Mr. Comstock-The lot is behind the old mobile home remains... Councilman Monahan- You will be entering from the dirt Road? Mr. Comstock- Yes. Councilman Eisenhart- I spoke to a neighbor, who is very adverse, I suggested that he come tonight. Town Clerk- Mr. Ingraham called me...he seemed to be satisfied after speaking with me...he could not attend tonights meeting... Supervisor Walter- Asked if anyone wished to speak either for or against the application... no one spoke... Councilman Olson- I have not heard from anyone either way... (Discussion held in regard to the name of the street and if it was a town road...Mr. South, Highway Employee noted that the road was plowed...Mr. Flaherty stated that it was a Town Highway.) Councilman Eisenhart- Will you be receiving Town Water? Mr. Comstock-Yes. Supervisor Walter- Asked if there was further discussion...Hearing none the Public Hearing was closed 7:37 P.M. PUBLIC HEARING Regarding the Establishment of the Mountainview Water District Hearing Opened 7:37 P.M. Notice Shown Supervisor Walter- Introduced Mr. Scudder, the engineer on the Project... Mr. Scudder-(maps used) Described the boundary of the Water Distict...Noted that the main transmission line runs down West Mountain Road and we will tap into that main, at this point, we will supply water to Stewart Road, Baker Road, Little Road and Sawn Road and it has been tapped to supply water on Pinewood Hollow Road. This is a small district, the Town has received several petitions requesting water in this area. Councilman Eisenhart-Why are the mains already in the Pinewood Road area? Mr. Scudder-Because the new subdivision regulations require that the developer place the lines... Councilman Eisenhart-Is there water in them? Mr. Scudder-I believe so... Mr. South-Did the town bear the expense of the line down West Mountain Road? Supervisor Walter- The Town is continuing to place a line down West Mountain Road for a tie in. Basically when we did not have any transmission lines along the West Mountain Fbad, if there was any kind of a problem with the water in another section of Town, we would be out of water. We are trying to run the main so if there is a water main break in the other half of town, we can supply water to other —' sections. We are currently laying mains as we can to make a tie in... Mr. Scudder- The cost estimate is $26,300.00 that involves ductile iron pipe with appurtenances and fire hydrants..work to be done by the water department... Mr. South- You have listed four dressors, where are they going? Mr. Scudder- This is an estimate, they are not going anywhere, we may not need them... Supervisor Walter- In establishing a water district we have to go out and have an Engineer stamp the plans and come up with an estimate of the expenses. What we will do in establishing the water district is to send these dollar amounts down to the Department of Audit and Control, they will come back and say whether or not the district is within the means of the people that are living in the area and whether we can create the district. The district cannot go over the dollars that we are talking to you tonight, we cannot spend within that district more dollars than $26,300.00, we can spend less. We are talking tonight about the worst possible case, so the dollars, we are talking about in the average household, you will know that you are not going to pay more than that. There is a very good chance, like in the creation of the Broadacres Water District, at the public hearing people were told they would pay something like $14.51 a thousand, when it actually come in we were paying approximately $12.00. We are telling you the worst, it cannot be more or we would have to go back to you people to see if you wated to do it. What we can give you now is our estimate of what it would cost and what we feel is going to be needed. Town Counsel, Mathias-Revied the procedure for establishing a district... Mr. Merlow-Questioned what would happen if the residents of West Mountain or Land O' Pines did not want to be in the water district? Mr. Flaherty-Water Supt.