SUMMARY AND AUTHORIZATION Independent Wireless One (IWO) , a Sprint PCS affiliate, and the Town of Queensbury are granted a permit, on conditions, authorizing a new major public utility use and a two lot subdivision in an area classified Rural Use by the Official Adirondack Park Land Use and Development Plan Map in the Town of Queensbury, Warren County. This permit is issued based upon the express understanding that the project will be undertaken and completed only as described in the application and the Findings of Fact herein and in compliance with the Conditions herein. This project may not be undertaken until . this permit is recorded in _ the Warren County Clerk' s Office. This permit shall expire unless so recorded on or before November 16, 2001 in the names of all persons listed on the first page hereof and in the names of all owners of record of any portion of the project site on the recordation date. , This project shall not be undertaken or continued unless the project authorized herein is in existence within two years from the date the permit is recorded. For purposes of determining whether a project is in existence, the Agency will consider the extent to which the proposed activities such as the attachment of antennae, the construction of the electronic equipment cabinet, and the improvements to the access driveway were undertaken. Nothing contained in this permit shall be construed to satisfy any legal obligations of the applicant to obtain any governmental approval or permit from any entity other than the Agency, whether federal, State, regional or local . • Page 1 of 7 Project & Permit No. 2000-197 AGENCY JURISDICTION The project subject to Agency jurisdiction consists of a major public utility use and a structure over 40 feet in height, Class A regional projects requiring an Agency permit pursuant to § 809 (1) and 810 (1) (d) (18) and (5) , respectively, of the Adirondack Park Agency Act . The project also involves a subdivision by virtue of a lease agreement. The lease also constitutes a Class B regional project requiring an Agency permit pursuant to §§809 (1) and 810 (2) (c) (2) (b) of the Adirondack Park Agency Act. PROJECT DESCRIPTION AS PROPOSED The project site is a 1 . 0± acre parcel of land located on the north side of the Luzerne Road in the Town of Queensbury, Warren County, in an area designated Rural Use on the Adirondack Park Land Use and Development Plan Map. It is identified on Town of Queensbury Tax Map 123, Block 1 as Parcel 55 . 9 . The project site is described in a deed from Delcie F. Gifford to the Town of Queensbury dated September 24, 1985 which was recorded October 8, 1985 in the Warren County Clerk' s Office in Liber 675 of Deeds at Page 349 . Independent Wireless One Corporation and its wholly-owned subsidiary, Independent Wireless One Leased Realty Corporation (collectively " IWO" ) has secured a lease with the Town of Queensbury (the Town) to install and operate cellular telephone service facilities on an existing 80 foot diameter water tank owned by the Town. The project as proposed by IWO and conditionally approved herein is summarized as follows : • attachment of six. sectorized antennae with a total of nine transmitters and one GPS antenna to the existing water tank, • construction of an electronic equipment cabinet at the base of the tank, • construction of a paved access driveway and a 12 feet wide parking area, and • the subdivision of the 1 . 0± acre parcel by lease. • The project is shown on 12 drawings entitled "Site I . D. # AL33XC380-A, Luzerne Mountains, Luzerne Road, Queensbury, NY 12804" which were prepared by Clough, Harbour & Associates LLP, Engineers, Surveyors, Planners & Landscape Architects (CHA) and are dated July 13, 2001 . A reduced-scale copy of the project is shown on Drawing No. AL33XC380-C2 entitled "Enlarged Site Plan" and on Drawing No. AL33XC380-C3 entitled "Elevation and Notes," drawn by CHA and dated July 13, 2001 and are attached as a part of this permit. Page 2 of 7 Project & Permit No. 2000-197 CONDITIONS BASED UPON THE FINDINGS BELOW AND INFORMATION CONTAINED. IN THE PROJECT FILE, THE PROJECT IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: 1 . The project shall be undertaken as described in the completed application and the Findings of Fact, plans referred to in the project description and Conditions herein. In _the case of conflict, the Conditions control . Failure to comply with the permit is a violation and may subject the applicant, successors and assigns to civil penalties and other legal proceedings, including modification, suspension or revocation of the permit. 2 . This permit is binding on the applicant (s) , all present and future owners of the project site and all contractors undertaking all or a portion of the project. Copies of this permit and all the approved maps and plans referred to herein shall be furnished by the applicant (s) to all contractors prior to undertaking the project, and to. all subsequent owners or lessees of the project site prior to sale or lease . All deeds conveying all or a portion of the lands subject to this permit shall contain references to this permit as follows : "The lands conveyed are subject to Adirondack Park Agency Permit 2000-197 issued September 17, 2001, the terms and conditions of which are binding upon the heirs, successors and assigns of the grantors and all subsequent grantees . " - 3 . The Agency may conduct such on-site investigations, examinations, tests and evaluations as it deems necessary to ensure compliance with the terms and conditions hereof. Such activities shall take place at reasonable times and upon advance notice where possible. 4 . No trees, shrubs or other woody-stemmed vegetation may be cut, culled, trimmed, pruned or otherwise removed or disturbed in order to undertake the herein authorized project. This condition shall not be deemed to prevent the removal of dead or diseased vegetation or of rotten or damaged trees or of other vegetation that presents a safety or health hazard. 