4.01 4.1 WATER\Water Main Replacement Project—Glenwood and Haviland Avenues—Set Public Hearing—11-21-2022 ORDER SETTING PUBLIC HEARING CONCERNING PROPOSED IMPROVEMENT OF QUEENSBURY CONSOLIDATED WATER DISTRICT FACILITIES -GLENWOOD AND HAVILAND AVENUES WATER MAIN REPLACEMENT PROJECT RESOLUTION NO. 12022 INTRODUCED BY: WHO MOVED ITS ADOPTION SECONDED BY: WHEREAS, the Queensbury Town Board duly established the Town of Queensbury Consolidated Water District(the "District") in accordance with New York Town Law, and WHEREAS, the Town Board wishes to improve the District's water transmission facilities by replacing approximately 2500 feet of 8" unlined cast iron water main on Glenwood Avenue between Quaker and Bay Roads and approximately 900 feet of failing 6" ductile iron pipe on Haviland Avenue between Richardson Street and Edgewater Road (Project), in accordance with Town Law §202-b, and WHEREAS, by Resolution No.: 261,2021, the Town Board accepted a total of $2,794,633.02 in American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Grant Funds from the New York State Department of Budget, such Recovery Funds to be used in accordance with the terms and conditions to be set forth by the New York State Department of Budget and/or the Federal Government, and established the ARPA Coronavirus Local Fiscal Recovery Capital Project No. 241 and the Town Board wishes to use these Recovery Funds for this qualifying infrastructure investment Project, and WHEREAS, the Town's Water Superintendent requested proposals for professional Design, Bidding and Construction Phase Engineering Services (Services) related to the Project and by Resolution No.: 373,2021, the Town Board authorized engagement of Delaware Engineering, D.P.C. (Delaware) for such Services, and WHEREAS, Delaware has prepared an Engineer's Report issued October 2022 concerning the Project together with an estimate of its cost, a copy of which Engineer's Report is duly filed in the Queensbury Town Clerk's Office and made available for public inspection and presented at this meeting, and WHEREAS, as detailed in the Map and Plan, this is a maintenance and repair project involving no substantial changes in an existing structure or facility, and therefore a Type 11 action under 6 NYCRR Section 617.5(c)(1) of the State Environmental Quality Review Act (SEQRA) regulations and therefore, no further environmental review is required, and WHEREAS, although the Town of Queensbury is a Town partially within the Adirondack Park, the District does not contain State lands assessed at more than thirty percent (30%) of the total taxable assessed valuation of the District, so permission of the State Comptroller to the proposed expenditure is not required under Town Law §202-b(5), NOW, THEREFORE, IT IS HEREBY ORDERED: 1. The project is a SEQRA Type II action pursuant to 6 NYCRR Section 617.5(c)(1) and therefore the project is not subject to SEQRA review. 2. The proposed improvements consist of the replacement of approximately 2,300 linear feet of 8" unlined cast iron water main on Glenwood Avenue between Quaker and Bay Roads and approximately 950 linear feet of failing 6" ductile iron pipe on Haviland Avenue between Riverside Drive and Edgewater Place. 2 3. The estimated cost of such improvements is $2,453,710. 4. The cost of the improvements will be funded by ARPA Funds and paid from Capital Project No.: 241. 5. The proposed improvements shall be constructed and installed as specifically delineated in the Map and Plan and in full accordance with the Town of Queensbury's specifications, ordinances or local laws, and any State laws or regulations, and in accordance with approved plans and specifications and under competent engineering supervision. 