WHEREAS, the Queensbury Town Board duly established the Town of Queensbury
Consolidated Water District (the "District") in accordance with New York Town Law, and
WHEREAS, the Town Board wishes to improve the District’s water transmission facilities by
replacing approximately 2500 feet of 8" unlined cast iron water main on Glenwood Avenue
between Quaker and Bay Roads and approximately 900 feet of failing 6" ductile iron pipe on
Haviland Avenue between Richardson Street and Edgewater Road (Project), in accordance with
Town Law §202-b, and
WHEREAS, the Town’s Water Superintendent requested proposals for professional Design,
Bidding and Construction Phase Engineering Services (Services) related to the Project, and
WHEREAS, the Water Superintendent and Purchasing Agent have received and reviewed two
(2) proposals, with the lowest, most responsible submitted proposal submitted by Delaware
Engineering, P.C. (Delaware) and therefore the Water Superintendent and Purchasing Agent have
recommended that the Town Board authorize engagement of Delaware for such Services in the
amount of $176,110 as delineated in Delaware’s October 21, 2021 Proposal presented at this
meeting, and
WHEREAS, the Water Superintendent has advised that there are times when Change
Orders may become necessary related to such Services and has requested that the Town Board
also authorize him to approve and sign certain Change Orders up to a ten-percent (10%)
contingency for Change Orders that he deems necessary or appropriate, and
WHEREAS, by Resolution No.: 261,2021, the Town Board accepted a total of
$2,794,633.02 in American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Grant
Funds from the New York State Department of Budget, such Recovery Funds to be used in
accordance with the terms and conditions to be set forth by the New York State Department of
Budget and/or the Federal Government, and established the ARPA Coronavirus Local Fiscal
Recovery Capital Project No. 241 and the Town Board wishes to use these Recovery Funds for
this qualifying infrastructure investment Project,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board hereby authorizes and directs engagement of
Delaware Engineering, D.P.C. (Delaware) for professional Design, Bidding and Construction
Phase Engineering Services (Services) related to the Glenwood and Haviland Avenues Water
Main Replacement Project (Project) for the amount of $176,110 as delineated in Delaware’s
October 21, 2021 Proposal in substantially the form presented at this meeting, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes the Town Water Superintendent to
approve and sign Change Orders pertaining to such Services up to a ten-percent (10%)
contingency or in the total amount not exceeding $17,611 that he deems necessary or appropriate,
and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs that funding for such

Project up to a total amount of $193,721 shall be paid from the ARPA Coronavirus Local Fiscal
Recovery Capital Project No. 241, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Budget
Officer to make any adjustments, budget amendments, transfers, prepare any documentation and
take all actions necessary to provide for payment of services, and
BE IT FURTHER,
RESOLVED, that the Town Board further authorizes and directs the Town Supervisor to
execute any needed agreement with Delaware in form acceptable to the Town Supervisor, Town
Water Superintendent and/or Town Counsel, and/or any other needed documentation, and the Town
Supervisor, Water Superintendent, Purchasing Agent and/or Town Budget Officer to take such other
and further actions as may be necessary to effectuate the terms of this Resolution.

WHEREAS, the New York State Department of Budget (NYS DOB) previously -
announced the availability of fluids through the American Rescue Plan Act (ARPA) to distribute
Coronavirus Local Fiscal Recovery Funds (Recovery Funds) to Non-Entitlement Units (NEUs)
of local government on behalf of the United States Department of the Treasury, and
WHEREAS, by Resolution No.: 219,2021, the Queensbury Town Board authorized its
request for Recovery Funds, and
WHEREAS, the Town was notified that it was awarded $2,794,633.02 in Recovery
Funds and received half of the amount, $1,397,316.51, in July 2021 and expects to receive the
balance, $1,397,316.51, in July of 2022, and
WHEREAS, the Town Board wishes to accept these Recovery Funds, establish ARPA
Coronavirus Local Fiscal Recovery Capital Project No. 241 and establish and fund the Revenue
and Expense Accounts in the total amount of$2,794,633.02,
NOW, THEREFORE,BE IT
RESOLVED, that the Queensbury Town Board hereby accepts a total of$2,794,633.02 in
American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Grant Funds from the
New York State Department of Budget of which $1,397,316.51 has been received by the Town