-The residents of Land O'Pines Water District cannot vote on this district...The only people who can vote are those who are in the district, these people are getting water now, but they are also paying a surcharge equal to what the tax in the Queensbury Water District, some of the people are hooked up to City Water are paying double the City rate. Regarding the economics of it, they will be better off to go with the new district... Mr. M erlo w-Questioned if the residents that have wells will like being taxed more to allow those of us who need the water to have a district? Councilman Olson-It only takes a small percentage of the people in a district to force a vote but it takes a majority to turn it down. Mr. South-Questioned how much is the surcharge and what is the estimate of cost on $1,000.00 assessment for this proposed district? Mr. Scudder-Illustriation=l0% interest retiring in 10 years, 1st. year cost $7.17 per thousand... --�' Supervisor Walter-The 1st. year costs would be $7.17, current Qsby. is $7.48 per thousand in a district such as this for the most part it is a descinding rate, unless financing charges go higher than 10%. Mr. Flaherty-Water Supt.-Those paying surcharge are paying at the Queensbury rate... Mr. Scudder-Mr. South have you firgured out what you would be paying? Whilt is your assessment? 213 you are talking about $60.00, to retire the debt for the capital costs of construction on top of that you have your water usage tax, and a one time charge for hookup. Mr. Merlow- The cost is immaterial, we would like the water... Unknown- The water main on the corner of Stewart and Baker Road,why is it extended across the road and not like at the corner of Sawn Road? (Fire Hydrant) Mr. Scudder- It was placed for discharge purposes ...noted that at the time they are working on the system it may be changed as to the placement of the hydrant... Mr. Flaherty-Water Supt.- Noted that it was hoped to have a standard feed for the lot... Unknown- Do you have plans to repave the road after the lines are placed? Supervisor Walter- Has it been paved in the last few years? Mr. South- That road was paved when it was first put in 18 years ago. Unknown- I know they pay a double rate but the pressure is terrible... Supervisor Walter- The Health Dept. frowns on untreated water, at that point that is exactly what it is... Mr. Flaherty- Water Supt.- Noted that in the past if you hooked up to the City line you signed an agreement that you would provide your own chlorination... Mr. Scudder- How much pressure do you have in that area? Mr. South- Somedays you have good pressure some days you have none. Unknown- At the end of Stewart Road, it takes 45-60 min. to fill a washing machine... Unknown- Do you have any idea when we could expect to have water? Supervisor Walter-Hopefully this fall... Mr. Flaherty-Water Supt.- That is a small project, once we have approvals...late October if lucky... Unknown- If we run out of water before then, after the district has been approved... Supervisor Walter- If you have any kind of an emergency situation you should call the Town Office or the Water Dept. and we will do our best to help you out in an emergency. RESOLUTIONS RESOLUTION TO APPROVE MINUTES RESOLUTION NO. 187, Introduced by Dr. Charles Eisenhart, who moved for its adoption, seconded by Mrs. Betty Monahan: RESOLVED, that the Town Board minutes of July 24th and 31st., 1984 be and hereby are approved. Mr. Barber has stated that he will be building a residence at this location... Councilman Monahan- Questioned that the driveway looked dangerous... Mr. Barber- Noted that all the residents on 149 have the same problem, he would be placing a "U" driveway to help with the problem... ' RESOLUTION TO AUTHORIZE TEMPORARY PERMIT FOR MOBILE HOME RESOLUTION NO. 188, Introduced by Dr. Charles Eisenhart, who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, Michael & Martha Barber have made application in accordance with paragraph 2 (B) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside of a duly licensed mobile home court at property situated on Route 149, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to authorize the issuance of the permit requested by said application, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, temporary permission is hereby given to Michael & Martha Barber of Pyramid Pines Saratoga, N.Y. to locate a mobile home outside of a licensed mobile home court for a period of one year at property situated at Route 149, Town of Queensbury, and that the Building Inspector is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. Duly adopted by the following vote: Ayes: Mr. Olson, Mrs. Monahan, Mrs. Walter Noes: Dr. Eisenhart Absent: Mr. Morrell RESOLUTION TO SET PUBLIC HEARING REGARDING COLONIAL CABLEVISION, INC, RATES RESOLUTION NO. 190, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, Colonial Cablevision, Inc•, has been franchised by the Town of Queensbury to install and operate a community -t.Aevision antenna system in the Town of Queensbury which said franchise provided for a guarantee of installation charges