Draft Resolution_PB Recommendation Town of Queensbury Community Development Office 742 Bay Road, Queensbury, NY 12804-5902 Town of Queensbury Planning Board Planning Board Recommendation to Zoning Board of Appeals Area Variance 26-2012 & Special Use Permit 9-2012 San Souci of Cleverdale Tax Map ID 226-12-1-43 The applicant has submitted applications for the following: Special Use Permit: Applicant proposes to modify approved site plan to include the removal of vegetation and the installation of “permeable” pavers on existing gravel parking spaces. Further, applicant seeks after the fact approval for the installation of a +/- 665 square foot patio with access deck and stairs to accommodate four tables as well as for the installation of a 6 foot tall, 112 foot long stockade fence along the south boundary. Modification to approved site plan and expansion of a nonconforming structure in a CEA requires Planning Board review and approval. Variances: Relief from side setback, expansion of a nonconforming structure, and fencing requirements. Planning Board shall provide a recommendation to the Zoning Board of Appeals. The Town of Queensbury Zoning Ordinance, per Section 179-9-070 J 2 b. requires the Planning Board to provide a written recommendation to the Zoning Board of Appeals for projects that require both Zoning Board of Appeals & Planning Board approval; and The Planning Board has briefly reviewed and discussed this application, the relief request in the variance application as well as the potential impacts of this project on the neighborhood and surrounding community, and found that: MOTION TO MAKE A RECOMMENDATION ON BEHALF OF THE PLANNING BOARD TO THE ZONING BOARD OF APPEALS FOR AREA VARIANCE NO. 26-2012 & SPECIAL USE PERMIT 9-2012 SAN SOUCI OF CLEVERDALE: Introduced by _________who moved its adoption, seconded by __________; and a)The Planning Board, based on a limited review, has not identified any significant adverse impacts that cannot be mitigated with current project proposal - OR b)The Planning Board, based on a limited review, has identified the following areas of concern: 1) Duly adopted this 15th day of May 2012 by the following vote: AYES: NOES: Cc: Bartlett Pontiff Stewart & Rhodes; Nace Engineering “Home of Natural Beauty- A Good Place to Live”