Thank you for forwarding the Request for Engineering Proposals for the ARPA funded
replacement of the water mains on Glenwood and Haviland avenues in the Town of
Queensbury. We are pleased to provide a proposal to assist the Town with this project.
As you know, Delaware Engineering, DPC has an over 30-year history providing civil
engineering focused on public water and sewer systems including permitting, design, and
bidding services as well as construction administration and inspection. As such;and with an
office in nearby Albany, we offer the technical expertise and accesssequired to assist the
Town with this project.
In support of our civil engineering work, we have a staff of environmental and planning
professionals that support the municipalities with whom we work in the conduct of the State
Environmental Quality Review Act (SEQRA); the National Environmental Policy Act (NEPA);
Town Law Article 12 proceedings including district formations, extensions and increase or
improvement 202(b) processes; and the requirements of a variety of funding programs •
including the State Revolving Fund, Water Infrastructure Improvement Act, Engineering
Planning Grants, Water Quality Improvement Program, Community Development Block
Grant, USDA Rural Utilities, Green Innovation Grant Program, Local Government Efficiency,
Climate Smart Communities,Local Waterfront Revitalization,and others.
In the spring of 2021, the Congress of the United States adopted the American Rescue Plan
Act(ARPA) and created the State and Local Fiscal Recovery Funds (SLFRF) which provides
funding to local•governments for a number of purposes including water and sewer
infrastructure investment.

working with many communities with regard to the new wave of Federal funding,current and

TOWN OF QUEENSUURY WATER DEPARTMENT PROJECT UNDERSTANDING AND APPROACH
WATER MAIN REPLACEMENT
PROJECT UNDERSTANDING
The Town of Queensbury Water Department is seeking a professional engineering firm to provide _
design, bid-document preparation and construction administration services for the replacement of
water mains on Glenwood Avenue(between Quaker Road and Bay,Road) and along Haviland Avenue in
the Town of Queensbury,Warren County,New York.
It is understood that residents on Glenwood Avenue are experiencing rusty water from an unlined cast
iron water main installed in 1949.The Queensbury Water Department has identified the need to replace
approximately 2300' linear feet of 8" C.I.water main, as well as 25 domestic water services and 5 large
service connections within the County right of way (ROW). Replacement and relocation of this fragile
infrastructure is critical in order to ensure that residents and businesses have reliable access to safe
drinking water.
In addition, Warren County is scheduled to replace components of the storm drainage system on
Glenwood Avenue in the same vicinity during July/August of 2022,and the water main work would have
to be scheduled around this project. As such, Delaware anticipates completing design and engineering
by early Fall 2022 in order to advertise the bid in late Fall 2022/early Winter 2023, with a Notice to
Proceed issued by early Spring 2023.
It is also understood that.the Queensbury Water Department has,been dealing with several breaks along
a section of deteriorated 6" Ductile Iron Pipe on Haviland Avenue. The Department had identified the
need to replace 900' linear feet of this pipe,along with approximately 3 water services connected to the
water main.
Delaware proposes to design these improvements, in accordance with all specifications outlined in the
Queensbury Water Department's latest Design and Construction Standards, and all requirements
associated with the use of ARPA funds for public works projects. Delaware will provide bid assistance
(including pre-bid meeting, bid tabulation and review, addenda and clarifications) and construction
phase services, from construction kick-off meeting to the provision of as-built drawings in paper and
digital form. -