6. The Town Board shall meet and hold a public hearing at the Queensbury Activities Center, 742 Bay Road, Queensbury, New York at 7:00 p.m., on Monday, December 5t', 2022 to hear all persons interested in the improvement of the District facilities described above and to take such other and further action as may be required or authorized by law. 7. The Town Board hereby authorizes and directs the Queensbury Town Clerk to duly publish and post this Order not less than ten (10) days nor more than twenty (20) days before the public hearing date, as required by Town Law §202-b. PAGE I TOWN OF QUEENSBURY WATERMAIN REPLACEMENT PROJECT 1.0 INTRODUCTION 1.1 Purpose and Need for the Project This report has been prepared as directed by Town Law Section 12-A, Section 202-b. The Town of Queensbury owns and maintains the water distribution system which serves approximately 21,200 people and businesses through 9,100 service connections. The Town of Queensbury has aging watermains throughout the Town that are in need of replacement. These older watermains have water discoloration and some are susceptible to breaks which disrupts residents and business in the area. The Town of Queensbury is proposing to replace approximately 3,200 linear feet in two locations and install two insertion valves in the existing system. 1.2 SEQR In New York State, most projects or activities proposed by a state agency or unit of local government, and all discretionary approvals (permits) from a NYS agency or unit of local government, require an environmental impact .assessment as prescribed by 6 NYCRR Part 617 State Environmental Quality Review(SEQR). The basic purpose of SEQR is to incorporate the consideration of environmental factors into the existing planning, review and decision-making processes of state, regional and local government agencies at the earliest possible time.To accomplish this goal, SEQR requires that all agencies determine whether the actions they directly undertake, fund or approve may have a significant impact on the environment, and, if it is determined that the action may have a significant adverse impact,prepare or request an environmental impact statement. Review of 6 NYCRR Part 617.5(c)(1) provides that actions are not subject to review under SEQR that involve "maintenance or repair involving no substantial changes in an existing structure or facility." This project involves the maintenance and repair of infrastructure and is therefore not subject to review. DELAWARE ENGINEERING,D.P.C. PAGE 2 TOWN OF QUEENSBURY WATERMAIN REPLACEMENT PROJECT 2.0 WATER PROJECT DESCRIPTION 2.1 Glenwood Avenue Glenwood Avenue consists of an 8 inch cast iron watermain installed in the late 1940's. The 8 inch cast iron watermain is connected from a 12 inch watermain on Route 9 and extends along Glenwood Avenue to Bay Road and connect to and existing 12 inch watermain. Due to the age of the watermains, water discoloration is an issue along Glenwood Avenue specifically between Quaker Road and Bay Road, see Figure 1. The watermain between Quaker Road and Bay Road is approximately 2,300 linear feet. The proposed watermain will be 8 inch to match the existing size with new valves and hydrants. The replacement of the existing 8 inch watermain will eliminate the water discoloration and reduce maintenance by eliminating watermain breaks. 2.2 Haviland Avenue Haviland Avenue consists of a 6 inch ductile iron watermain installed in the early 1980's. The existing 6 inch ductile iron watermain is connected to 4 th Street and is routed along Richardson Street which eventually turns into Haviland Avenue. The 6 inch watermain dead ends near the intersection of Haviland Avenue and Edgewater Place by the Queensbury and Glens Falls boundary. The section of watermain that is in need of replacement is approximately 950 linear feet between Riverside Drive and Edgewater Place, see Figure 1. This watermain has severely deteriorated over time due to poor soil conditions in this section on Haviland Avenue. The proposed watermain will be 6 inch to match the existing size with new valves and hydrants. The replacement of the existing 6 inch watermain will reduce maintenance by eliminating watermain breaks which causes restriction of flow within the system and will help reduce water consumption by reducing excessive leakage which is typical for older watermain. 2.3 Insertion Valves The project also includes the installation of two insertion valves within the water distribution system. One of the insertion valves is located near the intersection of Quaker DELAWARE ENGINEERING,D.P.C. During watermain breaks, sections of the watermain needs to be shut down for emergency repairs. The new insertion valves are located near busy commercial areas which can help isolate sections during emergency repairs without shutdowns in large sections of the service area. 3.0, ESTIMATED COSTS The entire project is funded by ARPA (American Recuse Plan Act) and the Preliminary Project 2023 Cost Estimate is$2,453,710.00.
