APPLICATION: Subdivision 4-2012 / Area Variance 32-2012
APPLICANT: DKC Holdings
REQUESTED ACTION: Recommendation to the Zoning Board of Appeals concerning the relief
requested in the variance application as well as the potential impacts of
this project on the neighborhood and surrounding community
LOCATION: Luzerne Road

PARCEL HISTORY: AV 32-12 Road Frontage Pending
PROJECT DESCRIPTION: Subdivision: Applicant proposes subdivision of a 15.21 acre parcel into 3 lots of
3.52, 3.95, & 7.74 acres respectively. Subdivision of land requires Planning Board review and approval.
Variances: Road frontage relief for proposed lot 3. The Planning Board shall provide a recommendation to the
Zoning Board of Appeals.
STAFF COMMENTS: Highway Superintendent must comment on West Avenue extension in order for this
application to move forward to Preliminary Subdivision. The applicant’s request for 80 feet of relief from the
100 foot road frontage requirements appears to be in need of clarification as no road extension has been offered.
Staff has determined that 100 feet of relief is required with the absence of a road extension plan. The applicant
has requested waivers from the required plans: Landscaping, stormwater, grading, layout and lighting. The
Planning Board should discuss these waivers at this point in time and clarify for the applicant if these waivers
are to be granted.
Nature of Area Variance:
Parcel will require area variances as follows:
Road Frontage – Request for 80 feet of relief from the 100 foot road frontage requirement for the CLI as
per §179-3-040.
Additional comments:
1.Endangered Species and Historic Preservation inquires have been submitted to associated agencies, see
application materials. To date, sign-off has not been received.
