County of Warren, State of New York, bounded and described as follows: Commencing at a point on the easterly boundary of New York State Route 9, commonly known as Upper Glen Street; from thence running N 49' 14' E a distance of 372.47 feet to an iron pipe found; from thence running N 42' 22' W a distance of 172.10 feet to an iron pipe set; thence running S 89' 44' E a distance of 232.34 feet to an iron pipe set; thence running S 49' 01' 30" E a distance of 193.27' to an iron pipe set; thence running S 38. 26' W a distance 195.37 feet to an iron pipe set; thence running S 35' 23' W a distance of 94.76 feet to an iron pipe found; thence N 54. 37' W a distance of 45 feet to an iron rod found; thence S 47' 121W a distance of 270,31 feet to an iron rod aet in the easterly boundary of the said Upper Glen Street; from thence running N 42' 241W along the easterly boundary line of Upper Glen Street to the point or place of beginning, containing 2.86 Acres ±. Being a portion of the premises conveyed to the party of the first part by deed of William P. Canale dated January 2, 1987, and recorded in the Warren County Clerk's Office October 13, 1987, in Book 698 of Deeds at Page 196. Karen Helier Horodas, Jane Heller Marantz, Erica H. Fischer and Ruth Heller which mortgage was recorded in Warren County Cleric's Office, on the 8th day of January, 1987, in Book 467 of Mortgages at page 726, on which there is an unpaid principal•of Three Hundred Eleven Thousand One Hundred Twenty-one Dollars and 71/100ths ($311,121.71), with interest from August 20, 1988, at the rate of 9 percent per annum, which said mortgage debt the party of the second part.hereby assumes and agrees to pay, as part of the purchase price of the above described premises, and the party of the second part hereby executed and acknowledged this * Instrument for the purpose of complying with the provisions of General Obligations Law, section 5-705, The foregoing is not all or substantially all of the real property of the corporation. Together with the appurtenances and all the estate and rights of the party of the first part in and to said premises, To have and to hold the premises herein granted unto the party of the second part, her heirs and assigns forever. And the party of the first part covenants as follows; First, That the party of the second part shall quietly enjoy the said premises; Second, That the party of the first part will forever Warrant the title to said premises. Third, That, in Compliance with Sec. 13 of the Lien Law, the grantor will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose.
