Relief requested from minimum shoreline and sideline setback requirements. In addition, relief requested from expansion of a nonconforming structure 3/17/2010 BP 06-572: 160 sq. ft. deck SB 8-2008: 3.42 acres into 2 lots of 1.0 & 2.42 acres 5/28/2009 PROJECT DESCRIPTION: Site Plan: Applicant proposes removal of 130 sq. ft. of existing stairs and replacement with 320 sq. ft. of stairs, landings, and decking. Further a 23 sq. ft. access landing and stairs to be removed and replaced on the west side of structure. Applicant has received ZBA approval for a 116 sq. ft. deck along shoreline (AV 4-2010), total square feet of new stairs, landing and decking equates to 456 square feet. Hard surfacing within 50 feet of a shoreline, removal of vegetation within 35 feet of a shoreline and expansion of a nonconforming structure in a CEA requires Planning Board review and approval. STAFF COMMENTS: As previously mentioned, the applicant had received approval for the deck proposed along the shoreline; please see attached resolution A.V. 4-2010. The proposed property line adjustment does not affect this approval; however, the other approvals associated with the parcel prior to the property line adjustment are void and now require relief as stated below. The applicant has received approval for a holding tank from the Town B.O.H. on 11/21/11, see attached. Further, on 3/21/2012 the applicant received approval from the ZBA for setbacks associated with the lot line adjustment, please see attached resolution. Site Plan Review  The limits of clearing should be clearly annotated on the site plan. If any trees are to be removed, please designate size, type, and location. Additional comments: 1. The Zoning Board of Appeals has placed two conditions on Area Variance 9-2012 approval and are as follows: a. Decks, landings and stairs not to increase is size b. Town Board approved septic alterations to be installed. 2. The Zoning Board of appeals approved Area Variance 10-2012 which was associated with the lot size change; please see attached resolution.
