Supervisor Walter-Anyone interested in the application either for or against should now speak... Mrs. Joyce Eggleston-Presented the Town Board with a petition..."We the undersigned do hereby oppose the application of Ormen and Claudia Gilliland to place a mobile home on property situated on Twin Channel Road, Town of Queensbury" Signed by 12 people...(on file) Mr. David Cook-Twin Channel Road-I am opposed and have signed the petition against the placement of the mobile home. I do not feel that Twin Channel Road is the place for mobile homes. Speaking from experience, I had a mobile home personally on the property, I intended to have it there only two or three years until I was able to build a house but I had one eighteen years, we tried to keep up the grounds, but a mobile home devaluates the property. Supervisor Walter- You had a mobile home on Twin Channel Road? Mr. Cook- I had a mobile until the past three years, it was placed there before any ordinances. I know the neighbors put up with my mobile home because they knew me and it was to be a temporary. If given the choice they would never had allowed it... Mrs. Joyce Eggleston- We have a new home within 300' of the proposed trailer site and we have a hefty tax base on our property and we pay considerable taxes. The placement of a mobile home will devalue our property, we would like you to look at it from that view. We would like you to look out for our interests.... Mr. Roland Bardin Jr.-I own a lot of property in this area, building lots etc. I am interested in keeping the value up, I am opposed to this application. Mr. Wm. L. Cook-I am opposed to a trailer in there, the value of my property will be reduced—lived within 500' of the area... a Mr. William Cook- I have been a resident of the area for 38 years and to my knowledge both roads are called Twin Channel Road... Mrs. Cook- Noted that years ago the area was called Twin Channel Park, it was changed for mailing purposes to Twin Channel Road... Councilman Eisenhart- I went out to the area, I spoke to a number of people and 223 looked the place over and without exception there was opposition expressed by the people to whom I talked. As far as I can tell there are no other mobile homes in the area, I do not know how many homes there are, but the people I talked to are opposed, I suggested that they come to the meeting tonight. There is in back of the Gilliland site a small house and behind that there is another house that was a mobile home and has been built on to and he objected to the mobile home. He stated that some time ago he wanted to place a mobile home on his land and was turned down by the Town Board. One neighbor said be would not object to a mobile home if it were a temporary situation while a home was being built. He did not want a permanent mobile home in the area. Councilman Morrell- In recent years we have granted two mobile homes, temporary ones on Big Boom Road by Arberger Drive and now there are two nice houses there. Councilman Olson- We have in the past turned down mobile homes in that area, I have looked at the area, I did not speak to any residents... Councilman Monahan- I went to the site and talked with some of the residents that are here tonight—they are upgrading the area... Supervisor Walter- Asked for further comments, hearing none the Public Hearing was closed...7:51 P.M. PUBLIC HEARING Mobile Home Application of Robert G. Holt of 3 Briwood Circle, to place a 1981 Winchester Mobile Home on Twin Channel Park, owner of property Edward Fisher NOTICE SHOWN Hearing Opened 7:51 P.M. Supervisor Walter- Asked for comments from the Public, either for or against the application... Mrs. Joyce Eggleston-Presented the Town Board with a petition signed by fifteen people opposing the placement of a mobile home, presented also a map of the area (on file). We have done so much to keep our homes nice and we would like the Board to consider that....noted it is a bad location in the winter with the children and school busses...The property is not owned by Mr. Holt, so he will not be a taxpayer like the rest of the residents of the area. He would rent, so it would not be any different then if he was in a trailer park... Supervisor Walter- His application says he has an option to buy. The Town Board in the past has not granted any kind of a permit to those who do not own the property. Mr. David Cook-Twin Channel Road-The proposed site for this mobile home is the exact site where my mobile home was, wish that my comments relating to the other mobile... Supervisor Walter- This is a different public hearing... Mr. David Cook- Again, I want it to be known that I am opposed to that. I feel that it devalues the land, I have built a home there. Hopefully my house