and rates to customers, and 215 WHEREAS, the franchise has notified said Town that prevailing economic conditions impair the continuance of such service at the guaranteed charges and rates prescribed and have requested an opportunity to be heard in respect thereof, and WHEREAS, Town Law, Section 100 requires a public hearing on amendments of ordinances, rules and regulations, NOW, THEREFORE BE IT RESOLVED, that a public hearing on the proposed change of guaranteed rates and charges of Colonial Cablevision Inc. be held Tuesday, August 28, 1984 at 7:30 P.M. and that the Town Clerk will give notice of such hearing by publication thereof in the official town newspaper once at least 10 days prior to the date specified for such hearing, specifying the time when and the place where such hearing will be held and in general terms describing the proposed change. Public Hearing to consider the amendments of the contract between Colonial Cablevision, Inc. and the Town of Queensbury in respect to increased monthly rates, increased connection and reconnection charges and increase in rates for additional TV Hookups, to customers in the Town of Queensbury. Sunset Avenue, and WHEREAS, this Town Board has conducted a public hearing in connection with -- said application and has heard all persons desiring to be heard in favor of or against said application, and WHEREAS, it is hereby determined that the facts presented in said application and at said public hearing are sufficient to authorize the issuance of the permit requested by said application, NOW, THEREFORE BE IT RESOLVED, that pursuant to the provisions of the above mentioned ordinance, permission is hereby given to David & Bonnie Comstock to locate a mobile home at property situated at W. Sunset Avenue and that the Building Inspector is hereby authorized and directed to issue such permit in accordance with the terms and conditions of said ordinance. RESOLUTION MAKING DETERMINATION OF NO SIGNIFICANT ENVIRONMENTAL IMPACT OF PROPOSED ESTABLISHMENT OF THE MOUNTAINVIEW WATER DISTRICT RESOLUTION NO. 192 , Introduced by Mrs. Frances Walter , who moved for its adoption, seconded by Mrs. Betty Monahan: WHEREAS, the Town Board of the Town of Queensbury, Warren County, New York has heretofore duly caused a general map, plan and report to be prepared and filed in the Office of the Town Clerk of the said Town in relation to the establishment of a proposed water district in said Town, to be known as the Mountainview Water District; and 216 WHEREAS, the establishment of the proposed water district and the construction of the improvements proposed therefor (hereinafter "The Project") constitute an action under the New York State Environmental Quality Review Act (hereinafter "SEAR"); and WHEREAS, under the implementing regulations set forth in 6 NYCRR Part 617, the Project is an unlisted action; and WHEREAS, the Town Board has caused to be prepared a Short Environmental Assessment Form pertaining to the project; and WHEREAS, the Town Board has considered the general map, plan and report along with the Short Environmental Assessment Form and all evidence given at a public hearing concerning the proposed establishment of said district; and WHEREAS, it appears that no significant environmental impact would result from the establishment of the water district or the construction of the improvements proposed therefor, NOW, THEREFORE BE IT RESOLVED, that it be hereby determined that the establishment of the Mountainview Water District and the construction of the improvements proposed therefor will have no significant environmental impact under SEAR. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mrs. Monahan, Mrs. Walter Noes: None Absent: Mr. Morrell RESOLUTION APPROVING THE ESTABLISHMENT OF A WATER DISTRICT IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, TO BE KNOWN AS THE MOUNTAINVIEW WATER DISTRICT, AND FURTHER APPROVING THE CONSTRUCTION OF THE IMPROVEMENTS PROPOSED THEREFOR RESOLUTION NO. 194, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, the Town Board of the Town of Queensbury, Warren County, New York has heretofore duly caused a general map, plan and report to be prepared and filed in the Office of the Town Clerk of said Town in relation to the establishment of a proposed water district in said Town, to be known as the Mountainview Water District. WHEREAS, an order was duly adopted by said Town Board on July 10, 1984 reciting a description of the boundaries of said proposed district, the improvements proposed, the maximum amount proposed to be expended for said improvements, the