Narrative 169 Haviland Road Queensbury, NY 12804 Hutchins Engineering PLLC Phone: (518)745-0307 Fax: (518)745-0308 February 15, 2022 Town of Queensbury Planning Board 742 Bay Road Queensbury NY 12804 Re- Foothills Builders — Round Pond Road Subdivision —Queensbury Lot 9 Site Plan —Access Driveway Modification Tax Map ID: 296.5-1-16 & 17 Dear Planning Board Members: This office represents Foothill's builders with respect to the modification to the approved single-family home project on Lot 9 of the Round Pond Road Realty Subdivision. This modification is for construction of a separate access drive across parcel 296.15-1-17 (Lot 10) to access the new home being constructed on parcel 296-1-16 (Lot 9). The original deed for Lot 10 includes an easement for a driveway to access Lot 9. During construction of the original driveway for the house on parcel 296.15-1-17 (Lot 10) the driveway was installed on the property line between lot 10 & lot 11. When this error was discovered the owners of Lot 10 & Lot 11 had a lot line adjustment of the property line between Lot 10 & Lot 11 so that the entire driveway for Lot 10 was within boundary of lot 10. The final deed for the lot line adjustment did not include the language for expanding the access easement for lot 9. Currently the owner of Lot 10 is refusing to allow use of the existing driveway because portions of the existing driveway are not within the easement delineation that is on the Lot 10 deed. This site plan modification proposes to construct a new driveway that is within the legally defined easement on Lot 10. The new driveway will be graded to drain to the north where the runoff from the new asphalt will be treated in a stone infiltration trench. Our client continues to try and resolve this matter without building the parallel access drive but requests approval of this modification if a resolution to use the existing driveway cannot be achieved.
