The purpose of this modification is to accommodate the final wetland jurisdiction as determined by NYSDEC and the Corps of Engineers. The original approved subdivision was based upon an earlier wetland delineation by NYSDEC (which they had indicated was still applicable) and a determination that all of the Corp of Engineers' wetland boundaries were within the 100 foot DEC buffer. However, when the Corps of Engineers finally looked at the site last fall they decided that they could not agree with the prior DEC delineation. This summer DEC and the Corps of Engineers finally agreed upon wetland boundaries and jurisdiction. These wetland boundaries, which are significantly different than the earlier DEC boundaries, make the previously approved subdivision plan impossible to construct without disturbing significant areas of jurisdictional wetland. Therefore, we have developed this revised subdivision plan which limits wetland disturbance to the minimum required to access the developable upland areas of the property. I am enclosing a copy of the final DEC wetland determination letter for your reference. The proposed modification reduces the number of lots from 16 to 10 and significantly reduces the amount of proposed town road. The configuration of the wetlands also prevents the construction of a subdivision thru road from Bay to Meadowbrook. In the modified plan, Lot # 10 fronting on Meadowbrook will be served by private internal roads. Enclosed are 15 sets of the modified subdivision plans and Stormwater Management Report.
