The proposed solar development will be limited to a 33.0± acre portion of the subject property (the “Project Area”), which is situated in the northwest corner of the overall site. The Project entails the establishment of a ground mounted photovoltaic (PV) system within the immediate vicinity of the Floyd Bennet Memorial Airport. The PV system is sized to generate 6.6 MW (DC). An 8' height perimeter fence is proposed to encompass the solar array. Access to the panel array will be provided by internal gravel access roads, via an extension of an existing gravel road that extends into the site from Hicks Road. Approximately 0.86± acres of impervious area will be generated on the subject property. This Pre-Construction Notification (PCN) is being submitted for proposed unavoidable permanent impacts to approximately 0.064± acres of jointly regulated wetland, as required for the construction of the solar farm. The permanent impacts generated by the Project are associated with the construction of the proposed access road. In addition, a total of 0.050± acres of temporary impact to regulated wetlands are proposed as part of the access road construction. Being that the wetland is jointly regulated, a 100-foot Adjacent Area (A.A) encompasses the wetland and impacts within the A.A. are inevitable. A total of 0.189± acres of permanent impact and 0.096± acres of temporary impact to the regulated 100-foot A.A is planned. The Project has been prepared in accordance with Section 404 of the Clean Water Act Nationwide Permit (NWP) 14, Linear Transportation Projects and NWP 51, Land-Based Renewable Energy Generation Facilities. In addition, the project also conforms with the permit issuance standards for an Article 24 Freshwater Wetlands Disturbance Permit as well as a Section 401 Water Quality Certification (WQC). This PCN is hereby being jointly submitted to both the U.S. Army Corps of Engineers (USACE) and the New York State Department of Environmental Conservation (NYSDEC) to obtain the necessary permits required for the solar development. A completed and signed Joint Application Form is included with this PCN as Attachment 1. 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 2 1.1 Project Purpose New York’s Clean Energy Standard (CES) mandates that 70% of the State’s electricity come from renewable generation by 2030. The State’s Climate Leadership and Community Protection Act (Climate Act) requires, by law, the installation of 6,000 MW of distributed energy generation by solar by 2025. The Project, as currently designed, will provide a local source of solar power and shall contribute to assisting New York State in achieving its renewable energy goals. The purpose of the Project is to generate low-cost renewable energy for households and small businesses located in northeastern New York State. The Project will also ensure that the local community receives the benefit of locally generated, clean, alternative power. In addition, the project anticipates the creation of a habitat rich in pollen and various nectar sources to promote the use by native pollinators. Consequently, the Project also benefits and supports local agriculture. 2.0 SITE LOCATION and DESCRIPTION The Project is located along the southern side of Hicks Road, approximately 2,485± feet to the west of the intersection of Hicks Road and Queensbury Avenue, in the Town of Queensbury, Warren County New York (Figure 1). The coordinates of the approximate center of the Project Area are 43º 21’ 0.00” N latitude and 73º 36’ 45.0” W Longitude. The topography of the land consists of drainage from north to south. The typical slopes in the area of proposed development range from 5% to 15%, with localized areas over 15%. Elevations at the site vary between 318 and 352 feet above sea level. The Project Area is bounded by Hicks Road to the north, the main runways of the Floyd Bennett Airport to the east and south, and undeveloped forested lands to the west. The Project Area generally consists of an actively maintained and annually harvested farm field. Most recently (2021) the field was tilled and planted with corn (Zea mayes). The corn was harvested in early fall of 2021. Through May of 2022, the field has since remained fallow and no new crops have been planted. Areas outside of the agricultural field are wooded (to the west) or exist as Palustrine wetland, comprised of scrub-shrub and/or emergent cover types (to the east). Based on the definitions presented in the Ecological Communities of New York State (Edinger, 2014) and Classification of Wetlands and Deepwater Habitats of the United States (Cowardin, 1979), the following ecological communities are found on the Site: 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 3 • Successional Northern hardwood forest (Edinger) • Successional old field (Edinger) • Cropland – row crops (Edinger) • Palustrine scrub-shrub wetland (Cowardin) • Palustrine emergent wetland (Cowardin) Photographs of the Site, taken to document the existing conditions of the property, and a map showing the location and direction in which they were taken, are included in Attachment 2. 