SUPERVISOR WALTER-Introduced Kestner Engineers, they have prepared the
Engineer's report for the Sewer Distict...We have spent a great deal of time on trying
to come up with a district that will encompass the areas of Queensbury particularly
in need of sewers. One prime factor in creating a district is to have a place to dump
the sewage, we had-several options, one to go with the City of Glens Falls the other
to build our own plant and a third to go with Washington County. We spent a great
deal of time in negotiations we were able to conclude a contract between the City
of Glens Falls, it is the most economical an efficient way to handle the sewage
effluent that will be coming out of this district and that is the point where we are
at now. Turned the meeting over to Mark Kestner of Kestner Engineers.
MR. MARK KESTNER-Reviewed the History of the proposed establishment of the
Central Queensbury/Quaker Road Sewer District...congratulated the efforts of the
Town Supervisor and Town Board in the contract negotiations with the City of Glens
Falls for the use of the City's Sewer Plant...(using map) Reviewed the Boundaries
of the Sewer District...There are two surface water discharge in this district one
at the Queensbury Plaza which discharges into the Half-Way Brook the other at
Regency Park which also discharges into Half-Way Brook. There are nine major
ground water discharges in the area including the Grand Union, Northway Plaza,
McDonald's, Dunkin Donuts, Roberts Garden North, Pyramid Mall...ect...Queensbury
does have a water system in the proposed district. In the mininum size sewer and
the sum of all the lines indicates the average daily flow of 250,000 gal. a day, all
the sewers will have the capacity of three times the daily flow and enough to
accomodate a future daily flow of in excess of 400,000 gal. a day which is what
was used in our negotiations with the City of Glens Falls. It has been determined
that most of the area can be serviced by gravity, there will be a pump station located
north of the intersection of Meadowbrook Road and Quaker Road in the District
Boundaries. A second smaller pumping station will serve the Regency Park Apartment
Complex... all sewers will be 8 to 12" in diameter. Borings under pavements will
be required under Aviation Rd., Quaker Road, Route 9 and Bay Road. The Central
Pump Station will be a wet well, dry well type. Reviewed the soil conditions including
the high water situations that will be met during construction of the system. The
Total Capitity of the City of Glens Falls 8% million gal. per day, Ciba Geigy has
purchased a flow of 3% million a day, the City has a capicity of 5 million a day three
of which is domestic flow two for collection system...The proposed district in the
Town of Queensbury would have a flow of 250,000 per day to allow for expansion
it was considered that the Town should buy capacity of 400,000 per day. The Town
of Queensbury would represent 10% of the total flow as compared with the City
of Glens Falls. A total initial capital charge for the Town of Queensbury would
be in the range of $300,000 dollars, in addition to the capital cost there would be
a yearly charge for the Town of Queensbury for the operation and maintenance of
the Glens Falls Treatment Plant and rental charge to use the City Sewers. An

agreement was announced on August 16, 1985 between the City and Town Item
1. Capicity-The City will provide the Town of Queensbury 400,000 gal. per day
with the option to request additional capicity...we would have first refusal on
additional capacity... Item 2. Capital Cost-The Town will pay the City of Glens
Falls 300,000 dollars for the capicity Item 3. Annual Charge-The fee for treatment
cost will be allocated on a share of flow basis plus 20% Item 4. Sewer Use Fee-The
use fee will be developed as a percent of the Total Sewer System operation and
maintenance cost for the City times a percent of the City Sewer System utilized
by the Town. Item 5. Maintenance responsibility for all lines use by the Town of
Queensbury within the City of Glens Falls,will be maintained by the City of Glens
Falls, including the Queensbury portion. Item 6. Plans and Specifications for
constr ,:tion of the Queensbury mains and pump station as it relates to meter reading
will b� reviewed by tl,ll City. Item 7. The Agreement is thirty years as the time
of exe, ution of December 31, 1985. The Queensbury Construction cost is estimated
at 5.2 million dollars, the engineering, legal fiscal administration etc. 1.3 million
dollars...The Town of Queensbury force main in the
City of Glens Falls is estimated at 200,000 dollars the basic treatment charge for
400,000 gal. capacity is 300,000 dollars giving a total project cost of 7 million dollars.
Using a Bond rate of 8% and a payback period of 20 years and a capital recovery
factor of .101 it requires an annual debt service of 712,000 per year. Plan for charges:
an advalorem charge, land area charge, water use charge, residential unit charge,
'f front footage charge and sewer hook-up charge...since the sewer dist. consists of
large commercial properties undeveloped land and residential properties an assessment
formula incorporates advalorum, lot area and water use would seem most equtible.
The advalorum $6.84 per thousand of assessed valuation...lot area assessment $238.00
per acre ... Water Use-$2.65 per thousand...City Charge for O&M of $33.00 and
Town of Queensbury O&M 15.00...Residential property...in Commercial Property
they would pay City O&M charge of $66.00 and Qsby. O&M 30.00 the advalorum
and lot area assessment and water use would be the same....the Treatment by the

City of Glens Falls is the most cost effective method...

