To clarify all the issues,I will lay them out as I understand them and as.the Fire Marshal understands them,as they occurred on our meeting of May 30,2002 and most recently August 15th at two o'clock in the afternoon.' On May 30,2002,we reviewed this proposed building as a separate building with a connected walkway,under the old building code. There were some issues that were unresolved as of that meeting, and I had not heard back from you until I met you in_ the Convenient Mart in South Glens Falls on July 315t'when you advised me an that you were submitting the plans again under the new building code, d I advised you at that time that I was on vacation for a week and a half,-and that John or Joel would be extremely busy, and they may or may not be able to review t�e permit. On Monday August 12th,you contacted me'to schedule a meeting to review the permit for Boats By George. I advised you at the time I was unable to meet with you that day, Tuesday, or Wednesday as I already had meetings scheduled. I agreed to meet with you on August,15th at two o'clock,which we did. , At that time,you brought in a drawing very similar to the one that we had previously reviewed and we agreed to review that under the new building code at your request. This building was being treated as an addition to the existing building so that we would not get into building separation issues between the existing building and the new building. At that time,we did a review,the following items were left to be resolved by you at the end of that meeting. LYou were going to provide us with a statement on the plans that showed that natural ventilatio would be introduced into the inside atmosphere of the building at.5 cfin per square foot or better. /You were going to add additional emergency lights as discussed with the Fire Marshal on the plan. 2/ You were going to provide an area on the plan that showed a handicap parking space with a handicapped access aisle adjacent to it You were going to install smoke vents, as previously' shown on the plans, and those would have a manual activation switch somewhere in the area of the main entrance so they could be operated by the fire department. You were going to redo the energy calculations because as I stated to you, the ComChek program which has been given to you is the only way to show compliance with the new energy code: The structural loading re uirements would be added to the plans and stamped by Mr.Montgomery. "HOME OF NATURAL BEAUTY . . . A GOOD PLACE TO LIVE" SETTLED 1763 Also at the end of that meeting,we discussed two items which I was going to call the State on regarding this addition. My concern was,if we were treating this as an addition to the existing building, does that effect the existing building at all. The second question was, do you need to provide a handicap bathroom in the new addition. On August 16th at 8:30 a.m., I contacted State Codes Division and asked to speak to a representative. I was told at the time that none of them were available and someone would get back to me. At 2:15 that afternoon,Charlie Rush returned my call. However,I was not in the office to take his call. At 2:45 1 returned his call and was unable to get through to him. I finally contacted him at 3:15 and specifically told him of the project and the type of construction and my two concerns as I explained above. During that conversation,Nit. Rush pointed me to Chapter le, specifically K 905.2,under Accessibility. That Section says,and I quote,"Where an addition affects the accessibility to or involves an area primary function effecting the existing portion of the building, the addition and the existing portion of the building shall requirements of Section K 604.3 of this Appendix". Section K 604.3 states, "If an alteration affects the accessibility to or contains an area of primary function, the route to the primary function area shall be accessible. The accessible route to the primary function area shall include toilet facilities or drinking fountains serving an area of primary function." There are some exceptions that do not apply to this particular project. At 3:30 that afternoon, I contacted you, after talking to Mr. Rush, and explained the above to you. At that time,I explained to you that the above items that we had already previously discussed needed to be addressed on the plans, as well as you needed to show a handicap bathroom within the existing building or the new building to comply with the requirements of K 604.3,which is referenced by K 905.2. You stated the existing building had a handicapped bathroom,and I asked you to show it on the plans. At that time I told you if you wished you could call Mr.Rush at the State Codes Division to get a clarification from him. This was his interpretation of the Code,and therefore this is what I was looking for on the plans. You stated that you would get back to me with a set of plans to issue a building permit on Monday August 19,2002. August 19th came and I did not have any correspondence not conversations with you until I received your fax letter on my desk today,August 215t, that was faxed to my office at 9:43 p.m.on August 20th by you. As to your statement that every item on X= check sheet and my check sheet was in compliance, I would disagree with you totally,and the Fire Marshal would also disagree with you. Our direct conversations reflect that the items stated above were not compliant on the plans and we asked that they be revised and put on the plans. As far as your requesting a meeting with Joseph McGrath,we can certainly arrange that meeting. However, Mr.McGrath does not make regular visits to this office,and only comes to this office upon request. Typically,it would take two weeks to get Mr.McGrath to this office. If you are requesting a meeting,please let me know and I will certainly schedule that meeting with IS& McGrath to review this project as soon as possible. I see no reason for my State Code variances to this project. Revised plans that are in compliance, as we discussed on May 30,2002 and August 15,2002,will be sufficient to issue a permit. As to the statement in your last paragraph, I see no reason why Mr. Pensel cannot order his building. I have never told him or you that he could not order his building. The only thing I've told anyone in this office, which is the consistent policy of this office,is that we will not do any inspections regarding footings or any part of a building until such time as the building permit is issued. I believe the items above will not delay Mr. Pensel in ordering his building,nor should have in the past. Once again,if there is a misunderstanding to any of the above items or issues which I have confirmed with the Fire Marshal, based on out two previous reviews, please contact me to clarify these issues, otherwise I would ask as I did on Friday August 16th, that you submit plans and specifications according to the above items,to issue a permit. The permit would be contingent upon the following agreed upon'six (6)`items listed below being completed. This would leave the Section K.questian for future discussion but to.be resolved before an occupancy permit is issued. 1. Finial drawings for the steel building being sealed by a licensed NYS Professional Engineer and submitted to your office prior to manufacture. All new building design loads and reactions will be.included on these drawing based on the new code requirements. Mr. Montgomery Jr. P.E. will verify compliance in the field and certify. 2. A handicap parking area will be established at the North side of the proposed structure. This,will not require additional site"plan review. 3. One additional dual light emergency fixture will be added at the middle of the West wall per Mr.,Steven Smith, Fire Marshal's request: This was added to the Energy Compliance Certificate during the Thursday,meeting as a type B fixture. 4. Eliminate one 36" 10,900 cfmi. exhaust fart and intake louver which was-scheduled to be hooked up to the fire alarm system and to provide a manual-switch near the'North entry door so in the event of"a fire a squad member-could break the glass in the door and.turn the switch on. These units will be designed to include an economizer allowing for the code requirements for fresh air. 6. Mr. Montgomery Jr. P.E. has included in the building permit Energy Compliance Documents which exceed the new Federal Code. I believe this is the only criteria required with out getting into the shortcomings of.the Federal Code Check Program. In Mr. Montgomery's review of Section K and his interpretation of the new code, he believes that the recent articles in the Post Star and the enclosed copy of an article from the August 16 -22, 2002 issue of the Capital District Business Review are pretty explicit regarding the objective of the new code. "Promote Expansion with out sacrificing personal safety". I await an explanation as to how every item was in compliance on the check sheets, of both yours and Mr. Montgomery's Jr. P.E. and we end up in Section K, which was designed to assist the designer in complying only in the event the new building failed to comply with sections of the new code. In Chapter 3401, Existing Structures, the Scope and Compliance Alternatives, clearly are not applicable in this project. A simple undocumented request through a limited conversation obviously does not carry much weight in the real world. I am not questioning the conversation between you and Mr. Charles Rush, but ask that our regular representative from NYSDOS Code Enforcement Division, Mr. Joseph McGrath P.E. be asked to review the plans in the presents of Mr. Montgomery Jr. P.E., you and myself when he is next scheduled to visit the area. I believe we are talking less than 1 hr of time. This would not be a field variance. Again the most important step is to obtain the Building Permit so the structure can be ordered.
