Project Description
Applicant has developed a pathway of approximately 650 ft. on a 5.34 acre parcel that is currently vacant.
Project for land disturbance without review, tree/vegetation removal within a wetland. Pursuant to Chapter
179-9-020, 179-6-050 and chapter 94 of the Zoning Ordinance, land disturbance, wetlands cutting and Chapter
94 wetlands work within 100 ft. of shoreline shall be subject to Planning Board review and approval.
Staff Comments
• Location-The project is located at 373 Big Boom Road. The parcel is 5.34 acres
• Arrangement- The property is vacant other than an improved trail towards the shoreline
• Site Design- A portion of the path has been developed and will be a total length of about 650 ft. The plans
call for two sections of a graveled path. One section to be 7.5 ft wide by 42 ft in length and the second
section to be 7.5 ft wide by 30 ft in length.
• Building – no house as of application
• Site conditions-existing vacant lot
• Site plan overall- The applicant received a Notice of Violation 10/13/2020 per the Town’s Code
Compliance Officer for development of a pathway through a wetland. The applicant was not aware the
project work would need review and subsequently pursued the necessary review from DEC and Army Corp
and the Town’s Site Plan and Wetlands review. Due to covid coordination with outside agencies to evaluate
the site work was an extended process.
• Grading and drainage plan, Sediment and erosion control- The applicant has received correspondence from
DEC for the tree removal at the bank and the bank stabilization meets the Water Quality Control Certificate

• Site lighting plan-There is no lighting proposed at this time.
• Utility details-There are no utility connections at this time.
• Elevations, Floor plans-There is no house proposed at this time.

• Waivers-Planning staff has reviewed the applicants request for waivers that include items g. site lighting, h.
signage, j. stormwater, k. topography, l. landscaping, n traffic, o. commercial alterations/ construction
details, p floor plans, q. soil logs, r. construction/demolition disposal s. snow removal.
• The waivers requested–Staff finds it reasonable to request a waiver as the project is specific to the
development of a residential recreational path through wetlands and shoreline work for access to the
shoreline.
Pursuant to Section 179-9-050 the Planning Board may grant waivers on its own initiative or at the written
request of an applicant. The Board is to review the waivers and to determine if they are to be granted
Freshwater Wetlands Permit
The project plans indicate the path/work will cross over approximately 540 sq ft of the wetland area. The
project work also includes prepping the embankment area at the Hudson River to allow access to the water.
Summary
The applicant has completed a site plan application and freshwater wetlands permit for the development of a
650 ft length 7.5 ft wide footpath through a wetland area and work along the shoreline for access. The project
involves tree removal, culvert installation and gravel installation. The applicant is to complete the work as
outlined in the Army Corp permit.
