Cover Letter900 Route 146 Clifton Park, NY 12065 (P) 518.371.7621 edpllp.com August 31, 2022 Attn: Stephen Traver, Planning Board Chairman Attn: Mike McCabe, Zoning Board of Appeals Chairman Town of Queensbury 742 Bay Road Queensbury, New York 12804 Regarding: Area Variance and Site Plan Review Application Re-Submission Randles Residence – 42 Old Assembly Point Road Dear Mr. Traver & McCabe: Submitted for your distribution and review are 15 sets of the revised Area Variance Application documents for the referenced project located at 42 Old Assembly Point Road. The subject parcel consists of a lawful nonconforming (shoreline setback, side yard setback) single-family residence. As proposed, the project involves renovation of the existing building (maintaining the existing foundation) addition of a second story, attached garage, screen porch, stormwater management and shoreline buffer improvements. Variances for shoreline setback (51 ft vs. 56.71 ft required), side yard setback (8 ft vs. 20 ft required), and stormwater infiltration device setback to Lake George (88 ft vs. 100 ft required) were granted at the August 24th, 2022 Zoning Board of Appeals Meeting. After the August 24th ZBA meeting, upon further review of the Survey map provided by Van Dusen & Steves Land Surveyors, it was made apparent that the shoreline setbacks had been measured from the water elevation taken on the day the survey was performed (February 23, 2022) and not from the Lake George Mean High Water Level (MHW) of 320.20 feet. This resulted in different setback measurements than what was proposed and approved at the August 24th ZBA meeting. The revised required shoreline setback to Lake George MHW is 53.75 feet as calculated by the average of the two neighboring houses to the north and south of the subject property. The proposed shoreline setback is 46 feet. Shoreline setback relief of 46 feet vs the 53.75 feet required is requested with this application. The side yard setback relief and infiltration device setback relief will remain unchanged from the approval granted on August 24th, 2022. The proposed house addition and all other site improvements remain as was originally submitted on June 15th, 2022 and presented to the Planning Board and Zoning Board of Appeals at the August meetings.
