STAFF COMMENTS:
The applicant proposes to rehab an existing deteriorating concrete pad with a 136 sq. ft. wooden patio and 23
sq. ft. of access stairs. The plans show the existing concrete patio, the metal framing and the new decking to be
installed. The new decking area is to be accessed with a staircase that will be built over an existing set of
concrete steps. The applicant has included photos showing the concrete pad and existing concrete stairs. The
applicant has indicated there are no other changes to the site and they explained that removing the deck and
rebuild have caused greater disturbance than building over the top of the structure. The applicant has requested
waivers from stormwater, topography, landscaping, land use districts, lighting and traffic.

This applicaARY tion has been tabled at the Zoning Board as requested by the applicant. The Planning Board should
consider tabling the application to the April's meeting with submission of information due by the March
submission date as the Zoning Board has done.
The applicant has completed a site plan application for the reconstruction of a shoreline deck and stairs where
hard surfacing within 50 ft. of the shoreline requires planning board review and approval. The Board may
consider the request for waivers from stormwater, topography, landscaping, land use districts, lighting and
traffic.

The Zoning Board of Appeals of the Town of Queensbury has received an application from Marc D. &
Betty R. Fuchs for a variance from Section(s): 179-3-040 of the Zoning Code of The Town of Queensbury in
order to rehabilitate and stabilize existing deteriorated concrete patio and stairs along the shoreline.
Installation of a galvanized metal frame along with construction of a 136 sq.ft.wooden patio on top of
frame is proposed. Construction also includes a 23 sq.ft. wooden supporting staircase. Relief requested
from minimum shoreline setback requirements.
SEQR Type II-no further review required;
A public hearing was advertised and held on Wednesday, February 19, 2014 and left open.
