Dear Gregory Francis, Sr.: This letter serves as a "Notice of Violation - Order to Remedy" for the violations of your Site Plan Review approval SP 72-2014 and AV 85-2014. A notification from the Building and Codes Department that your open building permit has been expired and you have been notified on numerous occasions to renew the permit also triggered a status check of your two zoning permits (referenced above). The status check revealed you and your agent/contractor (Bill Oehler) have been notified on numerous occasions of the violations of your zoning permits, and have failed to rectify the violations (see copy of July 13, 2015 email attached). Specifically, on July 10, 2015, an inspection of your project revealed that your deck was constructed considerably larger than that proposed and approved, and the configuration of the deck/stairs is different from that proposed and approved resulting in the violations. You are hereby directed to apply for a Site Plan Review Modification for your project "as built" and for the additional relief required from the Zoning Board of Appeals by December 31, 2019. An "as -built" survey will be required for both applications to the Planning Board and Zoning Board of Appeals. Additionally, when you renew your building permit, updated construction plans may be required along with the "as built" survey. Failure to act as directed by this official order will result in an appearance ticket being issued to you for Queensbury Justice Court. This was the first time I was contacted regarding the project. I was informed the deck project was completed, and on Friday, July 10, 2015, l performed the required compliance inspections per the above referenced approvals. My inspection revealed the upper deck has been constructed considerably largerthan that approved (28' long vs. 22' approved), and the lower deck slightly larger than approved. Also, the layout of the steps are different from that approved. Please submit "as built" plans for the BP file or make the necessary changes so that the deck and steps are in compliance with your approvals. Should you desire to keep the deck "as built", additional relief from the zoning code requirements will be needed, and a modification to your approved site plan will be required.
