The 0.27-acre parcel contains the existing tavern and associated parking areas. During the COVID-19 Pandemic the tavern has utilized several picnic tables and tables for outdoor seating to meet social distancing regulations and allow the tavern to operate with reduced indoor seating guidelines. The owners would like to continue the use of outdoor seating and are seeking a Special Use Permit Modification and Site Plan Review to continue this use. The proposed modification seeks to add 3 – four person tables (12 seats) on a new permeable paver patio along the north central portion in the area of the existing green space and impermeable patio on the tavern parcel. The neighboring parcel to the northeast is also owned by the tavern owners and is not proposed to be used for the tavern outdoor seating. The new permeable patio area will have a 4 ft high privacy fence as required by the NYS Liquor Authority. We have also proposed to add a reinforced turf area in the Mason Street parking area to maintain the existing approved permeability of the parcel. This modification is not requesting to add any additional impervious areas. As part of this application we have also relocated the dumpster enclosure to the northwest corner of the parcel which facilitates easier access for the garbage truck access and does not require backing up into Mason Street when it leaves the site. The current owners purchased this parcel in April 2018 and have not added any additional hard surfaces. The current owners did remove an existing unapproved patio and stairway on the south side of the parcel to facilitate installing an underground propane tank. The Sans Souci Tavern acts as a gathering place for the neighborhood and is not a destination restaurant per se. As a result, the customers are aware of the limited parking and make arrangements to carpool or park strategically. In addition, only two employee vehicles are allowed on site. The owners through the years have made arrangements with the adjacent landowners for parking as well. The customers with smaller vehicles will at times double park knowing that they will be notified to move their vehicle when a customer needs to leave. This is system has been used for years and is know to the neighborhood customers. The tavern has a maximum occupancy per the fire marshal of 105 seats. Currently there is 10 seats used in the lower floor as a waiting area and the main floor has a seating of 55 seats. This application does not increase seating capacity or require additional parking. As the proposed modification does not add additional hard surfaces to the parcel, we would request a waiver from stormwater management as this issue was addressed in the previous modification with the previous owner.
