Description of Proposed Project:
Applicant proposes to install eleven aluminum awnings ranging in size from 8.6 sq. ft. to 64 sq. ft. with
apple graphics for Applebees Restaurant.
Relief Required:
Parcel will require sign variances as per §140-6 as follows:
1. Number of allowable wall signs – Request for eleven (11) additional wall signs above previous
approvals.
Criteria for considering a Sign Variance according to Chapter 267 of Town Law:
In making a determination, the board shall consider:
1.
Whether an undesirable change will be produced in the character of the neighborhood or a
detriment to nearby properties will be created by the granting of this area variance.
Minorto
moderateimpacts to the neighborhood may be anticipated as approval of additional signage could
potentially set a precedent.
2.
Whether the benefit sought by the applicant can be achieved by some method, feasible for the
applicant to pursue, other than an area variance.
Feasible alternatives would be to install a
compliant number of signs.
3.
Whether the requested area variance is substantial.
The request for eleven (11) additional wall
signs may be considered severe relative to the code.
4.
Whether the proposed variance will have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district.
Minor impacts on the physical or
environmental conditions in the neighborhood.
5.
Whether the alleged difficulty was self created
. The difficulty may be considered self-created.

Staff comments:
The applicant has previous approval for 3 wall signs (two Applebee’s wall signs and Car side to-go sign)
that are slated for removal and replacement in conjunction with this proposal; these sign do not require
relief. All relief for this particular proposal is for the eleven (11) awning signs the applicant wishes to
install.
