,U NEWELL, individually and as executor of the Estate of Ronald L. Newell, residing at 19 Horicon
Avenue, Glens Fails, New York,12801,parties of the first part, and FOOTHILLS BUILDERS, LLC,
a New York Limited Liability Company with an office located at 9 Mountainside Drive, Queensbury,
New York, 12804, party of the second part,
WITNESSETH, that the parties of the first part, in consideration of One Dollar($1.00) lawful
money of the United States and other good and valuable consideration paid by the party of the
second part, do hereby grant and release unto the party of the second part, its successors and
assigns forever,
ALL THAT PIECE OR PARCEL OF LAND, situate, lying and being in the Town of
Queensbury, County of Warren, State of New York, and more particularly described in the
Schedule A attached hereto and made a part hereof.
Being the same premises described in a deed from Savino J. D'Angelico and Donna
D'Angelico flkla Donna M. Myers to Delwyn Mulder and Ronald Newell dated October 25,
2002 and recorded on October 30, 2002 in the Warren County Clerk's Office in Liber 1292
of Deeds at Page 180.
Ronald L. Newell died on January 15, 2021 a resident of the County of Warren. On January
22, 2021, Ronald Newell's Last Will and Testament was admitted to probate in Warren
County Surrogate's Court and Jane Marcella Newell was appointed as executor and
continues to act as such to date. Jane Marcell Newell is the surviving spouse of Ronald
Newell and the sole beneficiary of the estate.
Together with all right, title and interest, if any, of the parties of the first part in and to any
streets and roads abutting the above -described premises, to the centerline thereof.

Together with the appurtenances and all the estate and rights of the parties of the first part
in and to said premises.
To have and to hold the premises herein granted unto the party of the second part, their
heirs and assigns forever.
And said parties of the first part covenant as follows:
First, that the party of the second part shall quietly enjoy the said premises;
Second, that said parties of the first part will forever warrant the title to said premises.
Subject to the trust fund provisions of Section Thirteen of the Lien Law.

ALL THAT CERTAIN PIECE, PARCEL OR LOT OF LAND, situate, lying and being in the Town of Queensbury,
County of Warren and State of New York bounded and described as follows, to wit;
Bounded on the north by the highway leading from Glens Falls to what is known as Hogsback; on the west by
lands now or formerly owned by Roger Hopkins; on the south by lands nor or formerly owned by Lewis Howe; on the
east by land nor or formerly owned by William Granger Estate; being the same premises devised to the First Baptist
Church of Glens Falls by Eliza Turner, now deceased, and upon which said Eliza Turner resided at the time of her death;
and being the same premises conveyed by deed made October 5, 1887, by the First Baptist Church of Glens Falls to
Rudolph Akins of the Town of Queensbury, County of Warren and State of New York, which deed is recorded in the
County Clerk's Office on the 18'h day of October, 1887, in Book 53 of Deeds at page 556.
Parcel II
ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Queensbury, County of Warren, New York,
bounded and described as follows:
BEGINNING at the northwesterly corner of certain premises conveyed by Merritt G. Duell and Nora Duell, his
wife, to Timothy Turner by deed dated August 24, 1925, recorded in the Warren County Clerk's Office August 26,1925
in Book 165 of Deeds at Page 189, and at a point in the center of the highway leading from the city of Glens Falls to
Goodspeedville, and running thence south and along the westerly line of the premises so conveyed to said Timothy
Turner 263 feet to a corner; thence westerly 58 feet to the southwesterly corner of the premises conveyed by Albert B.
Granger to the said Merritt G. Duell and Nora Duell, his wife, by deed dated March 4, 1924, recorded in said Clerk's
Office on April 1, 1924 in Book 159 of Deeds at page 534; running thence northerly along the westerly line of the
premises so conveyed to said Merritt G. Duell and Nora Duel[, his wife, 263 feet to the center of said highway; thence
easterly along the center of said highway 58 feet to the point or place beginning, being the westerly 58 feet of the
premises so conveyed to the said Merritt G. Duell and Nora Duell, his wife, by Albert B. Granger, the remaining portion
of the premises so conveyed to the parties said Merritt G. Duell and Nora Duell, his wife, being those premises conveyed
by Merritt G. Duell and Nora Duel, his wife, to said Timothy Turner by the deed before mentioned.
The above two parcels of land collectively may be more accurately described as follows:

Warren County, New York, more particularly bounded and described as follows:
BEGINNING at an iron pipe set in the ground in the southerly bounds of Main Street, also known as the Corinth Road,
at the northeasterly corner of premises conveyed by Bullard and Riley to Norman W. Steves by deed dated January 4,
1958, recorded in book number 377 of deeds at page 166 in the Warren County Clerk's Office running from thence
North 80 degrees and 28 minutes East along the southerly bounds of Main Street, 141.22 feet to an iron pipe found in
the ground at the northwesterly corner of premises conveyed byJennie Allen to Raymond and June Ash by deed dated
June 12, 1968, recorded in book number 495 of deeds at page 570 in the Warren County Clerk's Office; thence South
09 degrees and 31 minutes East along the westerly bounds of the said lands conveyed to Ash, 237.84 feet to an iron
pipe found in the ground at the southwesterly corner thereof in the northerly bounds of land reputedly owned by one
Baldwin; thence south 80 degrees 50 minutes and 30 seconds West along a portion of the northerly bounds of the said
lands reputedly owned by Baldwin, 141.56 feet to a fence post found at the southeasterly corner of lands of Thomas
R. and Delia M. Dwyer; thence North 09 degrees, 33 minutes and 30 seconds West along a fence and the easterly
bounds of the said lands of Dwyer, 63.66 feet to a metal fence post found at the southeasterly corner of the said lands
conveyed to Norman W. Steves; thence North 09 degrees, 23 minutes and 30 seconds west along the easterly bounds
of the said land of Steves, 173.25 feet to the point of place of beginning.
EXCEPTING AND RESERVING FROM THE ABOVE PARCEL all that parcel of land conveyed from Ronald L. Newell
and Delwyn J. Mulderto the County of Warren Countydated March 11, 2008 and recorded in the Warren CountyClerk's
Office on May 16, 2008 in Book 3551 at page 307.
