4.04 J� r 4.4 NON-SIGNIFICANCE\Consent to LGPC as Lead Agent—Septic Inspection Program—2-14-2022 RESOLUTION AUTHORIZING CONSENT TO LAKE GEORGE PARK COMMISSION BEING DESIGNATED AS LEAD AGENCY FOR PURPOSES OF FULFILLING SEQRA REQUIREMENTS RELATIVE TO ESTABLISHMENT OF LAKE GEORGE PARK COMMISSION WASTEWATER MANAGEMENT REGULATIONS RESOLUTION NO.: ,2022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, in accordance with the State Environmental Quality Review Act (SEQRA), the Lake George Park Commission (Park Commission) has notified the Queensbury Town Board that the Park Commission is seeking Lead Agency status for the purposes of fulfilling the SEQRA requirements relative to new Lake George Park Commission Regulations 6 NYCRR 646-3 Wastewater Management regarding the development of new wastewater standards for the Lake George Basin related to a potential septic inspection program (the "Project") as set forth in the Park Commission's January 28,2022 letter presented at this meeting, and WHEREAS, the Park Commission has requested that the Town Board consent to the Park Commission being designated as Lead Agency, and the Town Board has concluded that the Park Commission is the most involved agency and should be Lead Agency for the purposes of SEQRA review relating to the Project, and WHEREAS, the Town Board wishes to therefore provide such consent by execution of the Lead Agency Response Form presented at this meeting, _i- C NOW, THEREFORE,BE IT RESOLVED, that the Queensbury Town Board hereby authorizes, directs and consents to the Lake George Park Commission acting as Lead Agency for SEQRA review relative to new Lake George Park Commission Regulations 6 NYCRR 646-3 Wastewater Management regarding the development of new wastewater standards for the Lake George Basin related to a potential septic inspection program and authorizes and directs the Town Supervisor to execute the Lead Agency Response Form substantially in the form presented at this meeting, submit it to the Park Commission and take any other actions necessary to effectuate the terms of this Resolution. The Lead Agency must determine the need for an environmental impact statement(EIS) on this project. Please note,the Park Commission desires to be Lead Agency, intends to develop an EIS, and aims to hold public hearings on this regulatory initiative during summer 2022 when the maximum number of landowners may be available to participate. [ ] expects to conduct an uncoordinated SEQRA review and (will make)/(has already made) an independent SEQRA determination (if a decision under SEQRA has already been made, please attach a copy) We have the following concerns, which we feel should be addressed in the SEQRA review: Name of Responsible Officer Date s RESOLUTION ADVANCING SEPTIC SYSTEM INSPECTIONS AND STANDARDS FOR THE LAKE GEORGE PARK RESOLUTION 2022-01 WHEREAS the Lake George Park Commission is charged with the long-term protection of Lake George and its unparalleled water quality, and WHEREAS improperly functioning wastewater treatment systems ("septic systems") can have deleterious impacts upon public health and nearby waterbodies including Lake George, and, WHEREAS the Commission is empowered by Article 43 of the NYS Environmental Conservation Law to develop regulations pertaining to wastewater treatment systems in the Lake George Park, and WHEREAS in the summer of 2021, the Commission formed an Ad-Hoc Committee comprised of representatives from NYS DEC, NYS DOH and local municipalities, as well as engineers and subject matter professionals to research and investigate the need for a proactive inspection program for septic systems within proximity of Lake George, and WHEREAS this Committee found that a recurrent septic system inspection program would ensure the functionality and viability of these systems surrounding Lake George and its tributaries, similar to programs in many other lakes around New York State, and WHEREAS the Committee also identified a need for increased design standards for septic systems for properties in the Lake George Park to help protect localized environments and public health, and WHEREAS the establishment of new regulations is a Type 1 action under SEQRA for which the environmental impacts must be evaluated, Now Therefore Be It Resolved that the Commission hereby moves to begin the formal process of regulation development pursuant to the State Environmental Quality Review Act and the State Administrative Procedure Act, and desires to act as the lead agency for this project, and Further Resolved that the Executive Director, Staff and Commission counsel shall cause all involved agencies and any other interested agencies to be notified of this resolution, and Further Resolved that pursuant to 6 NYCRR part 617.4 (b)(1), the Commission hereby declares that this project is a Type 1 action under SEQRA and accepts the completed EAF Part 1; and Further Resolved that the Commission will continue to work collaboratively with all involved and interested agencies, municipalities and stakeholders throughout this process to ensure public participation and awareness, resulting in the most effective program possible, balancing the needs of environmental protection and costs to the regulated community.
