WHEREAS, the Queensbury Town Board wishes to amend the portion of Queensbury
Town Code Section 136-53 relating to sewer permit and inspection fees so that such fees shall be
set by Town Board Resolution, and
WHEREAS, the Town Board conducted a duly noticed Public Hearing on Monday,

November 15, 2021 and heard all interested parties and has considered the verbal and written
comments received,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby adopts Local Law No.: ___ of 2021,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Clerk to file the
Local Law with the New York Secretary of State in accordance with the provisions of the Municipal
Home Rule Law and acknowledges that the Local Law will take effect immediately upon filing by the
Secretary of State, and
BE IT FURTHER,
RESOLVED, that the Town Board establishes that the sewer permit and inspection fees
per 136-53(B) of the Town Code shall be $125.00, and
BE IT FURTHER,
RESOLVED, that the Town Board authorizes and directs the Town Supervisor, Town
Clerk, Town Water Superintendent-Wastewater Director and/or Town Counsel to take any and all
actions necessary to effect this Resolution.

LOCAL LAW AMENDING QUEENSBURY TOWN CODE
RELATING TO SEWER PERMIT FEES
Be it enacted by the Queensbury Town Board as follows:
Section 1: The name of this Local Law is: A Local Law to Amend Chapter 136-53(B) of
the Code of the Town of Queensbury Relating to Sewer Permit Fees.
Section 2: Chapter 136-53(B) of the Code of the Town of Queensbury is repealed in its
entirety and replaced with the following language:
"A permit and inspection fee for a residential/commercial use will be required, except for
initial hookups of existing structures within the time schedule allowed in 136-44, measured from
the completion date of the construction contract of the public sewer servicing the structure. Such
fee shall be detailed, from time to time, by Town Board Resolution and included in the Town's
Wastewater Department fee schedule. The cost of an industrial permit shall be negotiated with
the Town of Queensbury at the time of application. This will depend on the volume of sewage,
number and size of connections and quality of discharge."
Section 3: The invalidity of any clause, sentence, paragraph or provision of this Local
Law shall not invalidate any other clause, sentence,paragraph or part thereof.
Section 4. All Local Laws or Ordinances or parts of Local Laws or Ordinances in conflict
with any part of this Local Law are hereby repealed.
Section 5. This Local Law shall take effect upon filing in the office of the New York State
Secretary of State or as otherwise provided by law.
