Duly adopted this 6th day of February,2012,by the following vote: AYES Mr. Metivier,Mr. Montesi,Mr. Strough,Mr. Brewer,Mr. Stec NOES None ABSENT: None REGULAR TOWN BOARD MEETING MTG#3 02-06-2012 97 RESOLUTION SCHEDULING PUBLIC HEARING ON PROPOSED LOCAL LAW NO.: OF 2012 AMENDING CHAPTER 179 "ZONING" OF QUEENSBURY TOWN CODE TO: (1) CHANGE ZONING OF CERTAIN PROPERTIES FROM "MS" TO "O" AND FROM "MS" TO "NR"; (2)ADD FUNERAL HOME AS ALLOWED USE WITH SITE PLAN REVIEW IN "CLI" ZONE AND (3) REVISE PROVISIONS RELATING TO ALTERNATE MEMBERS OF PLANNING BOARD AND ZONING BOARD OF APPEALS RESOLUTION NO.: 789 2012 INTRODUCED BY : Mr. Tim Brewer WHO MOVED ITS ADOPTION SECONDED BY: Mr.Anthony Metivier WHEREAS, the Queensbury Town Board is considering a request to amend the zoning designations for certain properties along Luzerne Road between Veterans Road and Holden Avenue as follows: (1) parcels 309.7-1-15, 22 and 23 from Main Street (MS) to Neighborhood Residential (NR), and(2)parcels (a) 309.7-1-11, 12, 13 and 14, (b) 309.10-1-94, 95.1, 95.2, 95.3, 96 and 97 and (c) 309.11-2-24, 25, 26, 27 and 28 from Main Street (MS)to Office(0), and WHEREAS, the Town Board is also considering a request to amend the Town Zoning Law to add "Funeral Home" to the list of allowable uses with Site Plan Review within the Commercial Light Industrial (CLI)Zone, and WHEREAS, the Town Board is also considering a request to amend Article 16, "Administration" of the Town Zoning Law to permit the use of alternate members by the Planning Board and Zoning Board of Appeals in circumstances other than a conflict of interest, and WHEREAS, the Town Board wishes to consider adoption of proposed Local Law No.: of 2012 to amend Queensbury Town Code Chapter 179 by amending the official Town Zoning Law and Map to reflect such changes as set forth above, and WHEREAS,before the Town Board may amend, supplement, change, or modify its Zoning Law and Map, it must hold a public hearing in accordance with the provisions of Town Law §265, the Municipal Home Rule Law and the Town of Queensbury Zoning Laws, NOW,THEREFORE, BE IT RESOLVED, that the Queensbury Town Board shall hold a public hearing on Monday, February 2711i 2012 at 7:00 p.m. at the Queensbury Activities Center, 742 Bay Road, Queensbury to hear all interested parties concerning adoption of proposed Local Law No.: of 2012, to amend the Town of Queensbury Zoning Law and Map to: (a) change the zoning of certain properties from Main Street (MS) to Office (0) and for others from Main Street (MS) to Neighborhood Residential (NR); (b) add "Funeral Home" use to the list of allowable uses with Site Plan Review in the REGULAR TOWN BOARD MEETING MTG#3 02-06-2012 98 Commercial Light Industrial (CLI) zone; and (c) revise provisions relating to alternate members of the Planning Board and Zoning Board of Appeals, and BE IT FURTHER- RESOLVED,that the Town Board hereby authorizes and directs the Town Clerk's Office to provide 10 days notice of the public hearing by publishing a Notice of Public Hearing in the Town's official newspaper and posting the Notice on the Town's bulletin board and website,and BE IT FURTHER- RESOLVED, that the Town Board further authorizes and directs the Community Development Department to provide the Town Clerk's Office with a list of all property owners located within 500' of the area to be rezoned so that the Town Clerk's Office may send the Notice of Public Hearing to those property owners,and BE IT FURTHER- [RESOLVED, that the Town Board further authorizes and directs the Community Development Department to forward the proposed Local Law to the Town Planning Board for its review and recommendation in accordance with Town Code §179-15-040, and BE IT FURTHER] RESOLVED, that the Town Board further authorizes and directs the Community Development Department to forward the proposed Local Law to the Lake George/Lake Champlain Regional Planning Board for its review and comment in accordance with New York State General Municipal Law §239-m, and BE IT FURTHER, RESOLVED,that the Town Board further authorizes and directs the Town Clerk's Office to send the Notice of Public Hearing to the Clerk of the Warren County Board of Supervisors and any other communities or agencies that it is necessary to give written notice to in accordance with New York State Town Law, the Town's Zoning Law and any other Laws of the State of New York. Duly adopted this 6th day of February,2012,by the following vote: AYES : Mr. Brewer,Mr. Stec,Mr. Metivier,Mr. Montesi,Mr. Strough NOES : None ABSENT: None 2.0 PRIVILEGE OF THE FLOOR JOHN SALVADOR-ALEXY LANE, NORTH QUEENSBURY-Spoke to the board regarding the