MR. MARK KESTNER-Noted that there are two ways...one to extend the district
or to contract with the Town for Service...
MR. BILL QUOLA-Questioned if we would have permission to hook up, noted that
there would be increased flow...
MR. MARK KESTNER-Noted that the increased flow would not go over the contracted
amount...
MR. BILL QUOLA-Is there a deadline to apply for a contract?
SUPERVISOR WALTER-As soon as possible apply to the Board for a contract of
service...so negotiations can begin...
COUNCILMAN OLSON-Do you share a system with Long John Silvers?
MR. BILL QUOLA-No.
MR. JIM COCCIA-White Pine Rd.-Once the Dist. is established and its maintaince
is run by the Town, what agency of the Town will run it?
SUPERVISOR WALTER-That will be under the Town Board-It will either the Highway
or Water Dept., there will be one individual that will be hired in either one of those
dept....
MR. JIM COCCIA-Is there a back flow, if something breaks down at point X where
does the sewage go...
M.P. MARK KESTNER-Noted that the system is gravity feed and is not under pressure,
reviewed the mechanism of repairing pipes that are broken...
SUPERVISOR WALTER-Mr. Coccia, do you live in the Dist.?
MR. JIM COCCIA-No.
MR. BILL MORTON-9 Meadow Drive-(read a prepared statement) sewering will
not be without secondary impacts, sewering will enduce growth and development
which will have paved areas in the Half-Way Brook Drainage Basin...this may increase
the level of flooding, 'also effect water quality—there is a need to manage runoff,
only recently has the pollution problem been recognized from runoff ...this is not
intended to distract from the fact that sewering is needed along Route 9 and Quaker
Road, it is intended to show some but not all of the secondary impacts, the question
that remains is what if anything can be done to midigate these impacts...this can
be done is the Town Board implements a Stream Corridor Management Program
combined with a Storm Water Management Program to control Urban
Runoff..(presented manual to Town Board) I would encourage you to consider this
last option in conjunction with the Quaker Road Sewer System.
MR. MARK KESTNER-I do not disagree with your statments...I will say in the proposed
construction of the district we will not be paving any areas that are not already
paved, we are aware of the wet lands in the area and flood planes...we will use ENCON
guides during construction...
MR. JOSEPH KESTNER-Our Firm provides engineering services to the Town of
Glenville and when they have new development in congested areas they set a standard
that the run off from the new facilities shall not exceed what it was previously and
therefore they provide a storm water detention basin and limit the runoff to the
same as it was before the land was developed, that way you can control runoff...this
has worked quite well.
MR. ANTHONY PALANGI-Wincrest Drive-(out of district)-I am asking a financial
question, has other avenues of financing been explored in order to lessen the impact
on the taxpayers? Federal or State Aid or low interest rates?
SUPERVISOR WALTER-I can assure you that we have explored all possibilities for
financing...
MR. MARK KESTNER-A major source of funds historically was the Fedreal EPA,
prior to 72 there were funds for water pollution control ...there has been cut backs
in the total amount.of monies available...N.Y. State has a project priority system,
point system...we do not meet its criteria...The Federal Goven't does not want to
promote urban sprawl they took away the aid for 8" diameter sewers...other agenices
that were looked at were Farmer Home...they are out of the low interest loans...they
also have a grant program based on income they are difficult to obtain...
SUPERVISOR WALTER-In looking at a program to keep the costs as low as possible
and what we generally give at public hearings is the worst possible case we have
looked at 20-30 year financing because we are financing this project entirely at
the expense of the taxpayers we look at the best way to finance and there is 20
year financing certainly cuts down on the amount of interest that you are paying
over a longer period of time. We will also bond this project and I can only tell you
that with the credit rating that the Town of Queensbury currently enjoys that we
will be getting the best possible rates on the bond. I have talked with Congressman
Solomon in regard to the economic development group, the Town of Queensbury
just because of the financial status as per census figures we have only one
neighborhood that would meet the criteria were we are eligible for the different
programs. We are looking at the best possible cost that we can present at this time,
every year construction costs go up...
MR. DAN VALENTI-Valenti Builders- I just got approval last week on my Townhouse
project which is just outside the dist. 1. When this sewer dist. goes in what is the
time frame when the sewer lines will be laid? Z. Can the district be expanded?
Noted he will have 250 units...bow long would it be to the second phase...
MR. MARK KESTNER-Hope to complete construction in November of 1987 to match
with the City's completion date of March 1987... the district can be extended... ✓
MR. STEVEN ZEMANEK-Quaker Village-Concerned about the hook-up..Bay St. or
Quaker Rd.
MR. MARK KESTNER-(used maps) reviewed the Quaker Village area and noted the
locations that the hook ups could be made....will be visiting Mr. Zemanek with further
information...
MR. CHARLES SCUDDER-Weeks Rd.-Did I understand that the design capacity
of the plant is 8% million of which 2 million is reserved for infiltration?
MR. MARK KESTNER-That is correct.