is in the $100,000.00 bracket. I do not feel that I want it next to a mobile home. Mr. Holt-I cannot see where there is a $100,000 home on Twin Channel Road, we hope to purchase the property after we have rented, I was not going to purchase the property without getting the variance in order to get in there. I would eventually like to build a home there, but I cannot tell you when I would do that. I have not applied for a temporary permit, I was not instructed by anyone in the Town as to how to apply, I came here two weeks ago no one told me how to fill the form out.... Supervisor Walter- Your applcation says that you are renting the property with the option to buy and you want to set up a foundation for a permanent residence. It says nothing at all about your consideration of building a house in the future. The Town Board can only know that you are looking at this for a permanent residence. Mr. Holt- I was at a Board meeting two weeks ago and was told that the application was not made out properly at that time. I sat at the back table and amended the application to be heard two weeks ago. Supervisor Walter- I remember, but at no time did he say it was to be a temporary... 224 Mr. Holt- There was a mobile home there sixteen years...it was taken out a short time ago...(Speaking to Mr. Cook) you were afforded the process, I should be allowed the same process... Councilman Monahan- Mr. Cook pointed out that he had his trailer there before we had any ordinance, therefore we had no control. Mr. Holt- I spoke to Mr. Bardin and he at that time showed me another lot on Big Boom Road, which is in the same area... Mr. Bardin That is what I am in the business for, to sell lots... Mr. Holt- I cannot understand why they are opposing it, Mr. Bardin agreed to sell me a lot at a different price than Mr. Fisher and I already agreed. Mr. Bardin-That is not relevent. Where he is talking about is across from my house, I own two houses in the area. I have been,,, Supervisor Walter- You are saying that you are appearing here tonight because you are within 500 feet of the proposed site? Mr. Bardin- Within 150' I am directly across from the lot...I have put a lot of time and effort into that place and into the one next to it and all the neighbors can tell you that. 1 have tried to move the value up, I do not want a trailer across from my houses... Mr. William L. Cook- I live across from the proposed site, beside Mr. Bardin. I want my place to have better value, I do not want anything to go against it, like a mobile home. Councilman Monahan- I do not have anything to say about the application but I think that this does point up a problem. Sometime we have to bite the bullet and find a place in this town where people who want to live in mobile homes can own their own lots. I think if we did this we would not have all these problems that we are having with these applications. Mr. Holt- I would like to second that remark, people who cannot afford to purchase $100,000 homes should be afforded the oppurtunity to have a place to live in a respectable atmosphere. Councilman Monahan-We need to find a place in the town where we can set aside land for that purpose. Supervisor Walter- I know that the Planning Board has been considering that for at least the last two years and I am sure they would welcome you to sit down with them...That is a consideration that we are well aware of. Asked for further comments, hearing none the Public Hearing was closed 8:04 P.M. PUBLIC HEARING CABLE T.V. -Rate increase request-Raise the monthly rate from $8.75 to $9.25 and the connection and reconnection charges by $5.00 and additional sets to $1.85 NOTICE SHOWN HEARING OPENED 8:05 P.M. Supervisor Walter- Requested that Mr. Nolan speak to the Board... Mr. Nolan-Counsel from Colonial Cablevision Inc.-The last time I came before the Town Board was two years ago, being the last change in our rates. The present fee for monthly service is $8.75 per month with additional sets being $1.60 per month. Tonight we are asking for an increase of .50cents per month...on the connection and reconnection, have not been changed since 1969. We requested an increase of $5.00, this would be a maximum. Many times there are specials run... There are 4,829 basic connections in the Town of Queensbury, this is the largest of the five systems easterly of West Mountain. There are 1510 additional sets in Queensbury, we pay franchise tax for the year 1983, $20,248.00. It will go out —' approximately $2500 for 1984, irrespective of the rate increase. Why do we need the increase? Operating Costs increase, salaries going up 7% a year, electronics going up, utilities increased. ...We are up 17% across the Board...We are a junior utility. We have 120 miles