3.0 EXISTING CONDITIONS 3.1 Soils Information obtained from the Natural Resources Conservation Service Web Soil Survey (Version 3.2) for Warren County, New York (the “Soil Survey”), reveals that four (4) different soil types are found within the boundaries of the Site (Figure 2). These soils include: Galway loam, with 3 to 8 percent slopes (GaB); Hudson silt loam, with 3 to 8 percent slopes (HuB); Madalin silt loam (Ma); and, Rhinebeck silt loam, with 0 to 3 percent slopes (RhA). 3.2 Vegetation The property consists of a mixture of both upland and wetland vegetative cover types. The upland cover types are comprised of Successional forested upland, Successional old field, and Cropland – row crops communities (Edinger). The wetlands are comprised of Palustrine communities comprised of scrub-shrub and emergent cover types (Cowardin). The dominant species of vegetation observed within each vegetative community type are documented below. The dominant species of vegetation observed within the Successional northern hardwood forest ecological community included, but are not limited to: white pine (Pinus strobus), American beech (Fagus grandifolia), northern red oak (Quercus rubra), black cherry (Prunus serotina), red maple (Acer rubrum), sugar maple (Acer saccharum), shagbark hickory (Carya ovata), and quaking aspen (Populus tremuloides). Within the understory, dominants include: Tatarian honeysuckle (Lonicera tatarica), hawthorn (Crataegus spp), common buckthorn (Rhamnus cathartica), wood fern (Dryopteris intermedia), Virginia creeper (Parthenocissus quinquefolia), common blue violet (Viola sororia), and, garlic mustard (Alliaria officinalis). The dominant species of vegetation observed within the Successional old field community include, but are not limited to: Tatarian honeysuckle, common buckthorn, gray dogwood (Cornus racemosa), Canada goldenrod (Solidago canadensis), wild carrot (Daucus carota), spotted knapweed (Centaurea maculosa), common burdock (Arctium minus), timothy (Phleum 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 4 pratense), orchard grass (Dactylis glomerata), red clover (Trifolium arvense), white clover (Trifolium repens), plantain, wild madder (Galium mollugo), and dandelion (Taraxacum officinale). The dominant species of vegetation observed within the Cropland – row crops ecological community included, but are not limited to: corn, bristly foxtail (Setaria faberii), horse nettle (Solanum carolinense), red clover, white clover, wild carrot, and dandelion. The dominant species of vegetation observed within the Palustrine forested wetland community include, but are not limited to: red maple, green ash (Fraxinus pennsylvanica), American elm (Ulmus americana), sphagnum moss (Sphagnum spp.), skunk cabbage (Symplocarpus foetidus), and fowl manna grass (Glyceria canadensis). The dominant species of vegetation observed within the Palustrine scrub-shrub wetlands include, but are not limited to: speckled alder (Alnus rugosa), silky dogwood (Cornus amomum), gray dogwood, pussy willow (Salix discolor), sensitive fern (Onoclea sensibilis), cinnamon fern (Osmunda cinnamomea), tussock sedge (Carex stricta), jewelweed (Impatiens capensis), late goldenrod (Solidago gigantea), slender goldenrod (Solidago tenuifolia), and fox sedge (Carex vulpinoidea). The dominant species of vegetation observed within the Palustrine emergent wetland ecological community include, but are not limited to: common reed (Phragmites australis), cattail (Typha latifolia), purple loosestrife (Lythrum salicaria), wool grass (Scirpus cyperinus), dark green bulrush (Scirpus atrovirens), late goldenrod, slender goldenrod, beggar ticks (Bidens tripartita), sensitive fern, sweet flag (Acorus calamus), fringed sedge (Carex crinita), lurid sedge (Carex lurida), tussock sedge, and jewelweed. 3.3 Watershed, Drainage, and Hydrology The Site lies within the Upper Hudson River Watershed. The on-site wetlands naturally drain to the south and into the maintained portions of the airport property. Constructed ditches extend through the airport property, which transport water to the east and into culverts that extend under Queensbury Avenue. These culverts hydrologically connect the on-site wetlands with an un-named, perennial tributary that is located to the east of Queensbury Avenue. This un-named tributary flows to the east and converges with Bond Creek. Bond Creek flows to the southwest and into the Old Champlain Canal. The old Champlain Canal drains to the south and converges with the Hudson River, in the Village of Fort Edward, New York. Both the Champlain Canal and the Hudson River are classified by the USACE as a Traditional Navigable Waterways (TNW) and (a)(2) WOTUS. 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 5 4.0 WETLAND DELINEATION and REGULATORY AGENCY JURISDICTION EDP staff conducted field delineations of on-site wetlands during the fall of 2021 and again in the Spring of 2022. The identification of wetland boundaries was completed based on the methodology described in the Corps of Engineers Wetland Delineation Manual (Environmental Laboratory, 1987). Determination of wetland boundaries was also guided by the methodologies presented in the Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Northcentral and Northeast Region, Version 2.0 (USACE, 2012). Wetland boundaries were defined in the field with sequentially-numbered pink surveyor’s flagging. Wetland boundaries were subsequently mapped using GPS technology (with reported sub-meter accuracy). Raw