My wife, Connie Fish, and I are the owners of property located at 6 Newcomb
Street, Que en9bury,New York. I offer this affidavit in support of my request to replace a
garage and a shed on my property with a garage shown in drawings included with this
affidavit and the application for a building permit.
The utility shed and garage have been continuously used by my brother and I for
the repair and construction of custom, made to order boats. To the best of my knowledge,
prior to our using this property in this manner, the property was used for car repair and
restoration, which is why we purchased the property in the early 1990s.
To the best of my knowledge, the use of the property encompassed the back two
lots, one of which is where the garage and shed are located, the other of which does not
contain any structures, other than temporary storage. I have continued to use this
property in the preparation, repair and construction of the boats since I bought the
property in the early 1990s. It is my understanding that this property was also used in the
auto business,conducted on the property before I purchased it. In fact, that is one of the
reasons I purchased the property. It was better for my family and I to conduct the
business where we lived rather than commute to my previous job working on boats.
Once the new garage is built, I will remove the storage shed on my property and
will convert the use of the old garage to personal/residential use. I understand that the
removing the shed and converting the use of the old garage is a pre-requisite to obtaining
a certificate of occupancy on the new garage.
I understand that the Town will rely on the truthfulness of my representations
made in this affidavit and also understand that if any of this is untrue, that-the Town may
resort to its legal rights to enforce its zoning laws against such untruths.

8. GRADE PLANE: A reference plane representing the.average of finished ground level
adjoining the building at exterior walls.Where the finished ground level'slopes away from the
exterior walls,the reference plane shall be established by the lowest points within the area
between the building and the lot line or,where the lot line is more than 6 feet from the building,
between the building and a point 6 feet from the building.
9. MEZZANINE: An intermediate level or levels between the floor and ceiling of any story with
an aggregate floor area of not more than 1/3rd of the area of the room or space in which the
level or levels are located. (Mezzanine area does not contribute to the building area or the
height in stories but does contribute to the fire area, aggregate area),
10. SMOKE BARRIER: A continuous membrane, either vertical or horizontal,such as a wall,
floor, or ceiling assembly, that is designed and constructed to restrict the movement of smoke.
(Required to have a I hr. fire rating).
11. STORY ABOVE GRADE PLANE: Any story having its finished floor surface entirely above
grade plane, except that a basement shall be considered as a story above grade plane where
the finished surface of the floor above the basement is: 1. More than 6 feet above grade plane
or 2. More than 6 feet above the finished ground level for more than 50%of the total building
perimeter or 3. More than 12 feet above the finished ground level at'any point.
