town Board wishes to appoint the Town Highway Superintendent and the Zoning Administrator as Stormwater Management Officers in accordance with Queensbury Town Code Chapter 147, to carry out certain administrative and enforcement provisions of MS4 and the Town Stormwater Management Code which are not covered under the Agreement with the Warren County Soil and Water Conservation District, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby appoints the Highway Superintendent and the Zoning Administrator as Stormwater Management Officers in accordance with Queensbury Town Code Chapter 147 and authorizes and directs the Town Supervisor to execute any Agreement or documentation needed to effectuate these appointments, and BE IT FURTHER, RESOLVED, that the Town Board hereby appoints and designates the Code Compliance Officer of Community Development to serve as Acting Stormwater Management Officer, and to exercise the same authority as the Zoning Administrator as Stormwater Management Officer, in the event the Zoning Administrator is absent or otherwise unable to serve as Stormwater Management Officer, and BE IT FURTHER, RESOLVED, that the Town Board hereby appoints and designates the Deputy Highway Superintendent to serve as Acting Stormwater Management Officer, and to exercise the same authority as the Highway Superintendent as Stormwater Management Officer, in the event the Highway Superintendent is absent or otherwise unable to serve as Stormwater Management Officer, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or Town Budget Officer to take such other and further action as may be necessary to effectuate all terms of this Resolution. nd Duly adopted this 22 day of August, 2011, by the following vote: AYES: Mr. Montesi, Mr. Strough, Mr. Stec, Mr. Metivier NOES: None ABSENT: Mr. Brewer 2