of cable in Queen bury. This is a luxary item, it is not like electricity or telephone...Described the new areas that have received cable in the last two years.such as Bedford Close:, Pilot Knob, Ridge Road, Sunnyside, 225 Zenas Drive etc. in the future the east side of Glen Lake, Route 149 to the new trailer park. It now cost approximately $7,000 a mile to string cable, underground is more per mile...Noted that they have run into problems with Northwest Mountain, that area is underground...cannot get a contractor to give a firm price on digging for the cable...Compared with other locations, the fees charged, Colonial is slightly lower... Councilman Eisenhart- When will Stonegate receive cable? Mr. Nolan- I was out of town today, but if they have made a run through we can do it before winter, that is underground. Councilman Olson- You will service the new trailer park? Mr. Nolan-yes Councilman Olson- If a home is sold and has cable and there is a new owner, does the new owner have to pay for a new installation? Mr. Nolan-They .pay for a new installation...The charges are maximum, there are sales... Councilman Olson-Questioned why some companies get 23 channels...for $9.50, we are getting 12 channels for a proposed $9.25... Mr. Nolan- No, you are getting 6 channels on the tier, 12 basic and 1 home box... Councilman Monahan- Questioned the form that was handed to the Councilman, noted that it said fee for basic service and listed 23 channels... Mr. Nolan- Noted that the form was misleading...We are considering adding the Disney Channel, a Religious Channel and possible Playboy Channel...Reviewed the channels that are now available... Councilman Eisenhart- Noted that he had gotten a complaint from a resident of Cottage Hill, service had been cut off during the afternoons and that when they tried to call, the line was always busy... Mr. Nolan- Noted that after the last storm there has been a problem and they are still working on it...in regard to the phone being busy, there are only two lines into the business... after hours there is an answering service... Councilman Monahan- If a resident is out of services does the individual get credit? Mr. Nolan- Yes, if they report it... Councilman Morrell- Do you have a percentage of increase of customers in the last two years? Mr. Nolan- A guess would be approximately 4,000, today, 4829. Councilman Olson- I have had less complaints in the last year and a half about service, I have had more that live close to the wires and cannot get service. Mrs. Joyce Eggleston-Twin Channel Road- Questioned when Big Boom and Twin Channel would be done... Mr. Nolan- Noted that he had visited the area and it is a marginal area for Cable Service...Will count the houses in that area again... Mrs. Goedert-Qsby. Ave.-Presented a petition from residents on the street that would like cable... Mr. Nolan-Received the petition and told Mrs. Goerdert that he would look into it... Mr. Naylor- Requested that Mr. Nolan look into the problem of service on Division Street. Mr. Nolan- I will... Mr. William Mellon- Requested service for his home on Farm to Market Road... 226 Mr. Chuck Mellon-Route 149 the corner of Martindale Road...requested service... RESOLUTIONS RESOLUTION TO APPROVE MINUTES RESOLUTION NO. 199, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Daniel Olson: RESOLVED, that the Town Board Minutes of August 14, 1984 be and hereby are -- approved. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None RESOLUTION TO RETAIN SURVEYOR RESOLUTION NO. 200, Introduced by Mr. Daniel Olson, who moved for its adoption, seconded by Mr. Daniel Morrell: WHEREAS, Mr. John B. VanDusen has sold his survey business to Mr. Leon Steves, and WHEREAS, the Town Board of the Town of Queensbury wishes to still do business with the firm, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby retains the firm of VanDusen and Steves as the Surveyors of the Town of Queensbury for the fiscal year 1984 at an annual compensation of $4,000.00 and that the Town Supervisor be and she hereby is authorized to execute on behalf of the Town a contract with Mr. Leon Steves for such services and be it further RESOLVED, that in addition to the services provided by such contract the Town Board employ said firm of VanDusen and Steves to perform other services as may be required which will involve the employment by Mr. Steves of persons to assist compiling data, drafting and similar work, and expenses in connection therewith during the fiscal year 1984 not to exceed the aggregate sum of $1,500.00 which reimbursement shall be made on itemized and certified vouchers thereafter audited by the Town Board. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None RESOLUTION TO TRANSFER FUNDS RESOLUTION NO. 201, Introduced by Mr. Daniel Morrell, who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, the Queensbury Highway Department has to stripe the roads in the Town of Queensbury per NYS regulatior,�., and �} WHEREAS, the money was not budgeted for this purpose, and there exists a surplus in D5110.100, NOW, THEREFORE BE IT RESOLVED, to transfer $5,500.00 from DR5110.100 to DR5110.440 for this purpose. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter RESOLUTION TO RETAIN INSURANCE CONSULTANT 227 RESOLUTION NO. 202 , Introduced by Mrs. Betty Monahan who moved for its adoption, seconded by Dr. Charles Eisenhart: I WHEREAS, it has been deemed necessary by the Queensbury Town Board to draw on the expertise of a professional insurance consultant, in anticipation of greater savings on insurance premiums, NOW, THEREFORE BE IT RESOLVED, to retain the services of Richard E. Schmidt, Insurance Consultant, of Binghamton, New York, for one year, the fee for such services being $1,000.00 per year. Duly adopted by the following vote: — Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None Supervisor Walter- Mr. Schmidt will be on call for the Town on Insurance matters... Councilman Morrell- How much did we save last year by having Mr. Schmidt... Supervisor Walter- Approximately $30,000 Councilman Monahan–That also gave us more coverage for the dollar... RESOLUTION TO ACCEPT DEED TO TOWN OF QUEENSBURY FOR PREMISES FOR TOWN HIGHWAY TO BE KNOWN AS FOX HOLLOW LANE RESOLUTION NO. 203, Introduced by Mr. Daniel Olson who moved for its adoption, seconded by Mr. Daniel Morrell: WHEREAS, Lucille E. Weaver, has executed and offered a deed for a Town roadway not less than fifty (50) feet in width, which is particularly described in Schedule "A: annexed hereto and made a part hereof, and WHEREAS, Paul H. Naylor, Superintendent of Highways of the Town of Queensbury, — has advised that he has made the necessary inspection of the right of way clearing, sub-base preparation, drainage implementation, and surface treatment and finds that such work has been performed in accordance with the standards and requirements of the Town of Queensbury, and he recommends that this Board accept this land for highway purposes into the Town Highway System, and WHEREAS, Thomas K. Flaherty, Superintendent of Water of the Town of Queensbury, has advised that he has made the necessary inspection of Water Line Installation in the proposed highway which is located within the geographical boundaries of the Queensbury Consolidated Water District and Funds that said installation has been made in accordance with the standards and requirements of the Town of Queensbury and that he recommends that this Board accept this land insofar as the water installation is concerned, and WHEREAS, the form of the deed has been approved by Wilson S. Mathias, Esq., Counsel to the Board, NOW, THEREFORE BE IT RESOLVED, that the aforementioned deed be and the same is hereby accepted and approved and that the Town Clerk be hereby authorized and directed to cause said deed to be recorded in the Warren County Clerk's Office after which said deed shall be properly filed and maintained in the office of the Town Clerk of the Town of Queensbury, and be it further, RESOLVED, thta this new road be hereby added to-the official inventory of Town Highways, to be described as follows: ROAD NO. 387 Description: West North-West NAME: Fox Hollow Lane Mileage: 842 ' or .16 Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None 228 Supervisor Walter- Letters of approval from the Highway Dept. and Water Dept. are on file...for Fox Hollow Lane Councilman Olson- I have looked at the road and it is an excellant job of paving... Mr. Naylor, have you verified the mileage? Mr. Naylor-Yes Councilman Morrell- If this road is accepted it will be the first road under the new foremat. Supervisor Walter- What Mr. Morrell is referring to is the new subdivision regulations approved in 1982...developers must pave new roads before they are accepted into the Town Highway System. RESOLUTION TO ACCEPT DEED TO TOWN OF QUEENSBURY FOR PREMISES FOR TOWN HIGHWAY TO BE KNOWN AS HONEY HOLLOW ROAD RESOLUTION NO. 204, Introduced by Mr. Daniel Olson who moved for its adoption, - seconded by Dr. Charles Eisenhart: WHEREAS, Northern Homes, Inc., has executed and offered a deed for a Town Roadway not less than fifty (50) feet in width, which is particularly described in Schedule "A" annexed hereto and made a part hereof, and WHEREAS, Paul H. Mr. Naylor- The road the Town is accepting is only the paved portion... Councilman Olson- At the intersectio. of Honey Hollow and Revere Road there was a cut in the pavement. Has that bee, repaired? Mr. Carusone- I have a letter from my contractor, Mr. O'Connor, that the road will be repaired... 