Project Summary This concept is an extension of Sub. 9-2000, subdivision approved in March of this year. The concept plan shows residential use for the lots. Lot #13 would contain 16 units, and Lot #14 would contain 20 units. Lot #16 is shown in 2 sections, A and B. Lot #16A would contain 4 separate groups of housing for a total of 116 units. Lot #16B would contain a total of 84 units in 2 groups. A total of 236 residential housing units is proposed. Wetlands Groupings of units are planned outside of wetland areas. However, there is one small area of ACOE wetlands on the subdivision map near the center grouping of buildings that is not shown on the concept plan. This wetland area should be shown and marked on a plan. A Freshwater Wetlands Permit from the Town may be needed, unless otherwise determined by the Zoning Administrator. Lavout The groupings of 4 unit buildings along Lots #13, 14, and part of 16A should be reviewed more carefully for alternative layout to have fewer access points directly onto the through road. Direct driveway access onto the through road for 9 of the 4 unit developments is in close proximity; there are 36 driveways in approximately 600 ft. of roadway. Plus, the drives for each 4 unit development are separated by just 10-20 ft. While this may be acceptable in a private loop drive/parking situation, is it acceptable onto a public road, and after considering the total amount of traffic to be generated here? There are also two access points along the proposed road between Lots #16A and 16B that may need to be restructured. The drive offset to the southwest is about 20 ft. There is another access at the center of this area that is about 80 ft. TOWN OF QUEENSBURY COMMUNITY DEVELOPMENT DEPARTMENT December 13, 2001 Infrastructure The road proposed would connect Bay and Meadowbrook Roads. There may be additional traffic to consider other than that within the development; the road is a connector and could be used as such by the public. Sewer and water information should be noted. Pedestrian Connections A connection outside of the buffer area between the northern units and all other units on Lot #16A should be considered. Density The density information provided should be reviewed carefully against the Zoning Ordinance and Subdivision Regulations. Section 179-62 Multiple Family Dwellings refers to the zoning designation as well as to the Subdivision Regulations. Section A183-22 Density provides detail. Wetlands are just one item to be subtracted from total land area to calculate density. Also to be considered is the amount of street right of way and public easements/right of way areas. Recreation Facilities Additional information on the recreation plan should be provided. Section 17"2 D. Recreation facilities notes that the anticipated recreation needs of residents should be depicted on a recreation plan. The plan should provide some level of measurement indicating the level of service to be provided concerning the clubhouse, pool, and playground. How many people will these facilities accommodate? Conclusion/Recommendations Densities and layout as noted are concerns. Use of loop roads and internal drives within groupings of housing units is a good feature. Additional site plan speck items should be noted, such as architectural features and landscaping. Planning staff is available to assist the applicant with requirements during a pre -application meeting. As a result 8 of the 10 lots would front on Willowbrook Drive which is shown as a cul-de- sac. Lot arranzement: One lot is proposed to have access off of Bay Rd. Another lot, the farthest to the east, will front on Meadowbrook Rd. All other lots will be arranged with frontage on Willow brook Rd., which is currently constructed to a point just west of Old Maids Brook. T000zraphy: The property is generally level with no areas of excessive slope. A grading plan has been submitted indicating existing and proposed contours for the western area of the subdivision. Water supply Sewage Disposal. This property is served by municipal water service. The property is part of a proposed extension to the municipal sanitary sewer system. Drainaze: (wading, drainage and erosion control plans have been submitted and are being reviewed by CT Male. Lot sizes: Lots range in from 1 acre to about 39 acres. The lot sizes as proposed meet the requirements of the Professional Office zone. Future development.• A few of the lots in this subdivision have been or are being developed. Future uses in the subdivision will be consistent with the PO zone. State Environmental Quality Review Act, SEQRA Type is Unlisted. A SEQR has been completed with the previous application reviewed by the Planning Board. The Planning Board should either reaffirm previous SEQR findings, or begin a new SEQRA review. Applicant Schermerhom • Date November 26, 2002 Page -2- Parcel History (construction/site plan/variance, SB 9-2000(previous modification), resolved 12/18/2001 Staff comments: The subdivision modification as proposed, would reduce the number of lots previously shown to 10. The new subdivision plat eliminates a road that was previously shown to connect Bay Rd. to Willowbrook Dr., and shows Willowbrook Dr. as a cul-de-sac instead of connecting to Meadowbrook Rd. All lots but 2 would have frontage on Willowbrook Rd., which is currently constructed to a point just west of Old Maids Brook. One lot will front on Bay Rd., another will front on Meadowbrook Rd. The new cul-de-sac appears to be under the 1000' limit for dead end streets contained in the Subdivision Regulations. The applicant has submitted information concerning NYSDEC and ACOE wetland delineations for wetlands shown on this subdivision plat. It should be noted, that DEC approval will be required for any fill or excavation within 100 feet of the NYSDEC wetlands shown, and a stream - crossing permit is required from NYSDEC when Willowbrook Drive is completely constructed. Final construction and dedication of Willowbrook Drive will