GPS data was post-processed by the EDP survey department and then subsequently plotted on Project Site plans. As a result of the delineation, four (4) separate vegetated wetlands, totaling 20.04± acres, were identified within the boundaries of Project Area. These wetlands have been designated as “Wetland Areas A/B, B, C, and D”. Additionally, Area A/B includes wetland extensions hereby identified as Wetland Area A6, Wetland Area A11, Wetland Area A17 and Wetland Area A21. These extensions were created to differentiate between state and federally regulated components of the overall wetland complex. During the delineation, no defined tributaries were documented within the boundary of the subject property. However, a small impoundment is found in the northeast corner of Wetland A/B, adjacent to Hicks Road. The impoundment was created as a result of the prior construction of an access road leading into the property from Hicks Road. The location and configuration of the delineated wetlands are shown on the drawing titled “Wetland Delineation Map – North Site” that is dated April 5, 2022 and last revised May 6, 2022. A copy of this drawing is included as Attachment 3. 4.1 U.S. Army Corps of Engineers Regulated Waters Based on the existing conditions observed, it was determined that the majority of the wetlands identified on the site possess a direct, surface/hydrologic connection with a tributary system of a navigable waterway. While Wetlands B, C and D are not hydrologically connected via a direct surface water connection, they are “adjacent” to and function in combination with the other wetlands identified. Therefore, by regulatory definitions imposed by the USACE, they are subject to federal regulation under Section 404 of the CWA. F 4.2 Potential Non-Jurisdictional Waters During the delineation, it was determined that either a direct hydrologic connection between the on-site aquatic resources and off-site WOTUS exist, or that the wetlands are positioned in close proximity to the connected WOTUS and therefore are adjacent and thus subject to the regulatory jurisdiction of the USACE. Consequently, none of the on-site wetlands have the ability to be considered “isolated” and/or non-jurisdictional. 4.3 NYSDEC Regulated Areas The NYSDEC Environmental Resource Mapper (ERM) was reviewed to determine if State regulated streams and/or freshwater wetlands are found on the subject property. Based on the information obtained, no portions of any currently mapped Article 15 regulated streams are found on or within the boundaries of the Project Area. However, currently mapped portions of Article 24 regulated Freshwater Wetland (FWW) HF-3 are found within the boundaries of the Project Area (Figure 3). As a result, DEC Region 5 was contacted and a request for a freshwater wetland boundary validation was submitted. Subsequently, on April 5, 2022 EDP met with Mr. Nicholas Sanges of the DEC and confirmed the extent of the state-regulated wetland found within the Project Area. As a result of his review, Mr. Sanges determined that Wetland Area A/B, as delineated by EDP, correlated with the mapped portions of FWW H-3. Consequently, it was determined that Wetland Area A/B (18.06± acres) is regulated by the DEC pursuant to Article 24 of the ECL. In addition to the regulated wetland, the DEC also imposes a regulated 100-foot Adjacent Area (A.A.) surrounding the wetland. A cumulative total of 10.78± acres of the Project Area are contained within the 100-foot A.A. 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 7 On May 2, 2022, Mr. Sanges issued a wetland validation letter for the Project Area. A copy of the wetland validation letter is provided as Attachment 4. 4.4 National Wetlands Inventory (NWI) Mapped Aquatic Resources The United States Fish and Wildlife Service (USFWS) website was accessed to determine if any wetlands and/or other aquatic resources that are identified by the Aquatic Resources Mapping Program are found within, or immediately adjacent to, the Project Area. Given the information provided by the National Wetland Inventory (NWI) Wetland Mapper, it was identified that a Freshwater Shrub Wetland, a Freshwater Emergent Wetland, and a Riverine Feature are found within the immediate vicinity of the Project Area (Figure 4). The NWI mapped aquatic resources correlate with the southern portion of “Wetland A/B”, as identified and delineated by EDP. The Freshwater Shrub component of the wetland complex is further defined as PSS1Ed (Palustrine, Scrub-Shrub, Broad-leaved Deciduous, Seasonally Flooded/Saturated, Partially Drained/Ditched). The Freshwater Emergent component of the wetland is classified as PEM1/5Ed (Palustrine, Emergent, Persistent, Subclass Phragmites australis, Seasonally Flooded/Saturated, Partially Drained/Ditched). The Riverine Feature is further classified as being R4SBCx (Riverine, Intermittent Streambed, Seasonally Flooded, Excavated). 