Hi Daniel.
Thank you for reaching out about this project and the split rail fence along the east property line. It’s my understanding
that the project sponsor would like to eliminate a section of that fence that if installed would create a barrier to the
stormwater management basin. Jed Hayden with our Bureau of Ecosystem Health visited this site with you yesterday to
discuss that request and observe the area in question.
Based on Jed’s observations, the section of fence that you’ve indicated on the plans you provided as being unnecessary
is, in fact, unnecessary to prevent egress to the wetlands due to the topography in that area. Given that, DEC is in
agreement with the omission of the fence along the east property line and adjacent to the stormwater basin. Please
maintain a copy of this email and the revised plan you provided for future reference.