229 Councilman Monahan-We have had it stated that we are going to have the request for approval in our hands at least a week or two weeks ahead of time. I received this particular one in my box, I do not know if it went in yesterday or today, I also got it in my mail today at home, hand delivered. Supervisor Walter- It was hand delivered yesterday. I did put an apology on there that it would have gone out last week but our copy machine was down. My Secretary did call the Board Members to tell them that we received Fox Hollow Lane. We never talked about two weeks, we talked about one week... Councilman Monahan- This was not mentioned when I received the call, I think that it is a discourtesy to the Town Board by any contractor to expect us in twenty four hours to go out and look at a road. In the future, I will vote against any road that is not in our hands for a week, I feel it is discourteous. It is like we are puppets that are having our strings pulled. While I want to be cooperative, I feel that we are leaving other things undone so that we can jump to things like this. Mr. Naylor- The road was not finished until 3:00 P.M. Saturday afternoon, that is when I made my final_inspection. RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION NO. 105, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Daniel Olson: WHEREAS, Ormen and Claudia Gilliland of Twin Channel Road have made application to this Board for a permit to locate a Mobile Home at property situated at Twin Channel Road and owned by Kathleen Eldred, and WHEREAS, upon proper investigation it appears that there is insufficient hardship and that the area is not condusive to Mobile Homes , NOW, THEREFORE BE IT RESOLVED, that there was insufficient hardship shown on the original application, and that the area is not condusive to Mobile Homes, therefore the application of Ormen and Claudia Gilliland be and is hereby disapproved and that the Town Clerk is hereby directed to notify Ormen and Claudia Gilliland of the decision of this Board. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None RESOLUTION TO DISAPPROVE APPLICATION FOR PERMIT TO LOCATE MOBILE HOME IN THE TOWN OF QUEENSBURY RESOLUTION NO. 106, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr.. Daniel Morrell: WHEREAS, Robert G. Holt of 3 Briwood Circle has made application to this Board for a permit to locate a Mobile Home at property situated at Twin Channel Park and owned by Edward Fisher, and WHEREAS, upon proper investigation it appears that there is insufficient hardship and that the area is not condusive to Mobile Homes, NOW, THEREFORE BE IT RESOLVED, that there was insufficient hardship shown on the original application, and that the area is not condusive to Mobile homes, therefore the application of Mr. Robert Holt be and is hereby disapproved and that the Town Clerk is hereby directed to notify Mr. Robert Holt of the decision of this Board. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None 230 RESOLUTION TO AMEND COLONIAL CABLEVISION AGREEMENT RESOLUTION NO. 207, Introduced by Mr. Daniel Morrell who moved for its adoption, seconded by Dr. Charles Eisenhart: WHEREAS, the Town of Queensbury and Colonial Cablevision, Inc. have heretofore entered itno an agreement to supply cable television to the residents of the Town, dated September 4, 1970 as amended, and WHEREAS, Colonial Cablevision, Inc. has applied to the Town of Queenbury to amend said agreement and a public hearing, after proper notice and publication, having been held on August 28th 1984, and it appearing that said agreement should be amended, NOW, THEREFORE BE IT RESOLVED, that an increase in the basic rate to $9.25 per month, additional sets $1.85 and connection/reconnection charges be raised an additional $5.00 be approved. Duly adopted by the following vote: Ayes: Mr. Olson, Dr. Eisenhart, Mr. Morrell, Mrs. Monahan, Mrs. Walter Noes: None Absent: None Councilman Eisenhart- Spoke to the Town Board in regard to the purchase of a new ambulance...cost $47,000 RESOLUTION TO APPROVE PURCHASE OF AMBULANCE RESOLUTION NO: 208, Introduced by Dr. Charles Eisenhart who moved for its adoption, seconded by Mr. Daniel Morrell: WHEREAS, the Bay Ridge Rescue Squad was recently involved in an accident with their ambulance, and WHEREAS, upon investigation it has been determined that it would be in the best interests of the residents of the Town that the company purchase another ambulance instead of repairing the damaged vehicle, NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Queensbury hereby approves of the purchase of an ambulance from New England Custom Coach in Hartford, Conn. in the amount of $47,000.00.