5 . There shall be no further land use and development without an additional or amended permit. FINDINGS OF FACT 1 . The Town of Queensbury administers an Agency-approved local land use program. Among other provisions, this means that the Agency has previously transferred to the Town permit jurisdiction over Class B regional projects to be undertaken on lands located Page 3 of 7 Project & Permit No. 2000-197 within the Town as well as authority to administer the shoreline restrictions . In addition, when the Agency reviews projects still subject to its permit jurisdiction but involving lands located within such a Town, the Agency applies the density restrictions contained in the local land use program instead of the overall intensity guidelines contained in Section 805 of the APA Act . 2 . Pursuant to §179-73 . 1 (A) of the Town of Queensbury Zoning Ordinance, the Planning Board is authorized to review and approve site plans which concern the placement and operation of telecommunications towers . Pursuant to §179-73 . 1 (C) of the Zoning Ordinance, telecommunications towers are allowed to be placed "in any light industrial and heavy industrial zone and on any property where a telecommunications tower or other tall structure (structures over 50 feet in height) exists ." 3 . Independent Wireless One Corporation and its wholly-owned subsidiary, Independent Wireless One Leased Realty Corporation (collectively "IWO" ) , is authorized to design, construct, operate, and manage Sprint,' s PCS Service Area Network in and around upstate New York. Wireless Co. , L.P. is licensed by the Federal Communications Commission (FCC) as of June 23, 1995 to provide PCS cellular telephone service to the FCC' s Major Trading Area 001 (MTA 001) . MTA 001 includes all of the area encompassing the Adirondack Park. • 4 . The proposed project is primarily designed to provide PCS cellular telephone service to an area outside the Adirondack Park. Secondarily, it will also provide service to a small portion of the Park that is that is currently serviced by IWO from its cellular telephone service facilities located outside the Adirondack Park. 5 . IWO received Site Plan approval, pursuant to §179-73 . 1 of the Queensbury Zoning Ordinance, from the Town of Queensbury Planning Board on July 25, 2000 . On July 24, 2001, the Site Plan approval was extended by the Planning Board until January 25, 2002 . 6. The construction of the existing water tank was approved by the Adirondack Park Agency on April 30, 1986 (Project No. 85-261) . 7 . The Adirondack Park Agency notified all adjoining property landowners and those parties as statutorily required by §809 of the Adirondack Park Agency Act and published a Notice of Complete Permit Application in the Environmental Notice Bulletin. No comments have been received. Page 4 of 7 Project & Permit No. 2000-197 PROJECT IMPACTS 8 . The proposed project will be substantially invisible. Existing vegetation substantially screens the existing water tank from public highways (and residences) in the vicinity of the tank other than directly from Luzerne Road in the immediate vicinity of the water tank. No additional vegetation is proposed to be cut in order to undertake the proposed project. All proposed construction will be undertaken within existing disturbed areas . The base of the existing water tower is at ground elevation 604 mean sea level (msl) . The top of the side wall is at elevation 660 msl and the top of the domed tank at elevation 670 msl . The tank is located on the side of a hill and is back dropped by the hill which rises to an elevation of approximately 1400 feet msl. The tank is also in the midst of 60-80 feet tall coniferous and deciduous trees . The proposed antennae will be approximately 9-12 inches wide and 6 feet in height and painted to match the exterior color of the water tank. The antennae will be mounted such that the top of the antennae will be flush with the top of the side wall of the water tank. The antennae will not increase the visibility of the tank. 9 . Agency review of the project based upon the pertinent development considerations set forth in §805 (4) of the Adirondack Park Agency Act and applicable regulations has determined that the project will not result in any undue adverse impacts on the Park' s resources, as follows : Preservation of existing trees and shrubs along the north, east, and west sides of the 1 . 0± acre project site is necessary to adequately avoid undue adverse aesthetic and open space impacts. 10 . The proposed project complies with the Agency' s Towers Policy adopted July 21, 1978, in that the proposed major public utility use is proposed to be located on an existing structure and is designed to blend with the structure; i.e. , it will be substantially invisible. 11 . The project as proposed and authorized herein will not cause any change in the quality of "registered, " "eligible, " or "inventoried" property as those terms are defined in 9 NYCRR 426.2 for the purposes of implementing §14 . 09 of the New York State Historic Preservation Act of 1980 . The project meets all of the pertinent requirements and conditions of the approved local land use program of the Town of Queensbury. 2 . The project would not have an undue adverse impact upon the natural, scenic, aesthetic, ecological, wildlife, historic, recreational or open space resources of the Park or upon the ability of the public to provide supporting facilities and services made necessary by the project, taking into account the commercial, industrial, residential, recreational or other benefits that might be derived therefrom. 3 . The Agency has considered all statutory and regulatory criteria for project approval as set forth in: §809 (10) of the Adirondack Park Agency Act (Executive Law,. Article 27) and 9 NYCRR Part 574 . 4 . The Agency hereby finds that the project is approvable and complies with the above criteria, provided it is undertaken in compliance with the conditions herein.
