MACCOUN, residing at 9231 South Crestmore Way, Highlands Ranch, Colorado 80126, and LAURIE A. SHOPE, residing at 24 Applegate Lane, Falmouth, Maine 04105, parties of the first part, and ROCKHURST, LLC, a New York Limited Liability Company, with an address of 14 Bedford Circle, Mechanicville, New York 12118, party of the second part, WITNESSETH that the parties of the first part, in consideration of ONE DOLLAR ($1.00) lawful money of the United States, and other good and valuable consideration paid by the party of the second part, do hereby grant and release unto the parry of the second part, its successors and assigns forever, ALL THAT PIECE OR PARCEL OF LAND situate, lying and being in the Town of Queensbury, County of Warren and State of New York, shown and designated as Lot 1 on a map entitled "Map of a Proposed Subdivision made for John L. Polk, Jr.", dated November 11, 1991, last revised on May 17, 1996, prepared by VanDusen & Steves Land Surveyors, and filed in the Warren County Clerk's Office on June 27, 1996 in Plat B 70, as Instrument #: 1996-82. TOGETHER with a certain right of way given Richard S. Fielding by deed dated February 27, 1951 and recorded in the Warren County Clerk's Office on March 3, 1951 in Book 297 of Deeds at Page 278. SUBJECT TO all conditions, covenants, easements and restrictions of record. BEING a portion of the premises conveyed to the parties of the first part by Deed from John L. Polk, Jr., as Executor of the Last. Will and Testament of Barbara F. Polk, dated August 27, 1987 and recorded in the Warren County Clerk's Office on September 1, 1987 in Liber 696 of Deeds at Page 790; said deed reserved a life estate to John L. Polk, Jr., which was terminated upon his death on January 18, 2017. TOGETHER with the appurtenances and all the estate and rights of the parties of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, its successors and assigns forever.