MR. CHARLES SCUDDER-Is there a program to seperate storm from sanitary?
MR. MARK KESTNER-Explained the Infiltration Study...
MR. CHARLES SCUDDER-Are there any competing interests in the capacity of
the plant?
SUPERVISOR WALTER-Yes...The City wants to keep it in reserve, for the City
and Industrial expansion...we struggled long and hard to get the capacity where it
is now—we felt it was important to get an option on capacity as it became available.
The Ev Aneers feel that there is capacity that we can purchase, we will have to
4 wait urAil the plant is running to see how much it is...at that point they will talk
to us az .din.
MR. ZEMANEK-Questioned the figures, can this runover?
MR. KESTNER-We are confident in the figures, there is 10% in contingent...
SUPERVISOR WALTER-The legalities in the Town Board creating a special district
is presented to the public at the maximum cost, when the district is created it will
be created on those cost, should we go over those costs we would have to go back,
and do this again, that is the reason that there are built in contingencies. If is comes
in lower you will reap the rewards.
MR. LARSON-I want to express my opinion which is favorable, because I am a resident
of the sewer dist. as proposed. I have heard nothing tonight which is negative...The
timing is important, and the Board should vote in favor of this project.
COUNCILMAN OLSON-I want to thank the Kestner firm for putting together this
proposal it was well presented...
COUNCILMAN EISENHART-I guess I am the only member of the Board that is in
the District and I am delighted, even though my septic system is working I do not
know from day to day if it will or not...

SUPERVISOR WALTER-(regarding proposed sewer dist.)We have had some comments
here this evening regarding people that are interested in being a part of the proposed
district. Several of these people had spoken to me, I talked with our engineers and
with the City of Glens Falls, we feel that we would like to go ahead with this district
and address those problems, the one in which it is not contingent with the Dist.,
with contractual, and the fact there will be development not only Mr. Vanenti but
other possible subdivisions and large housing units along Bay Road, we will have
time to work on the extension of this district over the next winter, we will have
this in mind, we have looked at Extension No. 1 which is up Route 9 and Extension
No. 2 in hoping when capacity became available we would be able to add to the
district.. Because of the bonding capabilities we are into now and the good rates
and the fact that we have the opportunity to go with extentions and get on with
them.
COUNCILMAN MORRELL-If we were to extend the District to other areas, could
those areas be factored into the ad valorem taxes?
SUPERVISOR WALTER-They could be incorporated into the district or go on their
own...
COUNCILMAN OLSON-They would pay the same as someone in that Dist.
COUNCILMAN EISENHART-Probably more...
COUNCILMAN MORRELL-This sewer dist. is a cooperative effort thanks to
businessmen who will be in the dist. , The Adirondack Regional Chamber of Commerce
a lot of hard work was done through an AD HOC committee, now we are seeing
the fruits of the labor of all of these people. I am thrilled.
COUNCILMAN MONAHAN-We should commend our Supervisor for the long hard
hours of work that have been put in reaching an agreement with the City...
COUNCILMAN OLSON- I am especially pleased that a solution has been found
in our Central Business Dist.
SUPERVISOR WALTER-I am happy that we are getting to the point where we can
pass a resolution an get on with it. We now have to wait the legal time frames

