3.06 3.6 AGREEMENTS\CSEA—Memorandum Agreement for August 22 2022—December 312024—8-22-2022 RESOLUTION APPROVING MEMORANDUM OF AGREEMENT BETWEEN TOWN OF QUEENSBURY AND TOWN OF QUEENSBURY UNIT OF CIVIL SERVICE EMPLOYEES ASSOCIATION, INC. (CSEA) AND AUTHORIZING NEW COLLECTIVE BARGAINING AGREEMENT RESOLUTION NO.: ,2022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Town of Queensbury (Town)previously entered into a Collective Bargaining Agreement with the Town of Queensbury Unit of the Civil Service Employees Association, Inc. (CSEA)regarding employment of the employees in the Town's CSEA Bargaining Unit, and WHEREAS, the Town and the CSEA negotiated terms and have come to an agreement concerning a new Collective Bargaining Agreement to be executed between the parties, and WHEREAS, the Town and CSEA signed a Memorandum of Agreement on August 2, 2022, and WHEREAS, the Memorandum of Agreement has been agreed to by majority vote of the CSEA membership on or about August 10, 2022, NOW, THEREFORE, BE IT RESOLVED, that the Queensbury Town Board hereby approves, affirms and ratifies the terms of the August 2, 2022 Memorandum of Agreement between the Town of Queensbury and Town of Queensbury Unit of the Civil Service Employees Association, Inc., and BE IT FURTHER, RESOLVED, that the Town Board hereby authorizes and directs the Town Supervisor to execute a new Collective Bargaining Agreement for the period from August 22, 2022—December 31, 2024, such new Collective Bargaining Agreement to incorporate the terms of the August 2, 2022 Memorandum of Agreement, and BE IT FURTHER, RESOLVED, that to the extent that the terms of the Collective Bargaining Agreement are being amended by such Memorandum of Agreement and are different than as set forth in previous Resolutions of the Town Board, this Resolution shall supersede the Town Board's earlier actions with regard to employees covered by the Collective Bargaining Agreement, and BE IT FURTHER, RESOLVED, that the Town Board further authorizes and directs the Town Supervisor and/or Town Budget Officer to take such other and further action necessary to effectuate the terms of this Resolution. Duly adopted this 22nd day of August, 2022,by the following vote: AYES NOES ABSENT: 2 c MEMORANDUM OF AGREEMENT THIS MEMORANDUM OF AGREEMENT is made on August 2,2022 by and between the TOWN OF QUEENSBURY("Town") and the CIVIL SERVICE EMPLOYEES ASSOCIATION, INC., LOCAL 1000,AFSCME, AFL-CIO,TOWN OF QUEENSBURY UNIT#900700,WARREN COUNTY LOCAL 857 ("CSEA")as follows: WHEREAS,the Town and CSEA have entered into a Collective Bargaining Agreement for the period from January 1,2020 through December 31, 2023;and WHEREAS,the Town and CSEA desire to extend the Collective Bargaining Agreement through December 31, 2024 in accordance with the terms of this Memorandum of Agreement;and WHEREAS,the Town and CSEA have completed collective bargaining in connection with the extension of the Collective Bargaining Agreement through December 31,2024; NOW,THEREFORE,the parties hereto agree as follows: 1. Effective August 22,2022,the base wage rates for the bargaining unit employees shall be increased by$2.75 per hour,and the wage rates in Schedule A attached to the Collective Bargaining Agreement shall be increased by$2.75 per hour;effective January 1, 2023,the base wage rates of the. bargaining unit employees shall be increased by 5% in lieu of the increase previously negotiated by the parties,and the wage rates in Schedule A attached to the Collective Bargaining Agreement shall be increased by 5%in lieu of the increase previously negotiated by the parties;and effective January 1, 2024,the base wage rate of the bargaining unit employees shall be increased by 5%,and the wage rates in Schedule A attached to the Collective Bargaining Agreement shall be increased by 5%. 2. In Article II of the Collective Bargaining Agreement,the reference to"Agency Shop"shall be deleted from the title of the Article,which will now be labeled "Payroll Deductions." 3. In Section 1 of Article IV of the Collective Bargaining Agreement,the reference to "12:30 p.m."shall be corrected to"12:30 a.m." in connection with the end of the second shift for the "Building Maintenance (Town-General)." 4. In Section 2(a)of Article VII,the following shall be added at the end of the paragraph: "Employees hired on or after September 1, 2022 shall contribute 15%of the premium,or the percentage paid by employees hired before January 1,2014, whichever is higher." 5. The duration of the Collective Bargaining Agreement shall be extended to December 31, 2024. ~~' 6, All other provisions nf the current Collective Bargaining Agreement shall remain infull force and effect.