5.0 PROJECT DESCRIPTION The proposed site development is inclusive of the establishment of a solar farm consisting of approximately 8.70± acres of solar panels spaced 40.4± feet center to center and the construction of approximately 2,900± linear feet (LF) of access road, stormwater management areas, and eight-foot-high perimeter fencing. The total area of proposed disturbance is approximately 33.0± acres and 0.86± acres of impervious area will be added to the site. The project also requires the construction of staging/laydown areas, inverter transformer stations, MV transmission line trenching, and the installation of a chain link perimeter security fence. No major grading of the project site is planned, minimizing disturbance to the existing topography and natural vegetative cover. All remaining areas of the property, found outside of the Project Area, will remain undisturbed and persist in their existing ecological condition. A stormwater management system has been designed to provide pollutant removal, reduce channel erosion, prevent flooding, and safely control extreme storm events in accordance with the NYS Stormwater Management Design Manual (Design Manual). The NYSDEC issued specific guidance in April 2018 relative to stormwater management design considerations for solar panel installations. The temporary erosion control measures and post-construction stormwater 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 8 management systems for this Project have been designed in accordance with those guidelines and subsequent discussions with the NYSDEC relative to the guidelines. The “Erosion and Sediment Control Plan” is included as part of the overall site plan set, included as Attachment 5. The proposed stormwater management system for the project will include roadside swales, vegetated filter strips, and pocket ponds designed to convey runoff from the proposed gravel stormwater access roads and solar equipment pads. The roadside swales will discharge to five stormwater management devices depending on the longitudinal slope and cross slope of the road in respective areas of the site. These stormwater management devices will consist of five pocket ponds to service the impervious area created by the access roads. 5.1 Proposed Regulated Resource Impacts Given the presence of jointly regulated wetlands, buffers, and their respective location/configuration within the Project Area, total avoidance of all regulated areas was not feasible. Consequently, unavoidable permanent wetland and 100-foot A.A. disturbances will occur. However, these permanent impacts have been minimized to the greatest extent possible, while still maintaining the viability of the Project. The Project has been designed to comply with NYSDEC general Water Quality Certification (WQC) and Article 24 permit issuance standards, as well as comply with all applicable conditions associated with USACE NWP’s #14 and #51. The permanent impact proposed is associated with the upgrade and extension of an existing access of road that leads into the property from Hicks Road (Wetland Disturbance Area 1). This existing road currently crosses the regulated wetland and buffer area; however, it will need to be upgraded and widened to support construction vehicle access during construction and future maintenance operations. The width of the existing gravel access road needs to be increased from approximately 10.5 feet to 20 feet to facilitate the construction of the Project. The existing HDPE culvert found at the road crossing, which connects the pond with the wetlands to the east, will need to be replaced. A new 36’ long x 12” wide HDPE pipe is proposed. The new culvert will need to have additional cover materials deposited overtop of it to ensure it will withstand the weight of loaded construction vehicles bringing in equipment and materials to the panel and inverter transformer stations by increasing the cover over the top of this pipe, more vegetation will need to be cleared and grubbed to tie the proposed grading into the existing grade. In conjunction with the road upgrade activities, additional wetland disturbances are proposed along the eastern portion of the entrance to make the slopes more gradual, as is required to provide treatment for stormwater before it reaches the wetland areas. Alternate stormwater 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 9 management practices were explored, however, grading into the adjacent wetland areas was significantly increased by the addition of a swale and by raising the grades to convey the flows to a stormwater management area outside of the wetland areas. As a result, the least intrusive method was selected as part of this Project. Permanent wetland disturbance is also proposed along the east end of Access Road 1 (Wetland Disturbance Area 2), due to the presence of high groundwater in this location. In order to provide sufficient storage for the adjacent stormwater management basin, the proposed grades of the access road needed to be raised, thus increasing the footprint of the road and necessitating the impact. Without doing so, the adjacent basin would not have any capacity to detain and effectively treat stormwater runoff. As a result of the construction of the access roads, a cumulative total of 0.064± acres of wetlands will be permanently impacted. The proposed wetland disturbance areas are clearly depicted on the “Overall Wetland Disturbance Plan (Sheet C-900)” and “Wetland Disturbance Details (Sheet C-901)” that are included in Attachment 5. The proposed permanent impacts are further summarized in Table 2 below. Table 2. The temporary impacts are also clearly identified on the plans contained in Attachment 5. A cumulative