UNDERSTANDING OF ARPA REQUIREMENTS
It is understood that both water main replacement projects will be funded by American Rescue Plan Act
of 2021 (ARPA)funds,and the selected consultant must have a thorough understanding of the eligibility
and reporting requirements associated with administration of the State and Local Fiscal Recovery Funds
(SLFRF).
As a trusted consultant and advisor to numerous municipalities, Delaware Engineering is working with many
communities with regard to the new wave of Federal funding,current and proposed. In particular, Delaware
Engineering is assisting a number of communities with the use of ARPA funds to support water and sewer
infrastructure. Delaware Engineering has studied the Interim Final Rules for ARPA as issued by the Treasury
and is well versed in all guidance documents associated with ARPA.

Following is Delaware's understanding of the ARPA/SLFRF requirements as they relate to this project:
• Initial payments of ARPA/SLFRF funds have been made to all of the Non-Entitlement Units
(NEUs) including the Town of Queensbury. The Town's first installment of$1,403,021 was
received in the Summer of 2021,and a second installment of$1,403,021 is expected in the
Summer of 2022,for a total allocation of$2,806,042.
• Eligible uses of ARPA/SLFRF funds are established by the Federal Government through the U.S.
Treasury's rulemaking. According to the legislation, NEUs have substantial discretion to use the
award funds in the ways that best suit the needs of their constituents;however,the US Treasury
guidance provides four statutory categories for eligible expenses,one of which is"to make
necessary investments in water,sewer,or broadband infrastructure".
• SLFRF funds can be used to cover eligible costs incurred from March 3,2021 through December
31,2024.NEUs are required to submit their first Project and Expenditure Report to U.S.
Treasury by April 30,2022 as provided in recent updates to the reporting schedule. That report
will cover the period between award date and March 31,2022. Annual Project and Expenditure
reports will be required thereafter. The format for annual reporting has been provided in
additional guidance from the US Treasury which we have reviewed relative to infrastructure
projects less than$10 million.
• In terms of water and sewer infrastructure eligibility,the US Treasury Interim Rule states that
projects must meet the guidelines of the State Revolving Fund(SRE). SRF is a creation of the
federal government that is implemented by the states;thus,each state has an Intended Use
Plan (IUP)that further describes eligibility for funding. We are intimately familiar with SRF

eligibility requirements and the scope of work envisioned by Queensbury is SRF eligible and
therefore ARPA eligible.
• Federal Davis-Bacon Act requirements (prevailing wage rates)do not apply to projects less than
$10 million funded solely with ARPA/SLFRF funds in accordance with US Treasury guidance;
however,NYS prevailing wages do apply because the projects are public works.
• Similarly, the requirements of Town Law Article 12 and related. laws (special improvement
districts) as well a General Municipal Law 101 and 103 (public works contracting) do apply to
ARPA funded projects.
• Because ARPA funds are federal in nature, NYS MWBE requirements do not apply to projects
funded solely with SLFRF funds.
• While ARPA funds are federal,the US Treasury rules exempt projects from the conduct of the
National Environmental Policy Act(NEPA); however,the State Environmental Quality Review Act
(SEQRA)applies.