be required before any new lots, with the exception of proposed lot 1, are issued building permits. Prior to the final construction and dedication of Willowbrook Drive by the Town of Queensbury, all landscaping shown on the subdivision's landscape plan must be put in place. Prior to this modification, the subdivision indicated that some existing trees on the lots represented as lots 2 and 5 on this modification would remain. This vegetation has been removed from the site. Also, existing landscaping that was put in place as part of the development of lot 5, and was shown on the prior subdivision plat, has not survived. All previously existing trees that were to remain must have new trees planted as replacements, and vegetation that was previously shown but has not survived must also be replanted prior to the final acceptance and dedication of Willowbrook Dr. as a town road. The Planning Board should determine if this modification requires a new SEQRA review or not. Any comments from CT Male, including comments on the stormwater management report that has been submitted with this application, should be addressed as part of this review. Nace Nace Engineering, P.C. 169 Haviland Road Queensbury, New York 12804 Dear Mr. Nace: On September 23, 2002, the New York District Corps of Engineers received a request for Department of the Army authorization for the discharge of fill material into waters of the United States to facilitate the construction of a senior housing development and an apartment complex. The request was submitted by Nace Engineering, P.C., consultant for the applicant. The site is located on Meadowbrook Road, in the Town of Queensbury, Warren County, New York. The construction would constitute the remainder of the development plans for the Baybrook Professional Park Subdivision. At an inspection of the project site on June 19, 2002, a representative of this office confirmed the extent of waters of the United States on the subject property. In a pre -construction notification submittal dated September 25, 2002, which included a drawing entitled "Baybrook Professior.,al Park - Existing Wetland Plan, dated June 20, 2002 and last revised October 15 2002, the applicant indicated that total impacts to waters of the United States would involve the discharge of fill material into 0.21 acres of wetlands. As mitigation for the proposed impacts to aquatic resources, the applicant proposes to establish 0.63 acres of wetland from uplands and deed restrict a total of 26,29 acres that includes 20.41 acres of wetlandE and 6.88 acres of adjacent uplands. It should be noted that, included in this proposal, is compensation for 0.21 acres of impacts to waters of the United States authorized under Permit Application Number 2001-00902-YN. Based on the information submitted to this office, and accomplishment of notification in accordance with the applicable federal requirements, our review of the project indicates that an individual permit is not required. It appears that the activities within the jurisdiction of this office could be accomplished under Department of the .Army Nationwide General Permit Number 39. The nationwide permits are prescribed as an Issuance of Nationwide Permits in the Federal Register dated 11/07/2002 12:04 518273165 CORPS OF ENGINES PAGE 03 January 15, 2002 (67 FR 2020). The cork may be performed without further authorization from this office provided the activity complies with the permit conditions listed in Section B, No. 39, Section C, any applicable New York District regional conditions, the following special conditions, anc any applicable regional conditions added by the State of New York, copies enclosed. Special Conditions (A) The permittee shall accomplish compensatory mitigation through the successful creation of 0.63 acre of freshwater wetlands from uplands, as described and depicted in the drawing "Saybrook Professional Park, Medical Office Building, Wetland Mitigation Plan and Details", dated January 29, 2002 and last revised October 15, 2002. The permittee shall ensure that all proposed mitigation plantings meet the federal wetland criteria outlined in the report entitled "Corps of Engineers Pletland Delineation Manual", dated January 1967, with current Corps of Engineers guidance. (B) The permittee shall ensure that all proposed mitigation plantings have an eighty-five (65) pe,rcent survival rate and the created wetland areas in conjunction with the compensatory mitigation shall have an eighty-five (85) percent coverage rate of hydrophytic plants (those with a regional indicator status of FAC, FAC+, FACW +/-, or OBL in the report entitled "National List of Plant Species that occur in Wetlands, Northeast [Region 1) ", published by the U.S. Fish and Wildlife Service)- The permittee shall also ensure that the vegetation in the created wetlands does not consist of more than a total of 10t areal coverage of common reed (Phragmites australis) and/or purple loosestrife (Lythrum salicaria). If the survival. and coverage rates are not met by August 15, 2001, and each year of the monitoring period, the permittee shall take all necessary measures to ensure the level of survival and coverage by the: end of the next growing season, including re -planting and re -grading if necessary. (C) The permittee shall provide: to this office annual reports on the statue of the mitigation activities, prepared during the growing season, no later than October 31 in each of the following five (5) years after initiation of the activities authorized by this letter. These reports shall include the following at a minimum: i. All plant species, along with their estimated relative frequency and percent cover, shall be identified by using plots measuring 10 feet by 10 feet with at least one representative plot located in each of the habitat types within the mitigation site. Vegetation cover maps, at a scale of one inch equals 100 feet, or larger scale, shall be prepared for each growing season. iii. Photographs showing all