total of 0.285± acres of proposed impact is planned. The proposed impacts to the 100-foot A.A. are clearly depicted on the plans contained in Attachment 5. These impacts are also outlined in Table 4. Table 4. Wetland impacts have been avoided and minimized by proposing the use of low pressure tracked vehicles, pile driving the solar array posts into the ground with no footings (within wetlands), and running the cables for the solar array modules outside of wetlands. Unavoidable impacts have been minimized, to the maximum extent practical, by utilizing an existing road and by strategically positioning the crossing/impact of wetland at other locations at the narrowest part, or along the fringe of wetland boundaries. In addition, an adequately sized culvert is proposed at the crossing to maintain hydrological flows and ecological 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 11 connectivity between upgradient and downgradient portions of the existing wetland complex. Wetland areas in proximity to access roads will be protected with sediment control practices and where vegetation is proposed to removed, the ground will not be disturbed, as no grubbing is proposed. Trees and shrubs will be cut to ground level, however, stumps and/or root masses will be left in place, thus no discharge of soil materials into regulated wetlands will occur. Construction impacts will be further minimized and mitigated by strict adherence to an Erosion and Sediment Control Plan that includes, but is not limited to, the use of stabilized construction entrance, Filtrexx Silt Sock, and concrete washout basin. Additionally, swales and detention basins will be installed to treat new impervious access road areas and minimize direct runoff into the surrounding wetland areas during storm events, which will reduce turbid water entering into the wetlands. These swales and basins will adhere to all state water quality requirements. 5.3 Off-site Alternatives According to the Applicant, there are no feasible off-site alternatives for the Project. A site selection analysis conducted revealed that no other properties were available for acquisition. The Applicant does not currently own or have the option to lease any other land for development at this time. The Applicant entered a lease agreement with the Owner with the intention and full understanding that it was suitable and available to solar development. The Applicant has commenced with the local municipality review and approval processes with the Town and County officials. Project plans were submitted to the Town of Queensbury and Warren County for review and preliminary approval. A formal determination under SEQR has yet to be issued. It is anticipated that the SEQR process and all local government approvals will be granted once the appropriate permits from the DEC and USACE have been obtained. 5.4 Biodiversity and Vegetation Management Plan The Applicant is committed to maintaining a biological component and overall biodiversity within planned solar developments. This can be achieved through protecting existing natural resources; enhancing habitat, where practicable; and, implementing a maintenance regime to encourage biodiversity throughout the duration of the Project. All management activities are designed to be compatible with the general operation of the solar facility and take into account the need for controlling vegetation between and underneath solar panels. The focus of the management approach is to establish and maintain grassland habitat from the existing cornfield present at the property. In addition, the Applicant will also limit mowing activities while songbirds and pollinators are most sensitive to disturbance. This approach also 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 12 establishes a more diverse plant community than would persist under more frequent mowing events. A secondary benefit is reduced maintenance costs. Nexamp Asset Management Services, Inc. (NAMS) is a full-service photovoltaic Operations and Maintenance company. Northern Gateway Renewables, LLC intends to contract with NAMS in order to provide O&M services for the project for the first five years of the system operation. At that time, Bakers Falls Solar, LLC will revisit that contract and renew the term. The following outlines a typical scope of work for an O&M provider for a large-scale solar PV array. NAMS has implemented this work plan as the basis for its services for infrastructure that it currently maintains. The primary services provided under the scope of an O&M agreement include: • Annual array and storage system preventative maintenance inspection, daily remote monitoring, unscheduled maintenance repair services, vegetation management and scheduled equipment replacement. • On-site services typically require one or two pick-up trucks and two to four licensed technicians. • Aerial inspections with small unmanned aerial systems occur annually or biannually, where permissible, using registered and insured operators and aircraft for the purpose of assessing module damage or degradation. • Technicians perform work with hand tools and battery-operated power tools and rarely require generators or any motorized or heavy equipment. • The array is designed to facilitate major equipment replacement using truck mounted boom lift