Special Use permitWest Mountain Ilk West Mountain Ski Area 59 West Mountain Road Queensbury, NY 12804 May 31, 2022 West Mountain Ski Area/Apex Capital LLC located at 59 West Mountain Road in Queensbury, NY, is seeking a 5 Year Special Use Permit from the Town of Queensbury. The proposed permit would allow for 10 single day events and 8 multiday events outside the Ski Area's normal operating season (November to April). With approval from the Town of Queensbury and in accordance with Article 10-Special Use Permit, West Mountain would hold for community and family events including mountain biking events, outdoor concerts/festivals, endurance races, and additional outdoor recreational activities. In harmony with the Comprehensive Plan and West Mountain will use the property. West Mountain will act in accordance with the General Criteria, under Section 179-10-060. West Mountain can hold a maximum of 750 vehicles between the main parking lot off 59 West Mountain Road and the Northwest Parking lot located off Northwest Passage. West Mountain will have a staff dedicated to the clean-up of the property during and immediately after events, including West Mountain Road, in the case that a large event would result in litter near West Mountain Road. West Mountain would provide a security detail, portable restrooms, and hand washing stations for large events. West Mountain currently has a large fire pit behind the Main Lodge that has been inspected and approved for use by the Queensbury Fire Marshall; no other open fires will be permitted on West Mountain's property. We will honor the town's previously appointed curfew allowing no outdoor music during an outdoor concert event outside the hours of 8am-11pm. West Mountain will not act, in any way to harm the local environment, natural resources, or the economic stability, environmental integrity and community character of the Town and surrounding properties. These uses have been so designated because they are considered to be inherently challenging and potentially incompatible with surrounding land uses due to the nature, intensity, size or type of operation of the proposed use or due to its proposed location The Planning Board may impose conditions such as limitations on the hours of use, the intensity of the use, the use of structures and land, and any other condition reasonably related to the project that it deems necessary. The Planning Board may require the posting of financial security in order to ensure that improvements and or activities are carried out as related to the Special -use permit. There are three types of permits which may be granted by the Planning Board, they are permanent, temporary, or renewable. Please provide a response to each of the following items as it relates to your project as part of your application for a special use permit general criteria 179-10-060. The proposed use shall be in harmony with and promote the general purposes and intent of the Comprehensive Plan, and Chapter 179 Zoning and the health, welfare and safety of the Town and its residents. The proposed off-season use of West Mountain Facility as a venue for concertcraft/art show is considered consistent with the Comprehensive Plan concept as a tourism recreational activity and or part of the Town's economic development vitality. Please explain how your proposed project is compatible to the area. The proposed use shall be compatible with the character of neighborhood, the area, the zoning district and the community surrounding the location of the proposed use and will not unduly prohibit or discourage future planned growth in the area. Utilizing the site on a year-round basis will be compatible with the neighborhood by ensuring the off season venues are held to a minimum number of events and does not overshadow the 12rimM function of the facilit as a traditional snow sports facility. Please describe all activities relation to traffic including access, circulation and parking. The proposed use shall have safe and efficient access for pedestrians and vehicles and shall provide for appropriate off -road parking and loading areas. The interior circulation system must be adequate to provide safe accessibility to all parking spaces and ensure that adequate and safe integration of pedestrian and vehicular movement is provided. The site has an existing parking are that will be utilized for customer parking, vendor parking,staff promotion parking, and West Mountain staff parking There are more than 500 parking spaces available that is denoted on the site plan snap. Entrance and Exit locations are also denoted in the site plan map 250 Additional parking spaces may be provided via Northwest Base Area parking lot and connected via dirt road between base areas SPECIAL USE PERMIT SUPPLEMENAL APPLICATION (Contd) Please describe the Infrastructure and services on site that are to be used for the project. There shall be sufficient infrastructure and services, including utilities, public facilities and services, available for the proposed use or the project shall extend or provide infrastructure and services for the area where the proposed use is located. There shall also be facilities and services implemented by the applicant to appropriately control any potential nuisances from the operation of the use, such as control of litter or trash, loitering and crime prevention, and any other.features or aspects of the operation of the proposed use that may affect the public safety, health and general welfare. Portable sanitation units will be utilized on site and maintained through contract as needed The onsite bathrooms will also be used. Existing 1, ighting_at parking area entry, venue entry exterior building lights and indoor tent lights will be utilized. Hours of music if applicable is proposed from Sam to 11pm DOH and NYS Liquor License Agency will also be notified and appropriate permit will be completed Firework paperwork and associated permits will be completed by West Mountain and submitted to Fire Marshal Food Service to use West Mountain kitchen facility. West Mountain will utilize existing_ garbage containers on site Arrangements for emergency services for Fire and EMS will be made ahead of events Describe your current and proposed site conditions as they relate to the Environment and natural features of the property. The proposed use shall be compatible with and appropriately protect environmental and natural resources, including the environmental and physical suitability of the site for development, and the general landscaping, screening and buffering shall be in character with the surrounding areas, and the risk of fire, food or erosion and impacts such as emissions of electrical charges, dust, light, vibration or noise detrimental to the public health, safety and welfare shall be minimized to the maximum extent practicable. The site is an existing snow sports facility with multiple trails on the property and associated equipment with traditional winter sports i.e.,Skiing snowboarding and snow tubing The existing buildings and parking area will not be altered in anyway. The site will be used as is with the addition of non -permanent placement of a stage, vendor booths, sanitation units tents for beer, performance and food Describe all anticipated long-term effects associated with the project. The proposed use shall provide positive or beneficial effects on the long-term economic stability, environmental integrity and community character of the Town and surrounding properties, districts and uses. The purpose of holding off-season single day and multiday events will assist the financial stability of the primary function as a snow sports facility. The off-season events will also aid in promoting the area increase additional traveler/visitors to the area provide additional recreational opportunities to the existing residents of the area. Any event that attracts more than 5,000 people will follow requirements for a "massgathering" as specified in NYS Sanitary Code
