Based on the review, it was determined that the area in question is a linear drainage ditch that extends from a culvert outfall (located on the O'Keefe parcel) and extends along the eastern boundary of the West property. The drainage conveys water from lands to the south of Bay Parkway, then flows north and ultimately into Lake George. Based on the existing conditions observed, the linear conveyance feature exhibits the characteristics (vegetation, soils, and hydrology) to be classified as Palustrine wetland. As a result, the extent of the wetland (within the West property only) was delineated and is now shown on the site plans for the project. Since the proposed project is not impacting or negatively effecting the wetland area in any way, the ACOE and APA have determined that no wetland disturbance permitting is required. However, due to the fact that the wetland appears to be federally regulated by the ACOE, it has been determined that the wetland is also regulated with respect to the Town of Queensbury Zoning Code and more specifically the shoreline setback. Therefore, the applicant is respectfully requesting shoreline setback variances for both the proposed home and four infiltration devices. The house is proposed to be located 10 feet from the existing wetland area (50 feet is required) and the infiltration devices are proposed from 52 feet to 74 feet from the wetland area (100 feet is required).
