EASEMENT AGREEMENT
WHEREAS, ROBERT A. GOVER
, is the owner of a parcel of land situate in the Town
of Queensbury, County of Warren and State of New York which parcel was conveyed to him by
deed from Dennis Jackson dated June 1, 2012 and which deed was recorded in the Warren County
Clerk’s Office on July18, 2012 in Volume 4532 at Page 140, (Tax Map Parcel 309.10-1-63) and
WHEREAS, MOUNTAIN VISTA PROPERTIES, LLC,
a New York Limited Liability
Companyis the owner of a parcel of land situate in the Town of Queensbury, County of Warren
and State of New York, which parcel was conveyed to it by deed from DNE LANDS, LLC dated
June 8, 2021 and which deed was recorded in the Warren County Clerk’s Office on June 9, 2021
in Book 6385 at Page 52, (Tax Map Parcel 309.10-1-60) and
WHEREAS, ROBERT A. GOVER AND MOUNTAIN VISTA PROPERTIES, LLC
wish to grant to each other an easement over their respective premises.
NOW, THEREFOREROBERT A. GOVER
, hereby grants a permanent easement
MOUNTAIN VISTA PROPERTIES, LLC
twenty-five (25) feet wide to for the purpose of
constructing and using a turn around area (a hammer-head turn around) which will have a
minimum length of sixty (60) feet and a turning radius which would allow a fire or other
emergency vehicles to travel from Newcomb Street over twenty-five (25) feet wide right of way
MOUNTAIN VISTA PROPERTIES, LLCROBERT
granted by and cross onto the premises of
A. GOVER MOUNTAIN VISTA PROPERTIES,
but then be able to back onto the premises of
LLC
and then exit the Judkins parcel by way of the twenty-five (25) feet wide right of way to
Newcomb Street. The intent is to create a hammer-head turn around using portions of each of
parties premises for the benefit of each of the parties hereto.
MOUNTAIN VISTA PROPERTIES, LLC
hereby grants a permanent easement twenty-
MOUNTAIN VISTA
five (25) feet wide adjacent to the northerly boundary of the
PROPERTIES, LLC
parcel (5639/62) from Newcomb Street through the premises of
MOUNTAIN VISTA PROPERTIES, LLCROBERT A. GOVER
until it reaches the parcel of
(4532/140).
The easements granted to the parties hereto are for the purpose of allowing access by
vehicles and on foot over and across said easements from Newcomb Street to and onto the premises
of Gover; same are to provide access to improvements on said premises by emergency vehicles.
MOUNTAIN VISTA PROPERTIES, LLC
The easement granted by is twenty-five (25)
MOUNTAIN VISTA PROPERTIES,
feet wide and is adjacent to the northerly boundary of
LLC
for its entire length.
ROBERT A. GOVER
The easement granted by is twenty-five (25) feet wide and is
described in Schedule A which is attached hereto.

In addition to the above access easement, if desired by , at Gover’s
MOUNTAIN VISTA PROPERTIES, LLCROBERT A. GOVER
expense, also grants to , an
easement to install underground electric power and sewer line (connected to the existing building
MOUNTAIN VISTA PROPERTIES, LLC
of sewer line that is connected to the Town of
Queensbury Sewer System.
BEFORE
either party is to commence construction on the other party’s premises, that
party will provide the other party proof of liability insurance naming the other party as an
additional insured.
Any gravel disturbance made in installing the power lines, the sewer lines and or paving
the easements, shall be returned to prior state at the expense of the party making the disturbance.