proposed method of financing to be employed, the fact that said map and plan were on file in the Town Clerk's Office for public inspection, and specifying the 14th day of August, 1984 at 7:30 o'clock p.m., prevailing time, at the Queensbury Town Office Building, Bay & Haviland Roads, in said Town, as the time when and the place where said Town Board would meet for the purpose of holding a public hearing to hear all persons interested in the subject thereof concerning the same; and WHEREAS, such order was duly published and posted in the manner and within the time prescribed by Section 209-d of the Town Law and proof of said publication and posting has been duly presented to said Town Board; and WHEREAS, said public hearing was duly held at the time and place set forth in said order, as aforesaid, at which all persons desiring to be heard were duly heard; and WHEREAS, following said public hearing, and based upon the evidence given thereat, said Town Board duly adopted a resolution determining in the affirmative all of the questions set forth in Subdivision 1 of Section 209-e of the Town Law; and WHEREAS, it is now desired to adopt a further resolution pursuant to Subdivision 3 of Section 209-e of the Town Law, approving the establishment of said district and the construction of the improvements proposed therefore; NOW, THEREFORE BE IT RESOLVED, by the Town Board of the Town of Queensbury, Warren County, New York, as follows: SECTION 1. The establishment of a water district in the Town of Queensbury, Warren County, New York to be known as the Mountainview Water District, to be bounded and described as hereinafter set forth, and the construction of a water system to serve said district, including the acquisition of land or rights in land, and original furnishings, equipment, machinery or apparatus necessary in connection therewith at a maximum estimated cost of Twenty-Six Thousand Three Hundred ($26,300.00) Dollars is hereby approved and authorized. The method of financing the cost of said improvement shall be by the issuance of not more than Twenty-Six Thousand Three Hundred ($26,300.00) Dollars in serial bonds of said Town, maturing in annual installments over a period not exceeding thirty (30) years, payable in the first instance from a levy on the taxable real property in said water district which the Town Board of said Town shall determine and specify to be especially benefited thereby in the manner prescribed by Subdivision 2 of Section 202 of Town Law. SECTION 2. Said water district shall be bounded and described as is set forth in Schedule "A" annexed hereto and made a part hereof. 218 SECTION 3. Within ten days after the date that the adoption of this resolution becomes effective, the Town Clerk of said Town is hereby directed to file a certified copy of this resolution, in duplicate, in the Office of the State Department of Audit and Control, in Albany, New York, together with an application, in duplicate, for permission to establish the aforesaid water district, in the manner required by the provisions of Subdivision 3 of Section 209-f of the Town Law. SECTION 4.. This resolution is subject to a permissive referendum as provided by Section 209-e of the Town Law. RESOLUTION OF SORROW RESOLUTION NO. 195, Introduced by the Entire Town Board WHEREAS Mr. Douglas Luke had served as a member of the —� g Queensbury Conserservation Advisory Counsel, and WHEREAS, Mr. Luke devoted his time and efforts with enthusiasm and dedication to promote the quality of our environment in Queensbury, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury and the people of Queensbury were saddened to learn of the untimely passing of Mr. Douglas Luke and be it further ?9 RESOLVED, that the Town Board of the Town of Queensbury, on behalf of the people 1 of the Town does hereby express their deep sorrow on the death of their friend, Mr. Douglas Luke and does express to his wife and family their heartfelt sympathy at this difficult time. RESOLUTION TO AUTHORIZE PUBLIC HEARING RESOLUTION NO. 196 , Introduced by Mrs. Frances Walter who moved for its adoption, seconded by Mrs. Betty Monahan: WHEREAS, Ormen and Claudia Gilliland have made application in accordance with paragraph 2 (c) Section 4, of an ordinance of the Town of Queensbury entitled ORDINANCE FOR THE REGULATION OF MOBILE HOMES AND MOBILE HOME COURTS IN THE TOWN OF QUEENSBURY, WARREN COUNTY, NEW YORK, to locate a mobile home outside at property situated at Twin Channel road, and WHEREAS, it is hereby determined that said application complies with the requirements of said ordinance, and