INDIAN RIDGE PLANNED UNIT DEVELOMENT TO AMEND PUD
AGREEMENT AND PERMITTED USES

WHEREAS, by Resolution No.: 357,1996 the Queensbury Town Board (Town Board)
approved the Indian Ridge Planned Unit Development (PUD) subject to execution of a PUD
Agreement between the Town and the Developers, and
WHEREAS, by Resolution No.: 97, 2000 the Town Board approved the PUD Agreement and
authorized the Town Supervisor to execute same Agreement, and
WHEREAS, the PUD Agreement between the Town and Developers was executed on April
12, 2000, and
WHEREAS, the owner of Tax Map Parcel No.: 295.20-1-4.2 has requested an amendment to
the PUD Agreement and Master Plan for the Indian Ridge PUD to reflect a change of permitted use
designation from commercial services to single family residential, and
WHEREAS, the Town Board desires to consider such changes to the Indian Ridge PUD, and
WHEREAS, changes to PUDs are subject to the requirements of Queensbury Town Code
Chapter 179, Article 12, and
WHEREAS, by Resolution No.: 330,2021 the Town Board referred the proposed change to
the Queensbury Planning Board for consent to the Town Board being Lead Agency for State
Environmental Quality Review Act (SEQRA) and for review, report and recommendation, and
WHEREAS, at their meeting on November 16, 2021 the Planning Board passed motions
consenting to the Town Board being Lead Agency for SEQRA and offering a positive
recommendation on the proposed change to the Indian Ridge Planned Unit Development,
WHEREAS, the Town’s Senior Planner has reviewed the proposed change to be sure it
is in compliance with the PUD Ordinance and the Indian Ridge PUD and has recommended that
the Town Board adopt a Resolution affirming that the proposed change is consistent with the
Indian Ridge PUD and the prior SEQRA Negative Declaration for the PUD, and
WHEREAS, the Warren County Planning Department has reviewed the proposed change and
on December 10, 2021 recommended approval, and
WHEREAS, Municipal Home Rule Law §20 requires the Town Board to hold a Public
Hearing prior to the adoption of any Local Law and by Resolution No.: 393,2021 the Town Board

scheduled the public hearing, and on Monday, December 20, 2021 duly conducted the public hearing,
heard all interested parties and closed the public hearing, and
WHEREAS, the Town Board has considered the conditions and circumstances of the
proposed Local Law and wishes to consider adoption of Local Law No.: __ of 2021 as presented at
this meeting,
NOW, THEREFORE, BE IT
RESOLVED, that the Queensbury Town Board determines that the proposed modification
will not result in any new or different environmental impacts then those previously analyzed at the time
of PUD approval and that, therefore, no further SEQRA review is necessary, and
BE IT FURTHER

RESOLVED, that the Queensbury Town Board hereby affirms that the proposal by the
owner of Tax Map Parcel No.: 295.20-1-4.2 for an amendment to the Indian Ridge PUD
Agreement and Master Plan to reflect a change of permitted use designation from commercial
services to single family residential is consistent with the Indian Ridge PUD as approved by the
Town Board by Resolution Nos: 357,1996 and 97,2000 and the prior SEQRA Negative
Declaration for the PUD, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby adopts Local Law No.: __ of 2021, “A Local Law
to Amend the Indian Ridge Planned Unit Development to Change Zoning of Certain Property From
Community Service to Single Family Residential,” and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk to send a
copy of this Resolution and a copy of the Local Law to the Town Planning Board, Town Zoning
Board of Appeals, Town Zoning Administrator and Warren County Planning Department in
accordance with §179-15-080(D) of the Town Zoning Law, and
BE IT FURTHER,
RESOLVED, that the Town Board hereby authorizes and directs the Town Clerk to file the
Local Law with the New York State Secretary of State in accordance with the provisions of the
Municipal Home Rule Law and acknowledges that the Local Law will take effect immediately upon
filing with the Secretary of State.