Intermunicipal Agreement with the Lake George Park Commission noting he looks forward to the completion of this project. GEORGE WINTERS-4 John Clendon Road, Queensbury-Questioned the board as to how much snow has to be on the road before the Town of Queensbury Highway Department plows the roads noting a couple of times they have went by there has been an inch on the road and it is going to be forty degrees why would they have to plow the road? SUPERVISOR STEC-That is a question for the Highway Superintendent that is his call. COUNCILMAN BREWER-I have seen the plows out possibly salting the roads because of ice whether the temperature gets up to forty then in the evening it might go down, maybe he is putting salt down, we can ask him. MR. WINTERS- Thinks it is unnecessary. Questioned the money that is not used in the Highway budget does it get rolled over to the next year? SUPERVISOR STEC-The Town Board controls their money whatever they do not use the Town Board controls we fund them as we go. COUNCILMAN STROUGH-Because of the lack of snow and wet weather we have had a lot of storm water issues I have received more calls than usual on that. There could be some storm water work so some of that money that we have left over could go to that, but winter is not over yet. SUPERVISOR STEC-Contact Mike Travis, Highway Superintendent regarding this. MR. TUCKER-Spoke to the board regarding the light on Corinth Road. SUPERVISOR STEC-It is on their list I was told it would be March. MR. TUCKER-Noted there is a spot on a pole in front of the Emergency Squad on Media Drive that would be the spot for it. SUPERVISOR STEC-That is not where you told me before. REGULAR TOWN BOARD MEETING MTG#3 02-06-2012 101 MR. TUCKER-Asked Supervisor Stec to contact National Grid to tell them to change it. Spoke regarding a letter he received from the Town Assessor informing him that he does not qualify for the Senior Discount. The State of New York raised the maximum in 1995 the Town of Queensbury, Warren County, Queensbury School District have failed since 1995 to raise the limit. SUPERVISOR STEC-On the exemption we are going to do that this fall. Warren County is going to lead the charge on adjusting that table that you are reading about we are going to fix it first. We are hoping that if the County takes the first step that will be something that everyone else will follow. It is even more important to the seniors that the school districts make that adjustment because the school taxes are bigger than the County and Town taxes in the County. We would tackle it this fall so it would go into effect next January tax bill. MR. TUCKER-Asked again if he would call National Grid. SUPERVISOR STEC-1 am afraid if I call them they won't change the light that we want. They told us that it is on their list and that is good enough for me. MR. TUCKER-Spoke to the board regarding the Transfer Stations and the increase in price. SUPERVISOR STEC-The landfill was losing money the general fund was subsidizing it to the point where the Comptroller Office was criticizing the Town. MR. TUCKER-If there was any money lost the City of Glens Falls had to make up the difference. SUPERVISOR STEC-That is not the arrangement we have with the City it is not true it is a myth. COUNCILMAN BREWER-We are making money now, but to continue to be able to make money and pay for the transfer stations we raised the price. SUPERVISOR STEC-The volume has dropped, but we still have the same overhead and that is why the rates went up. MR. TUCKER-We had the same problem before the City of Glens Falls was partners for forty percent we were partners for sixty percent. COUNCILMAN BREWER-1 have never seen a contract where we are partners with the City of Glens Falls on the Transfer Station. The City of Glens Falls owns that property we have maintained it as long as I can remember that I have been on this board we have paid for any improvements or any maintenance issues. 3.0 CORRESPONDENCE NONE REGULAR TOWN BOARD MEETING MTG#3 02-06-2012 102 4.0 TOWN BOARD DISCUSSIONS COUNCILMAN MEITIVIER • None COUNCILMAN RONALD MONTESI • None COUNCILMAN JOHN STROUGH • Spoke to the board regarding the 2501h Anniversary of the Town of Queensbury. We are going to be doing this in many ways will be having two occasions where the public is going to be invited to join us Dr. Marilyn Van Dyke the Town Historian has arranged this for May 201h we will be at the Quaker Cemetery on the corner of Quaker and Bay. On August 251h there will be another occasion here at the Town Hall. There are going to be banners all kinds of posters celebrating the occasion the Post Star is working with us on this.