WHEREAS, it is hereby determined that the facts presented in said application are sufficient to justify further consideration by this board, therefore be it RESOLVED, that pursuant to the provisions of the above mentioned ordinance, the Town Board shall conduct a public hearing on said application on August 28, 1984 , at 7:30P.M. in the Queensbury Town Office Building, Bay Road, and that the Town Clerk is hereby authorized and directed to give proper notice of said public hearing in accordance with the provisions of said ordinance. Councilman Eisenhart- I would prefer to leave it the way it is... Unknown- Asked if the residents in the area have any recourse in this matter...asked what the 50' Buffer Zone meant? Supervisor Walter- Businesses that are already in operation are probably grandfathered, but new businesses that go in need to have 50' buffer zone... 220 At this time the Town Board will take no action on the rezoning request... Councilman Monahan- Asked if the residents had any input into the Planning Meeting? Unknown- No, I found out what happened after the meeting... Supervisor Walter- I would suggest that you appear before the Planning Board, I will speak with the Chairman about this...I will ask Mr. Roberts to put you on the agenda... Unknown- Asked what a sign on the street saying 2 Ton Limit except for local deliveries...meant? Mr. Naylor-Highway Supt.-Just what it means, unless it is milk, bread, fuel trucks, local deliveries are exempt... Unknown- Graders, Backhoes are over two tons? Mr. Naylor- Yes... Unknown- Who enforces these laws? Mr. Naylor-Highway Supt.-The Sheriff's Dept. Unknown- I understand that the Town has a twenty foot right of way onto your property... twenty feet back from the center of the road? Mr. Naylor-Highway Supt.-It depends if it is a deeded highway or a road by use...by use it would be 49% feet wide, if it is deeded 20' wide that is all we own...normal Town Roads are 50' wide, 25' from the center of the road... Unknown- Does a private citizen have the right to use the right of way? Mr. Naylor- yes... Unknown- Questioned if she was paying taxes on this property... Twin Channel Park Councilman Eisenhart- Questioned the location of Twin Channel Park vs Twin Channel Road? Mr. Holt-It is the road that goes toward the river, there are three residences on the road... Councilman Eisenhart-Are you asking for a one year permit or permanent? Mr. Holt- Permanent... Supervisor Walter- There is no stated hardship on this application, questioned if Mr. Holt would review the application and state such in writing... Mr. Holt- Took back the application to revise it...noted that there has been a mobile home on this lot in the past...removed approximately one and a half years ago... Supervisor Walter- We will request that Mr. Holt revise his application and at such time as this is completed, we will decide if a public hearing will be set... -Ltr. Supervisor Walter, from the Federal Emergency Management Agency-we passed a local law regarding the Flood Plains Management Regulations and this is a letter from the agency indicating that we have been assured participation in the program, we have met their regulations through that local law -Ltr. Supervisor Walter- APA A Meeting held 7-31-84, we asked for $8,000.00 to defray costs in dealing with local planning and be received $6,000.00 REPORTS -Town Clerk-Month of July 1984 on file -Building & Zoning-Month of July 1984 on file 221 OPEN FORUM Discussion held in regard to the acceptance of new roads...Mr. Carusone was present.. stated that he will have a road ready for acceptance before the next meeting... Supervisor Walter-I did indicate to Mr. Carusone, that I did not myself understand why the Board needed two weeks to approve a road, that fact that if all the completed information was brought to the Board, they did not need two weeks...we would like at least one week...I indicated to Mr. Carusone, that I would talk to Mr. Flaherty and Mr. Naylor and our Attorney saying that once the road has been completed Mr. Naylor, if you would drop me a letter right away instead of being part of an 'agenda, if they get, all the deed information to the attorney and if it is ok and the Water ]dept. letter of approval, once all items are collected the Board will look at it...then after the Board has looked at it, it can be put on the agenda for the next meeting... Mr. Carusone- I have no objections to that at all... Supervisor Walter- Asked if there was anyone else to speak at open forum-closed... Mr. Holt has revised his mobile home application and it is now before the Board...