representative areas of the mitigation site shall be taken at least once each year during the period between June I and August 1S. iv. Surface water and groundwater elevations in representative areas of the mitigation site shall be recorded twice a month during April through September of each year. The location of the monitoring well or gauge shall be shown on the plan view engineering drawing. V. A corps of Engineers wetland delineation data sheet for each cover type within the mitigatior, site. If this office determines that the success criteria outlined in (A) and (B) above has not been met for at least three consecutive years during the five-year monitoring period, this period will be extended until this office determine:: that the success criteria has been met for three consecutive years. (D) All grading and planting in conjunction with the wetlands mitigation work shall be completed prior to the completion of the discharge of fill authorized herein. (E) The permittee shall ensure that no mowing of the mitigation area occurs. (F) The permittee shall undertake the authorized filling activities in a manner aimed at reducing impacts upon the general environment. In addition, the permittee shall not stockpile fill or other materials in a manner conducive. to erosion, or in areas likely to cause high turbidity runoffduring storm events. All exposed soils shall be re -vegetated in a timely manner to further reduce potential effects. The permittee shall also fence off all wetlands and other sensitive ecological areas during construction periods to prevent equipment and personnel from entering these areas. (G) The permittee shall secure a conservation easement or deed restriction on the wetland mitigation site; on the remaining 20.41 acres of Federal wetlands which lie within the 81.86 parcel and includes the 5.2 acre site where impacts were authorized under Permit Application Number,2001-00902-YN; and on 6.88 acres of uplands, to guarantee their preservation for wetland and wildlife resources. These wetland and upland areas are depicted on the drawing entitled "Baybrook Professional Park - Existing Wetland Plan", dated June 20, 2002 and last revised October 15, 2002. County Registrar of Deeds within one year following the initial plantings/seedings of the mitigation site. (H) The permittee shall assume all liability for accomplishing the corrective work should the New York District determine that the compensatory mitigation has not been fully satisfactory. If the New York District does not find the mitigation satisfactory, an extensior. of monitoring time may be required to cover any necessary remedial work. This determination covers only the work described in the submitted material. Any major changes in the project may require additional authorizations from the NFw York District. Care should be taken so that construction materials, including debris, do not enter any waterway to become drift or pollution hazards. You are to contact the appropriate state and local government officials to ensure that the subject work is performed in compliance with their requirements. This verification is valid for a period of two years from the date of this letter, unless the nationwide permit is modified, suspended or revoked. Thifi verification will remain valid for two years from the date of this letter if the activity complies with the terms of any subsequent modifications of the nationwide permit authorization. Is drainage going to be on site? Please note on Potter Road east of hydrant in front of lot #8, drainage pipe goes under road. Spring runoff goes across a large portion of lots 16 & 8. Please take note of this. Proposed Fairfield Professional Park: Request that pipe going under proposed Baybridge Dr. extension be certified that 24" is adequate to handle stream water in runoff season or heavy rains? Drainage easements to lots 15 and 12-11 are done that proposed lamps be placed 12' from edge of pavement. Based on our review of these documents we offer the following comments: Letters 1. The July 1, 2002 letter from NYSDEC to Tom Nace (Nate Engineering, P.C.) indicates that "A DEC freshwater wetlands permit will be required to proceed with planned development if it includes any form of fill, excavation or clearcutting of vegetation (... ) in the wetland or its 100 foot adjacent area". The proposed plans show the construction of the road and the detention basins within 100 feet of the DEC wetland boundary. It will be necessary for the applicant to secure a wetland permit from DEC or to relocate these improvements to avoid impacting the 100 foot adjoining area. 2. The access to Lot 10 requires crossing DEC wetlands or the 100 foot area adjacent to the wetlands. Access to this Iot should be investigated in more detail or consideration should be given to combining this lot with Lot 8. Plans I Drawing S-2, Subdivision Platt - The road frontage for Lot 3 is less than the required minimum width of 80 feet but the average width of the lot is greater than 80 feet. Based on the boards interpretation of the code this lot may require a variance. 4. Drawing S-4, Grading & Drainage Plan - The restricted outlet size shown for the detention basins on this plan do not correlate with the outlets modeled in the stormwater report. Stormtw� a e 5. Page 1- indicates that the Army Corps of Engineers (ACOE) has required wetland mitigation. The report further states that ACOE wetlands will be impacted and that new wetland areas will be created to mitigate the impacts. The report states that the wetland boundaries shown include the proposed disturbances and created mitigation wetlands. The plans should show the extent of the existing wetlands that will be impacted and the extent of the wetland mitigation. It should be noted on the grading and drainage plan that each site will require on -site stormwater detention/management. 7. The culverts sizing calculations indicate a culvert length of 80 feet but the plans indicate a culvert length of 60 feet.
