The approved plan was then modified by Planning Board approval in March of 2010 to add a small amount of acreage(0.33 ac)to Lot 1. The modified plan was subsequently filed with the County Clerk's office on April 1,2010. Over the past couple of months,we have had several conversations regarding the effort to correct what we feel is an inconsistency on the filed subdivision plan which was approved by the Queensbury Planning Board in March of 2010. The September 2009 approved plan indicated the shoreline setback to be 50'. The March 2010 approved plan inexplicably lists the shoreline setback as 751. It is undetermined as to why the change in shoreline setback dimension was made. We have decided to submit an application for a subdivision modification which will correct a representation of the Shoreline Setback standard from 76'to 60'. Fifteen (15)sets of a revised subdivision plan and Page I of the Final Subdivision application are herein provided for your distribution and review. A check($26)for the Subdivision Modification application is also included. It should be noted that the 2.28-acre lot(Lot 1)that was created by the subdivision has been sold by Ray&Wendy Kraft to new owners Sharon& Michael Serini. The Sermi's have plans to develop the property with a single-family residence and we are seeking to get the Shoreline setback standard corrected to the 50'standard typical of this area of the WR zoning district. Aside from the discussions with your office I have also spoken to Matt Steves,Tom Hutchins and Stefanie Bitter who all served as agents for the Krafts in their subdivision application/approval process. In addition, I have reviewed minutes of September 2009 and March 2010 Planning Board meetings and APA documents related to APA's review of the project. The results of my research and discussions with those parties directly involved is that there is no recollection or documentation as to why the shoreline setback was listed as 75'on the filed map. In 2009/2010,as it is now,the shoreline setback standard for the Cleverdale area of the Waterfront Residential zoning district was 501 (or the average of the two adjacent properties). It was not normally 751. The plan submitted with this application has been prepared by Van Dusen&Steves and simply revises the Zoning Information to list the Setbacks to be 50'AT SHORE. This dimensional standard only applies to Lot I as it is the only lot with shoreline frontage. Pending Board approval,the plan will be filed with the County Clerk.
