Dear Mr. Brown:
The Chazen Companies (Chazen) has received the latest submission package from your office for the Sans
Souci Restaurant of Cleverdale. The Applicant intends to modify an existing area variance and
that was approved in 2009. Submitted information includes the following:
Site Plan Set entitled, Church of Our Lady of the Annunciation Parking Lot Expansion, prepared
by Jarrett Engineers, PLLC, dated April 16, 2012;
A Stormwater Pollution Prevention Plan, prepared by Jarrett Engineers, PLLC; and
A Site Plan Application with supporting documentation.
Your office has requested that we limit our review to the designanagement and erosion
and sediment control items as it relates to compliance to local,
Based on our review of the information provided, Chazen offers t
consideration:
Stormwater Management & Erosion and Sediment Control:
1.The proposed site improvements disturb less than 1-acre of land and will not be subject to
NYSDEC Phase II Stormwater Regulations. However, Section 179-6-080 of the Town Code, states
that the stormwater drainage plan shall analyze impacts of the project using at least a 50-year
return interval storm for commercial projects. The Applicant has not provided calculations for the
50-yr storm. The Applicant shall complete appropriate calculations and submit them in support of
the application.
2.This project is also located in the Lake George Park, and will be subject to the requirements of
Section 147-11 of the Town code, which reiterates the regulations of the Lake George Park

Commission. In conformance with Section 147-11(I)(2)(a), the Applicant had implemented in the
previously approved plan the alternate stormwater runoff calculation approach, utilizing a stone
storage trench with 1.5 gallons of stormwater capacity for every square foot of new impervious
area. However, the current plan no longer includes a storage trench and does noany
calculations. The Applicant shall provide appropriate stormwater measures to m
from the previously approved and constructed building addition, and address any mitigation
needed for the currently proposed plan. Appropriate stormwater calculations shall be provided
to verify conformance with code requirements.
3.The applicant has indicated that there will be an overall decrease in impervious area. However, it
is unclear from the information provided which areas are being considered pervious versus
impervious. According to Section 5.3.11 Sizing, permeable pavers that are subject to traffic
exposure cannot be treated as pervious. The Applicant shall provide clarification on the plans to
substantiate the impervious reduction. It is recommended that the Applicant provide specific
runoff and infiltration data from the manufacturer of the propos& crushed stone parking
systems in support of the application. Further review is required once submitted.
4.In accordance with NYSDEC SWDM Section 5.3.11 Feasibility/Limitations, permeable paver
systems shall be separated by at least 25 feet down gradient from structures. The permeable
crushed stone parking area at the eastern portion of the site is located directly adjacent to the
existing building. The Applicant shall consider alternative method of stormwater management or
waterproofing methods to protect the structure foundation.
5.Permeable paver systems are highly susceptible to clogging and may be subject to owner neglect.
It is recommended that the land owners be educated to ensure that proper maintenance and
winter operation activities are performed to allow the system to function as designed. The
Applicant shall also include specific long-term maintenance requirements on the plan. Further,
no sand should be used during winter snow maintenance operations
that sand cannot be used should be employed on site.
6.The Applicant does not depict any erosion and sediment controls on the Modified Site Plan. The
Applicant shall incorporate appropriate measures and shall providetails and construction
specifications in accordance with the NYS Standards and Specific
Control.
Conclusions and Recommendations
It is our opinion that the applicant should provide clarificatio
changes in subsequent plan submissions.
