No: Site Plan 05-2012 Dear Mr. Brown: The Chazen Companies (Chazen) received a submission package from for the above referenced project. Submitted information includes the following: A plan entitled, SWPPP  Erosion & Sediment Control, prepared by Nace Engineering, P.C., dated April 13, 2012; A draft Notice of Intent Form; and A Site Plan Application with supporting documentation. Your office has requested that we limit our review to the design of and sediment control items as it relates to compliance to local, Based on our review of the information provided, Chazen offers the following comments for the Towns consideration: Stormwater Management & Erosion and Sediment Control: 1.There are inconsistencies in the value listed for total area of within the information submitted. The NOI and plans provided indicate that site disturbance is 1.72 acres. However, the EAF and Cover Letter indicate a disturbance of 0.9 acres. Based on the drawings provided, it appears that the total disturbance is 1.72 acres and therefore the project is subject to NYSDEC Phase II Stormwater Regulations. As such, the Applicant shall revise the EAF and cover letter submitted to reflect the total site disturbance. 2.The Applicant shall provide clarification regarding the site acc constructed prior to, or as part of this application. The site plan application lists the access trail as an existing paved, gravel, or other hard surfaced area, which Town of Queensbury Site Plan 05-2012 DKC Holdings, Inc. May 10, 2012 Page 2 Acres). However, the access trail has been included in the overa depicted on the plan, which may imply that improvements and/or alterations are being proposed for this trail. If the project involves construction or reconstruction of the impervious access trail, then the project would fall under Appendix B, Table 2, of the SPDES General Permit GP-0-10-001, which requires preparation of a SWPPP that includes post-construction stormwater management practices. Alternatively, if there is no increase or reconstruction of impervious area, then the project would fall under Table 1, and a Basic SWPPP meeting the requirements of Part III.B. of GP-0-10-001 would be required. The applicant shall clarify these items and determine whether the project falls under Table 1 or Table 2 of the SPDES General (GP-0-10-001) and provide the appropriate documentation to the Town. 3.The Applicant has submitted an Erosion & Sediment Control Plan, Basic Stormwater Pollution Prevention Plan (SWPPP). However, the Applicant has not provided sufficient information to support permit eligibility. The Applicant shall revise the following: Part I.D.4 of the General Permit, prohibits discharges from cons adversely affect a listed or proposed to be listed, endangered ohreatened species or in its critical habitat. Documentation that this project complies w General Permit needs to be provided in order to support permit e information shall be included within the SWPPP with reference made to any supporting studies completed. In accordance with part III.A.6 of GP-0-10- 001, the plan shall also identify the specific elements of the S and subcontractor will be responsible for. Part III.B.1.c requires a description of the soils present at the site, including an identification of the Hydrologic Soil Group (HSG). Part III.B.1.j requires that the SWPPP include a description of measures that will be used to control litter, construction chemicals, and construction debris from becoming a pollutant source in the stormwater discha 4.In response to requirement J for Site Plan Approval, the applicant has indicated that the proposed project is designed to recharge all site runoff to groundwater with no discharge off site. The Applicant shall either provide appropriate calculations as required. 5.Additional silt fence shall be depicted on the plans to protect laden runoff. Proposed silt fence shall be installed parallel with contours to ensure proper function. The Applicant shall revise the plan appropriately. 6.In accordance with the NYS Standards and Specifications for Eroshe stabilized construction entrance detail shall be revised to indicate a minimum leng 7.The NOI indicates that temporary swales will be employed as part control measures for the site. However, no temporary swales have been indicated on the plan. If swales are proposed, then a construction detail shall be added t the NYS Standards and Specifications for Erosion and Sediment Control. Conclusions and Recommendations It is our opinion that the applicant should provide clarification for the above items and incorporate the changes in subsequent plan submissions.
