1.3 1.3 WASTEWATER-SEWER\APPROVE\.Sniith Ben—Replacement Leaching System to Lines—10-17-2022 RESOLUTION APPROVING BENJAMIN SMITH'S APPLICATION FOR SANITARY SEWAGE DISPOSAL VARIANCES RESOLUTION NO.: 12020 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, Scott and Carol Sbrocco's (Applicants) filed an application for variances from provisions of the Town of Queensbury On-Site Sewage Disposal Ordinance Chapter 136 to install a replacement septic system with the leaching system to be located: 1. 1' from the rear property line in lieu of the required 10' setback; and 2. 2' from the side property line in lieu of the required 10' setback; on property located at 8 Colonial Court in the Town of Queensbury, and WHEREAS, the Town Clerk's Office published the Notice of Public Hearing in the Town's official newspaper and the Local Board of Health duly conducted a public hearing concerning the variance request on Monday, October 17t', 2022, and WHEREAS, the Town Clerk's Office has advised that it duly notified all property owners within 500 feet of the subject property, NOW, THEREFORE, BE IT RESOLVED,that 1. due to the nature of the variances, the Local Board of Health determines that the variances would not be materially detrimental to the purposes and objectives of this Ordinance or other adjoining properties nor otherwise conflict with the purpose and objectives of any Town plan or policy; and 2. the Local Board of Health finds that the granting of the variances is necessary for the reasonable use of the land and are the minimum variances which would alleviate the specific unnecessary hardship found by the Local Board of Health to affect the Applicant; and BE IT FURTHER, RESOLVED, that the Local Board of Health hereby approves the application of Benjamin Smith for variances from the Sewage Disposal Ordinance to install a replacement septic system with the leaching system to be located: 1. 1' from the rear property line in lieu of the required 10' setback; and 2. 2' from the side property line in lieu of the required 10' setback; on property located at 8 Colonial Court in the Town of Queensbury and bearing Tax Map No: 301.12-2-6. The existing system is a seepage pit that was installed by a previous owner that is currently in failure and was most likely installed without review and approval by the Town Building Department. Given the site constraints and effluent line location, it is not possible to install a compliant absorption field system upon the parcel, therefore two variance requests to the Local Board of Health are requested for the project. These requests are itemized on Sheet S1 of the project plans and consist of: 9 ft of relief from the rear property line and 8 ft of relief from the side property line. It is our opinion that this proposed replacement absorption system is a vast improvement for the parcel and the neighborhood. We respectfully request that this application be placed upon the Local Board of Health's meeting agendas for the October meetings.
