Dear Chairman Jackoski and Chairman Hunsinger:
Please be advised that our law firm represents the Fuchs with regard to their proposal to restore
the condition of an area which makes up their shoreline. The subject area contains a deteriorated
concrete patio with associated concrete stairs and maintains a zero setback to the shoreline. As a
result of its size and location, any improvement to this area requires a variance.
The Applicants are proposing to rehabilitate this area by constructing a 136 square foot wooden
patio on top of it with a supporting staircase which would be approximately 23 square feet in
size. In assessing the project,the Applicants wanted to restore the area in a manner which had
the least impact on the environment. As a result,removing the broken concrete patio, was not an
option due to the negative effects that it would have because of its close proximity to the Lake.
The Applicants proposal is to stabilize the broken concrete patio by placing a galvanized metal
frame which will be fabricated to the size and shape of the existing broken concrete patio. The
wood or composite deck will then be constructed on top of the stabilizing metal frame. The

wooden stairway will be constructed upon and bolted to the existing concrete stairs which lead to
this broken concrete patio.
The area variances requested are for relief from the shoreline setback requirement and for
altering a pre-existing non conforming accessory structure. Due to the aesthetic improvement
proposed,no undesirable change will result with the granting of this variance. In addition, since
the structure pre-dates zoning and is entirely contained within the setback, any modification
would require relief. As a result, this request should not be deemed substantial or self-created.
Due to this project being limited to the restoration of the existing broken concrete patio and
stairs, during Site Plan Review the Applicants request waivers from the following requirements:
(1) Storm water;
(2) Topography;
(3) Landscaping;
(4) Land Use Districts;
(5) Lighting; and
(6) Traffic.
I have enclosed both the Area Variance and Site Plan Applications, supporting pictures,the plans
for the restoration project and the required fee. Please place this on your next available agenda.