every 10-15 years. The management of incompatible vegetation will include the following elements: a) Midseason mowing – Mowing operations are typically conducted two to four times per season, depending on the weather conditions and resultant growth. Normally, two to four personnel using ride-on and self-propelled mowers and weed whackers will perform the mowing operations. Any required mowing of emergent wetland vegetation will be undertaken with weed whackers as to avoid leaving tire ruts from maintenance equipment. Depending on the array location and surrounding vegetation, an arborist with boom truck may also need to thin shading tree growth and limbs adjacent to perimeter fences. b) In the event that weed control is required, NAMS uses only non-persistent solutions previously approved for use by the jurisdictional environmental authority and many municipalities for use in regulated and protected areas. The frequency of this activity is 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 13 typically once annually, if at all. Work is typically performed by licensed applicators using trailer born and backpack spraying apparatus. c) Wildflower Seeding - Reseed existing crop land or cleared area with solar-compatible pollinator mix containing 80% native/naturalized grasses and 20% native/naturalized wildflowers. Wildflowers shall be selected to provide continuous blooms between April 1 and October 15. Costs for this practice provide for purchase of a wildflower seed mix from a commercial provided (e.g., Ernst Seed). Installation costs are assumed to be similar to that for establishment of turf grass cover as required as part of the project’s soil erosion and sediment control plan. d) Snow removal may be required to allow site access during winter months; however, no snow removal operations will be performed within the array areas. Snow clearing from modules may be completed depending on the amount and type of snow, two to four times per winter, to facilitate production. Snow clearing is completed manually by three to six laborers using hand held squeegees. e) Inspection of the storm water management facilities will occur during each scheduled site inspection, no less than biannually, with maintenance provided to restore the facilities to their original condition and proper function. 6.0 PROPOSED DECOMISSIONING PLAN The Project is anticipated to operate for 40 years. At the time the Project ceases to operate, Applicant will perform decommissioning which shall include removal of all energy facilities, structures and equipment including any subsurface wires from the parcel. Any access roads created for building or maintaining the system shall also be removed and re-planted with vegetation. The solar panels and all other equipment removed from the project site, unless being reused or repurposed for another project, shall be recycled in accordance with all applicable New York State policies and procedures in effect at the time of decommissioning. Further, decommissioning will include restoring the property to its pre-installed condition, including grading and vegetative stabilization to eliminate any negative impacts to surrounding properties. Specifically, such decommissioning shall include, but is not limited to, physical removal of all ground-mounted solar collectors, structures, equipment, security barriers and transmission lines from the site. 7.0 HISTORIC and ARCHAEOLOGICAL RESOURCES EDP accessed the NYS Historic Preservation Office GIS Online Resources System for an indication of any known archaeologically sensitive areas in the vicinity of the subject parcel. EDP prepared a request to the NYS Office of Parks, Recreation and Historic Preservation 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 14 (OPRHP) for an opinion on the necessary permits or approvals for the proposed project. The request was made via letter and Project Review Cover Form May 12, 2021. OPRHP responded via letter, dated May 24, 2021, stating that no archaeological and/or historic resources will be impacted by the project. Correspondence with OPRHP is included with Attachment 6. 8.0 ENDANGERED, THREATENED and RARE SPECIES EVALUATION As directed by USACE Nationwide Permit and NYSDEC Article 24 Permit conditions and guidelines, EDP reviewed the DEC ERM to obtain information regarding the potential for state- listed endangered, threatened, or rare species of flora and fauna, as well as significant ecological community types, present on (or within the immediate vicinity of) the Project Area. Based on the information obtained, it was identified that the Site is not located within the buffered radius of any known occurrences of state-listed species. However, it was identified that two separate significant ecological community types are found within the vicinity of the airport property. These significant ecological communities include Marl Fen and Northern White Cedar Swamp (Figure 5). The U.S. Fish and Wildlife Service (USFWS) was also contacted regarding the potential for presence of federally listed endangered, threatened, or candidate species on, or within the immediate vicinity of, the Site. A review of information provided by the USFWS Information for Planning and Consultation (IPaC) database (dated May 20, 2021) revealed the potential for one endangered