out...then we will make a final determination and sent it to the State Comptroller,
when we get his approval then the dist. will be approved. This is the first real sewer
dist. in the Town...we have got another area in town that we have got to get into
sewers and I hope that now our efforts will be directed to the Lake George area
and that we can get on with working there.
COUNCILMAN MORRELL-Our effort here tonight will be amunition for the Board
to.go into an area that cannot solely fund itself, if we pull this project off, the State
and Federal Govn't will have to look favorably on us for funding in areas where the
Tax Base is not strong enough to correct a bad situation...So. Qsby.,
Rockhurst,Cleverdale Area...
COUNCILMAN OLSON-We have had several new water dist. in the past few years,
but it has been years since we have had a piece of business before us that has been
as important as this resolution we are dealing with right now. ---'

A RESOLUTION MAKING DETERMINATIONS PURSUANT TO SECTION 209e OF
THE TOWN LAW OF THE STATE OF NEW YORK IN RELATION TO THE PROPOSED
ESTABLISHMENT OF A SEWER DISTRICT IN THE TOWN OF QUEENSBURY,
WARREN COUNTY, NEW YORK TO BE KNOWN AS THE QUAKER ROAD SEWER
DISTRICT
RESOLUTION NO. 210, Introduced by Dr. Charles Eisenhart who moved for its adotion,

WHEREAS, the Town Board of the Town of Queensbury, Warren County, New York
has heretofore duly caused a general map, plan and report to be prepared and filed
in the Office of the Town Clerk of the said Town in relation to the establishment
of a proposed sewer district in said Town, to be known as the Quaker Road Sewer
District; and
WHEREAS, an order was duly adopted by the said Town Board on August 27, 1985

RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New
York as follows:
Section 1. The establishment of a sewer district in the Town of Queensbury,
Warren County, New York to be known as the Quaker Road Sewer District, to be
bounded and described as hereinafter set forth, and the construction of a sewer
system to serve said district, including the installation and construction of pipes,
hydrants, valves and appurtenances for the collection of waste water in said district
and basic treatment one-time charge for use of the Glens Falls Treatment Plant
at a maximum estimated cost of Seven Million Dollars ($7,000,000.00) is hereby
approved and authorized. The method of financing the cost of said improvement
shall be by the issuance of not more than Seven Million Dollars ($7,000,000.00) in
serial bonds of said Town, maturing in annual installments over a period not exceeding
twenty (20) years, payable in the first instance from a levy on the taxable real
property in said sewer district which the Town Board of said Town shall determine
and specify to be especially benefited thereby in the manner prescribed by Subdivision
2 of Section 202 of the Town Law.
Section 2. Said sewer district shall be bounded and described as is set forth
in Schedule "A" annexed hereto and made a part hereof.
Section 3. Within ten (10) days after the date that the adoption of this resolution
becomes effective, the Town Clerk of said Town is hereby directed to file a certified
copy of this resolution, in duplicate, in the Office of the State Department of Audit
and Control, in Albany, New York together with an application, in duplicate, for
permission to establish the aforesaid sewer district, in the manner required by the
provisions of Subdivision 3 of Section 209-f of the Town Law.
Section 4. This resolution is subject to a permissive referendum as provided
by Section 209-e of the Town Law.

ORDINANCE ESTABLISHING NEW ZONE FOR MOBILE HOME PARKS
RESOLUTION NO. 212, Introduced by Mr. Daniel Morrell who moved for its adoption,
seconded by Mr. Daniel Olson:
WHEREAS, the Town Board of the Town of Queensbury received a petition from
Daniel P. and George Drellos requesting the establishment of a zone for mobile
home parks in an area totaling approximately 45 acres adjacent to Interstate Route
87 on the East and Luzerne Road on the South, and
WHEREAS, the Town of Queensbury Planning Board has reviewed the aforesaid
petition and recommended approval to re-zone the areas to permit mobile home
parks and further recommended that the area for such re-zoning include tax map
lot numbers 93-2-4,93-2-2,93-2-5,93-2-6,93-2-7,93-2-8,93-2-9,93-2-10.1,93-2-10.2,93-
2-11.1,93-2-12,93-2-21.3, and
WHEREAS, the Warren County Planning Board in accordance with Section 239m
o the General Municipal Law has reviewed the aforesaid re-zoning and recommended
approval thereof, and
WHEREAS, an amendment to said Zoning Ordinance has been prepared and a legal
description of such zone set forth, copies of which are hereto annexed, and
WHEREAS, the proposed amendment is worthy of consideration for legislative action
