Page 1 of 2 Mrs. Chris Breda Mr. Mike Breda World Class Kid's 340 Aviation Road Queensbury, NY 12804 Dear Mr. and Mrs. Breda, On the afternoon of June 5, 2001, Dave Hatin, from the Town of Queensbury, Building Department, and myself, conducted a follow up inspection at World.Class Kids, to verify the fire separation between your space and the space adjoining the future gym. Kim pointed out that several items noted in my fire inspection had been corrected also. An explanation follows: 1. A two-hour fire separation does exist between the gym area and the adjoining space. 2. Fire stopping along this wall complies with code. 3. There is a safety glass label on the commercial front door of the gym. 4. The emergency light in the gym has been repaired. Several fire safety safeguards must be completed before the Town of Queensbury can issue a certificate of occupancy for the gym. 1 b. The supervised fire and smoke detection system must be extended into the hair dressing studio. . . v 2b. Additional smoke detectors must be installed in the,gym bathrooms, the gym electrical closet, and the gym storage closet which is enclosed. 3b. Install a horn strobe unit in the gym. 4b. Install an exit/emergency combo unit over the archway, with the sign face and the emergency lighting facing the gym. Both devices must be battery back up. 5b. If the second exit from the gym is to be relocated to the rear, the existing door must- be replaced with a 444inch door. As noted before; panic hardware is the only approved locking device allowed for this,door. All others locking devices must be removed, and no others can be installed. "HOME OF NATURAL BEAUTY . . . A GOOD PLACE TO LIVE" SETTLED 1763 Mrs. Chris Breda Mr. Mike Breda Page 2 of 2 Another option for you is to install an electronic panic device with a 15 second delayed egress function and an alarm. This device will sound an alarm when children push the crash bar, but the door will not immediately open. This device will allow staff up to 15 seconds to move the children away from the door. The crash bar must extend completely across the door. 6b. During our inspection yesterday, we noted that the electrical panel in the gym closet had been blocked with storage. State and national codes require 36" of clearance in front of electrical panels. Please relocate the stored items as necessary to maintain the required clearance. 7b. The roof top unit over the gym must be tied into the fire alarm HVAC shut down switch. Please note that several violations remain to exist, or have not been verified in the occupied portion of World Class Kids. lc. The dead bolt locking device must be removed from the exit door at the end of the hallway. 2c. Repair the exit light over the main entrance. You must remedy the items required for occupancy of the gym, and a re-inspection must be scheduled by you, before you can occupy the gym. Necessary repairs and modifications should be initiated by you as soon as possible. A follow-up inspection will automatically be scheduled in approximately two weeks to verify the correction of the regular fire inspection violations. This letter or a Certificate of Occupancy from the Town of Queensbury in no way relieves you from the requirements of.the Office of Children and Family Services. During my inspection, several violations were noted and several questions arose. I will clarify these issues for you now. The technical assistance division of the Department of State did confirm that two exits are required from the gym, because it's gross square footage exceeds 1000 square feet. The Department of State also confirmed that at least one exit from the gym must empty directly to the exterior, because.World Class Kids is in a mixed-use building. During our meeting yesterday, Chris expressed some concern for allowing the children to use the front exit door of the gym. A remedy to this would be to:relocate the exit sign to the single rear door; and to replace the existing hardware with "panic' type hardware. it is important to note that all exit doors in a daycare centermust be equipped with panic type hardware. No other locking device of any kind is allowed on the exit doors, in addition to, or instead of panic hardware. During my inspection, I noted that several exit doors had been retrofitted with additional locks. Any additional locks must be removed from all exit doors. The one exception to this is the main entrance, it is assumed that the main entrance will be unlocked when the.business is open, as it must be. If you are concerned about children leaving without your knowledge, I would suggest installing "door open" alarms or electromagnetic releases. During our meeting yesterday, Ms. Way, from the Office of Children and Family Services, asked for documentation confirming the use of safety glass in the doors and windows. I was unable to find any confirmation of this in our records; it is possible that you have kept the documentation in your files. "HOME OF NATURAL BEAUTY . . . A GOOD PLACE TO LIVE" SETTLED 1763 Mrs. Chris Breda Mr. Mike Breda Page 2 of 2 While reviewing your original construction permit, I located an inspection slip completed by Dave,Hatin on March 7, 2000. On that slip, the following instructions can be found related to "extending the day care into the Coffee Shop": "1. Move 2 hour fire separation 2. Extend Alarm System 3. Cover Kraft Faced Insulation 4. Install Exit and Emergency. Lighting" You may recall the New York State Uniform Fire Prevention and Building Code requires Day Care Centers, for children three years old and younger, to be completely enclosed in a two hour fire separation. During my inspection yesterday, it appears as though the two-hour separation has been breached by a doorway. Please contact the Queensbury Building Department immediately upon receiving this letter to confirm that a new two hour wall was constructed, between the day care center and the neighboring business, prior to breaching the wall that separated the day care centerr from the area now used as the gym. If this work has not been completed, the doorway must be closed off again to maintain the required fire separation until such time as the new fire separation is complete. A building permit must be applied for and a certificate of occupancy must be obtained before the gym area can be occupied. Any interior construction alterations also require a;building permit. Please note that any exit lights relocated or installed must be of the battery backup type. Please note that the emergency light in the gym is in need of repair. Please note that a blank is needed in the circuit breaker box. It is absolutely imperative that the necessary corrective measures be initiated immediately.