species, the Indiana Bat (Myotis sodalis), to be present at, or within the immediate vicinity of, the Project Area. A copy of the USFWS consultation is included in Attachment 7. The speculated presence of Indiana Bats is based on recorded occurrences of these species within all of Warren County, New York. The information obtained from the USFWS does not document physical occurrences of Indiana Bats or any critical habitat for the species on the subject property. Based on the information obtained from the DEC NHO and USFWS, it was determined that an assessment of the Project Area for the presence of Marl Fens, White Cedar Swamp and/or potential habitat conducive to the existence of Indiana Bats was required. An evaluation of the Project was conduced by EDP biologosts on April 18, 2022. During the assessment, the extent of the Project Area was traversed, the ecological community types present were identified, and the existing conditions of the properties were recorded. The Project Area is primarily comprised of open, early successional and/or active agricultural fields that border existing runways. Lands immediately adjacent to these runways are routinely mowed and maintained as “lawn”. The Project Area is bordered by forested communities to the west and contains lower elevational areas that encompass Palustrine wetlands composed of emergent and scrub-shrub cover types to the east. 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 15 While the DEC ERM shows Marl Fens and Northern White Cedar Swamp communities within the vicinity of the Project Area, no portions of either community type are found within 300± feet it. This was confirmed with a DEC wetland biologist during a confirmation visit held on April 18, 2022. Subsequently a concurrence letter, documenting that no Marl Fens or White Cedar Swamp communities are present in the Project Areas, was issued by the Department on June 17, 2022. A copy of a concurrence letter issued by the Department is contained in Attachment 7. In addition, none of the planned project activities will result in any adverse effect upon the Marl Fen or North White Cedar Swamp communities documented by the ERM. Consequently, no further coordination with the DEC relative to significant ecological communities is required. Based on the existing conditions observed, the vast majority of the Project Area is comprised of land that is void of trees. However, wooded areas are located along the western perimeter of the Project Area. Upon the evaluation of these wooded areas, it was identified that few trees exhibiting the characteristics of potential summer roosting habitat for Indiana Bats are present. Suitable summer roosting habitat is characterized by the DEC and USFWS as “…trees (dead, dying, or alive) or snags, greater than or equal to 5 inches in diameter at breast height (dbh), with exfoliating or defoliating bark, or containing cracks, crevices, or holes that could potentially be used by Indiana bats as a roost”. The potential roost trees are inclusive of several shagbark hickory (Carya ovata) and dead/damaged oaks (Quercus spp.), ash (Fraxinus spp.) and maples (Acer spp.). In addition to the roosting habitat, potential foraging habitat for Indiana Bats was also noted in the vicinity. Specific surveys (mist-netting, acoustical monitoring) to document the actual presence of Indiana Bats were not conducted. Given the presence of potential summer roosting and suitable foraging habitat, it is possible that Indiana Bats could be present and utilize portions of the Project Area for daily activities. As a result, species presence has been assumed. Based on the subsequent review of the conceptual plans, it has been determined that forest clearing activities are planned within the Project Areas. The clearing of 1.81±acres of forested habitat is proposed. Consequently, standard protocol imposed by the DEC and USFWS includes a time-of-year restriction for the cutting of these trees to avoid direct impact to individual bats. Clearing of trees would be restricted to occur between November 1 and March 31 of any given year. This is the time of the year when tree dwelling bats are not found within summer roosting habitats, and therefore, would not be subject to direct impact by the removal of trees on either site. Based on prior consultations with USFWS staff during the review of other similar project sites, if the time-of-year restriction is strictly adhered to and all tree clearing activities are limited to occur between November 1 and March 31, then direct impacts to individual bats would be 900 Route 146, Clifton Park, New York 12065 phone (518) 371-7621 Page | 16 avoided. Consequently, an effect determination of “unlikely to adversely affect” can be issued during the required Section 7 ESA interagency consultation. 9.0 FEMA FLOOD HAZARD ZONES According to the FEMA mapping obtained for the Project Area, there are no 100-year Floodplains or other Flood Hazard Areas that are found on, or immediately adjacent to, the property (Figure 6). Consequently, the Project will not result in any impacts to the 100-year flood plain. 10.0 ADDITIONAL PERMITS/APPROVALS REQUIRED To facilitate the review and coordination of the various regulatory agencies, this section provides an overview of approvals and permits required for the proposed Project.
