1.1 1.1 WASTEWATER\Extension of Time to Complete Septic Alteration&Escrow Deposit Per Property Transfer Law-SeanChant—22 North Lane—8-22-2022 RESOLUTION GRANTING SEAN CHANT AN EXTENSION OF TIME TO COMPLETE WASTEWATER SYSTEM ALTERATIONS ON PROPERTY LOCATED AT 22 NORTH LANE, QUEENSBURY RESOLUTION NO.: ,2022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, by Resolution No. 380,2018, the Queensbury Town Board adopted Local Law 2 of 2018 entitled "Septic Inspection Upon Property Transfer" which is set forth at Queensbury Town Code Chapter 137 (Chapter 137), and WHEREAS, by Resolution No.: 176,2019,the Town Board adopted Local Law 5 of 2019 and by Resolution No. 47,2020, adopted Local Law 1 of 2020 to make additional minor modifications to Chapter 137, and WHEREAS, Chapter 137 requires inspection of Onsite Wastewater Treatment Systems (OWTS) prior to the sale of certain real property and provides that a $2,000 escrow deposit will be forfeited to the Town in the event that completion of a wastewater treatment system meeting all standards is not completed within the time provided as established by Chapter 137, and WHEREAS, by letter dated August 10, 2022, Sean Chant (Applicant) has advised that he will be unable to obtain a variance from the Town Board serving as the Town's Local Board of Health necessary for the completion of the installation/construction of a new wastewater treatment system on his property located at 22 North Lane in the Town of Queensbury before September lst 2022 and therefore, the Applicant has requested that the Town Board grant him additional time or until December 15d', 2022 to obtain the variance and complete such work and to extend the date on which the $2,000 escrow deposit he previously deposited with the Town shall be automatically forfeited to the Town, and WHEREAS, the Acting Director of Building and Codes Enforcement has recommended Town Board approval of this requested extension, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board, as the Town's Local Board of Health, hereby authorizes and grants Sean Chant additional time or until December 15d', 2022 to obtain a certificate of compliance from the Town's Building and Codes Enforcement Office as set forth in Chapter 137 for installation/completion of a new wastewater treatment system located on his property at 22 North Lane, Queensbury and to extend the date on which the $2,000 escrow deposit shall be automatically forfeited to the Town until such date of December 15d', 2022 as delineated in this Resolution and authorizes and directs the Town Supervisor and/or Acting Director of Building and Codes Enforcement to and take any and all actions necessary to effectuate all terms of this Resolution. SLIperViSOr B'J Town Of QUeensbUry 742 Bay Road Queensbury, NY 12804 Re: Time Extension Onsite Septic System Construction 22 North Lane,Assembly Point I recently purchased the property at 22 North Lane on Assembly Point. Unfortunately I was unaware that the existing onsite septic system was required to be replaced as required by a Settlement Agreement between the previous owner and APA dated March 18, 2013. After I purchased the property I had a well drilled and located it as far away from the existing onsite septic system as was practical. After the well was drilled and I was taking steps to have my septic system checked for proper operation I became aware of the old requirement for a new septic system that was never completed. In addition, it has now fallen on my shoulders to have this new very costly "Peat Moss System" constructed on my site. I recently met with my engineer and the building department to discuss the plans and procedures to get started on the new septic system and I was informed that I would need to act a variance for the new system as it cannot meet the required separation from the new well that I had drilled. As such I will not meet the deadline that I had for the $2000 escrow for providing the Town information indicating that I have a working system. At this time I would like to request an extension to allow us tirne to get a variance for the lack of separation from my well and then to get the construction completed. As the system is not a basic stone and pipe type it will take a little longer to get constructed so I would request and extension to December 15"' of this year. I have talked with a contractor who tells me that he should be able to complete the work by that time. We will be submitting a variance request by the end of the week. We needed to change the location of 4-- the proposed system in order to get the maximum separation between the well and the septic system and have got that cleared by APA so now we can move forward as soon as the variance is granted.