WATER MAIN REPLACEMENT
PROJECT APPROACH: SCOPE OF SERVICES
This Scope of Services includes the steps necessary to complete the design, bidding and construction
administration for the Water Main Replacement on Glenwood & Haviland Avenue. Both projects
include the development of approved design plans and specifications, permitting, bidding assistance,
selection of qualified contractors, construction administration, inspection services and preparation of
as-built drawings.
The Delaware Engineering scope of services is inclusive of attendance at meetings and phone
conversations with representatives of the Water Department and regulatory agencies without
limitation.A description of engineering services to be provided during construction is also included.
PHASE I-DESIGN&BIDDING
1. Delaware will attend a kick-off meeting with the Water Department to discuss the proposed
schedule and scope of the project. In advance, Delaware will review plans and equipment
specifications for the existing infrastructure. Delaware will conduct site visits and review as-built
drawings and any other available information pertaining to the Project area.
2. Delaware will prepare an Engineering Report to support the Town Law §202(b) process which
involves acceptance of the Report by the Town Board, scheduling and conduct of a'public hearing
and adoption of a final order for the proceeding. Delaware will work with the Town Attorney to
support the 202(b) process which will include but is not limited to preparation of the required
engineering report, attendance/presentation and materials for a public meeting, and information
necessary for the Town Attorney to create resolutions and orders. It is noted that the 202(b)
proceeding is subject to SEQR.
3. To support the SEAR process,Delaware will prepare Part 1 of a Full Environmental Assessment Form
and conduct lead agency coordination if the determination is made that a coordinated review is
appropriate.
4. As part of the SEAR process and in consideration of other permitting, Delaware will prepare and file
a project review form with the State Historic Preservation Office (SHPO) and coordinate a Section
106 (federal) and 14.09 (state) review. A sign-off of no impact to historic/cultural resources is
anticipated to be obtained without conduct of a Phase 1A or 1B cultural resource survey,given that
the project involves work in previously disturbed areas and is a replacement of existing
infrastructure. Should SHPO request conduct of Phase 1A and/or 1B cultural resources surveys,
Delaware will notify the Town and assist the Town in securing the services of a cultural resource
professional,the cost of such work to be paid by the Town to the consultant directly.

5. Delaware will assist the Town Board as presumed lead agency with preparation and review of Parts
2 and 3 of the Full Environmental Assessment Form. Given the nature of the project, a Neg Dec is
anticipated, the preparation of which Delaware will provide along with any required notifications
such as publication in the ENB and circulation to involved agencies.
6. Delaware will ensure that a topographical survey of the Project area is completed, and will conduct
soil borings in order to evaluate subsurface conditions. The preliminary design will be conducted
utilizing publicly available LIDAR and GIS data. A detailed survey of the entire pipe route will be
conducted upon determination of the final pipeline route. The geotechnical investigation will
include soil borings to determine the soil characteristics, bedrock elevations and ground water
elevations. This proposal includes three days of soil boring work.
7. Delaware will design and engineer proposed improvements,and will prepare,submit and secure all
required permits and approvals, including but not limited to permits required by the Warren County
Department of Public Works, New York State DOH, New York State DOT, New York State DEC, and
the Town of Queensbury Highway Department.
8. Based on the design, Delaware will prepare easements based on public records as required for
construction and maintenance access for the project. Delaware will work with the Town in
contacting property owners, discussing the nature and scope of easements, and securing executed
easement documents. All easements will be filed with the County as required.
�.. 9. A full set of draft bid specifications and documents will be provided to the Water Department for
review and comment.Once finalized, Delaware will provide up to 10 sets of plans and specifications
to the Town for bidding purposes, and will assist the Town in advertising the bid for construction
services.Delaware will make bid documents available online,free of charge,to bidders.
10. Delaware will schedule and coordinate a pre-bid conference on-site with prospective bidders to
answer questions and to prepare, reproduce and deliver addenda to bidders as necessary. All
addenda shall be submitted to the Water Department staff for review and approval. Delaware will
be present for the bid opening, and will evaluate all bids and bidders, determining if bidders are
responsible and responsive to the bid requests. The review performed by Delaware will include an
analysis to ensure that required documentation has been filed (i.e., bid bonds, certifications, etc.).
Delaware will also evaluate the qualifications of the contractors to ensure that the bidders are
qualified to perform the work they have proposed.
11. Delaware will prepare a bid tabulation for all responsive bidders and will prepare a
Recommendation for Contract Award once all bidder qualifications and submittals have been
reviewed.

infrastructure,our area of expertise lies particularly in securing low-cost financing and grants from the NYS
Environmental Facility Corporation's (NYSEFC) through the State Revolving Funds (SRF) for both Drinking,
