Staff Notes Department of Community Development Queensbury Planning Board Staff Notes April 19, 2012 APPLICATION: Subdivision 14-2005 (Modification); Site Plan 25-2012 & Freshwater Wetlands Permit 2-2012 APPLICANT: Hayes Construction Group REQUESTED ACTION: Subdivision: Modification to approved subdivision requires PB review / approval; Site Plan/FWW: Land clearing/disturbance in excess on one acre and disturbance within 100 feet of regulated wetland LOCATION: 504 Luzerne Road EXISTING ZONING: MDR-Moderate Density Residential SEQRA STATUS: Unlisted or reaffirm previous SEQR PARCEL HISTORY: Subdivision 14-2005 Original approval Subdivision 14-2005 Modification-David Howard-Lot PROJECT DESCRIPTION: Applicant proposes modification to an approved subdivision to include as- built house and driveway location as well as after the fact limits of disturbance. STAFF COMMENTS: The applicant is seeking subdivision modification as a result of the recently erected house being sited in a location other that what was approved. Clearing limits have been exceeded and are within the no-cut zone and disturbance within 100 feet of a delineated wetland has occurred. The Planning Board is being asked to approve, after the fact, both the existing location of the Single Family Dwelling as well as the disturbance associated with the construction of the home and disturbance within the 100 foot adjacent zone to a wetland. Additional comments: 1.Total disturbance according to the applicant is 17,600 square feet. This appears to be an underestimation upon review of the submitted survey map and should be quantified to include total property clearing as well as homesite. 2.The site has yet to be stabilized and it should be ascertained when soil stabilization will occur. 3.SWPPP associated with initial subdivision has been submitted. 4.Initial approved location of house attached. 5.The applicant has requested waivers from grading, stormwater, E&S and topography.
